South Brown Road on Monday, June 26, 1978, at 7:30 p.m. on
the matter of the Hennepin County Park Reserve District's
application for proposed vacation of a platted road lying
within Morris T. Baker Park Reserve legally described as

SUBJECT: Hennepin County Park Reserve District
Request to Vacate a Platted Road
The Park Reserve District, as per the attached letter, has
requested the City to vacate a portion of a platted undeveloped
road lying entirely within the boundaries of Baker Park Reserve:,
The Planning Commission should schedule a Public Hearing for
June 26, 1978.
PLANNING COMMISSION MEETING - JUNE 26, 1978
Public Hearing held. Tim Marr represented the Hennepin County Park
Reserve District and explained the request. Neighbor of 1195 Starkey
Road, Mr. Laidlaw, was present to review the proposal. He had several
comments concerning the proposed bike/hike trail location but said he
had no objection to the subject vacation. The location of a gate into
the park was discussed with comment made that gate next to Laidlaw's
property would be less desireable than one further inside park property.
Planning Commission recommended approval of vacation finding a public
benefit in single ownership and maintenance responsibilities subject
to park reserve providing private easement for existing utility lines.
Vote: Ayes (4), Nays (0), Abstention (1) McDonald. McDonald didn't
see the public benefit of the road vacation and possible moving of gate
to park boundary.

It was discussed and decided that the Fresh Water WEST SHORE LAFAYETTE
Biological Institute would daily monitor the BAY ASSOCIATION
quality of the water under a $5,000 grant. The DREDGING
project would also be checked daily by the (#319)
Watershed District, DNR and the PCA.
Frahm motioned that the Planning Commission approve
this dredging using the method specified in WAWAPA DCO
with the stipulation that the FWBI and Dr. Woods will
perform the tests specified in their letter of
May 17, 1978 and report to the City of Orono, and also
contingent on the approval of all other agency permits
and regulations. Motion seconded by Hammerel; five
ayes; McDonald abstained and Hurr opposed. Motion
carried.
This item was tabled until a meeting can be set up
with the Commission members and the applicants at
the site.
This road is located in the middle of the marsh,
entirely on Park Reserve Property. No public
purpose would be served by not vacating this
road. Therefore, a public hearing is scheduled
for June 26, 1978, at 7:30 P.M.
Applicant was not present. Public Information
Meeting was scheduled for June 12, 1978, at
8:00 P.M.
Mr. Towle was present. He explained that he now
boards 17 - 25 horses and hopes to increase that
number. He also corrected the record to show
that he is purchasing 50+ acres by Contract for
Deed, which would allow more horses to be boarded.
The original conditional use permit Ras approved
but without sanction of any increase in the
number of animals normally allowed under the
zoning code.
A public hearing was scheduled for June 121 19781

MINUTES OF A PTA NNING COMMISSION MEETING HELD ON JUNE 26, 1978
The Orono Planning Coriami s s i on met on the above
date with the following members present: Hurr,
acting chairwoman, McDonald, Frahm, Hr,mmerel,
and Wilson. Hassel will be late.
Hurr announced this was the ti e for a public
hearing for the Baker Park Reserve Road Vacation
application. Alan Olson, the City Planner,
stated he had the Affidavit of Publication and
Certificate of Mailing. Mr. Marr was present
to represent the Park Reserve District. A
neighbor, Mr.Laidlaw of 1195 Starkey Road, was
present. i`r. Marr showed the exact location
of the vacation. During the discussion, Mr.
Laidlaw had several comments regarding the
bike/hike -all, but did not object to the
road vacat in. Public Hearing closed at
7:50 P.M. Further discussion concerned the
possible moving of a gate to the property
line of Mr. Laidlaw, but he stated that would
not be a problem to him. The only thing
that could cause a problem would be people
parking their cars at the gate. Wilson

A RESOLUTION VACATING A PLAT ROAD IN THE 5W 1/4 OF
SECTION 29, T118R23 WITHIN THE CITY OF ORONO, MINNESOTA
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City of Orono has received a request from
the Hennepin County Park Reserve District to vacate a portion of a
plat road lying entirely within the Morris T. Baker Park Reserve; and
WHEREAS, no other property abutts or has access from the
portion of the plat road which is to be vacated; and
WHEREAS, after due published and posted notice, a Public
Hearing regarding said vacation was held before the Planning Commission
on June 26, 1978, and all interested persons were given an oppirtunity
to be heard; and
WHEREA.;, after due study and consideration, the City Council
of the City of Orono finds that it will be for the best public interest
to approve such vacation;
NOW, THEREFORE, BE IT RESOLVED, that such request: is hereby
granted and the said "plat road" legally described as follows:
"All of the 'Plat Road' within the City of Orono, Hennepin
County, lying west of the east 332.3 ft. as shown on the
plat of Minnetonka Carden Acres in the southwest quarter
of Section 29, Township 11.8, Range 23."

the subdivision request of Paul Englund, 980 North
Shcre Drive West, dated May 17, 1978, which states:
The applicant wishes to divide his 8.62 acre
(excluding road) parcel into two pieces, one with
house to be 3.68 acres (excluding road); the
other to he 4.98 acres (excluding road). Both
parcels meet all requirements of the RR-lB two -acre
zone. The existing house meets all setback requirements.
Planning Commission fleeting - May 22, 1978
Sketch plan reviewed and approved. Staff noted
to Planning Commission and to Mr. England's
attorney that the lot line should be relocated
slightly to provide at least four acres in each
parcel. Septic testing will be required prior to
final plat approval. Public information meeting
scheduled for June 26, 1978 at 8:00 P.M.
Staff Note: Received revised plan with dividing

Mr. Alan Olson, City Planner, entered into the
record the request for rezoning from B-2 to
LR-lA, at Stubbs Bay Marina property, 3445 Bay -
side Road, for James McCleary, dated May 17,
1978, which states:
This is a proposal to down -zone a certain portion
of the marina property. The purpose is to
establish a reasonable boundary for the authorized
dock use area required by the LMCD and the City
of Orono regulations.
The proposal was suggested to Mr. McCleary at the
Orono Marina Committee_ meeting held on April 18,
1978. The revised dock use area will provide for
66 slips as per previous years licenses without
the need for general harbor dredging. The only
dredging required tinder application #294 would
be a 30 ft. wide channel to the launching ramp.
The result of this proposal is in concert with
the Council direction given on March 30, 1978,
with no adverse precedent estatlished by the
down-zoninq.
