A RESOLUTION GRA.NTING AN AMENDMENT TO THE EXISTING INDUSTRIAL SITE PLAN FILE NO. 03-2963 WHEREAS, WJM Properties, LLC. (hereinafter the applicant) is owner of the property located at 2605 Wayzata Boulevard West within the City of Orono (hereinafter "the City") and legally described as follows: Par 1: That part of the South half of Northeast Quarter of Section 33, Township 118, Ra�ige 23, which lies East of the East line of the plat of Orono I�ldustrial Park, and its extensions and West of the West line of the plat of Long Lake West Industrial Park and its extensions, Hennepin County,Minnesota • . Par 2: Lots 1 through 12, inclusive, Block 1, Orono I�zdustrial Park, and all of Lincoln Drive, vacated, as shown on the plat of said Orono Industrial Park (hereinafter the"property"); and WHEREAS, the applicant has applied for a Con�unercial Site Plan Review per Mtuucipal Zoning Code Section 78-821 to allow a 20' x 75' addition to an existing detached garage structure on the property; a�ld WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Plaruung Codes, the Orono Planning • Page 1 of 5 Y,1 ' I � �i f � <. • � O� O O � � 3 CITY of ORONO � - � �, � ti ti RESOLUTION OF THE CITY COUNCIL � ��`9kESII�g'�G NO. � o � � . Commission held a public hearing on November 17, 2003, at which time all persons desiring to be heazd concerning this application were given the oppornmity to speak thereon. NOW, THEREFORE, BE IT RFSOLVED by the City Council of Orono, Minnesota: FINDINGS� 1. T'his application was reviewed as Zoning File::03-2963. 2. The property is located in the(n Industrial District 3. The proposed addition is an allowed use in the I dis�ict per Zoning Code Section 78-824. 4. The Orono Planning Commission reviewed this a�plication on November 17, 2003 and • recommended approval by a vote of 6 to 0. 5. The Planning Commission made the following findings of fact: . A. The Planning Commission finds the 20' � 75' addition meets all setbacks per Section 78-825 (e). The addition also conforms to the Lot Coverage requirements of Section 78-825 (c). B. The proposed addition will result in a l�s of approximately 5 pazking stalls, however the properiy will still conform to t�e parking requirements of Section 78- 1516 (20). � C. The City Council fmds that approval of the commercial site plan for the proposed garage addition will not be detrimental to thz health, safety or general welfare of the public, will not adversely affect light, air nor pose a fire hazard or other danger to neighboring properties, nor will its use dep��ciate surrounding property values and that the proposed level of use of the propert��will be in keeping with the intent and objectives of the Zoning Code and Comprehznsive Plan of the City. D. CONCLUSIONS,ORDER,AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby approves the commercial site plan to allow a 20' x 75' addition to an existing detached gazage structure on the property, subject to the following conditions: � 1. The addition is constructed consistent with the plan submitted and annotated on Exhibit A. 2. Violation of or non-compliance with any of the terms and conditions of the commercial site plan approval shall constitute a violation of the zoning code, shall automatically ternunate any authority granted herein,and shall be punishable as a misdemeanor. . 3. The undersigned owner has read, understands and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property.
