A RESOLUTION GRA:�TING '' A CONDITIONAL USE PERMIT FOR PLUMBING IN AN ACCESSORY STRUCTURE PER MUNICIPAL ZON�G CODE SECTION 78-303, SUBDIVISION(1� FILE #03-2929 WHEREAS, Jeffrey L. Martineau and Nielissa L. Ottinger, husband and wife, (hereinafter"the applicants") are owners of the property located at 2565 North Shore Drive R�ithin the City of Orono (hereinafter"City") and legally described as: Attached"Exhibit A" (hereinafter"the property"); and WHEREAS,the applicants have applied to the City for a condirional use perm.it per Municipal Zoning Code Section 78-303,Subdivision(17)to allow plumbing including a toilet,sink • and shower to be installed in a proposed accessory structure; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on September 15,2003,at which times all p�rsons desirinQ to be heard concerning this application were given the opportunity to speak thereon. y � NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File#03-2929. 2. The property is located in the LR-1 A Zoni.n�District,where 2 acres is the minm,� lot area. The property is approximately 1.47 acres in gross azea including�vet�amds. 3. The proposed use of the accessory structure with plumbing will not be detrimental to the residential character of the neighborhood. b. The plumbing fixtures proposed are in keeping with the intended use of the accessory structure. i c. The property size and building location are sufficient to allow the conditional . use permit to be granted. ; ; d. The CUF should be subj ect to the standard"Plumbing in Accessory Structure" conditions. e. The installation of a kitchenette in the structure would not be appropriate as that would make the building easily functional as a guest house for which the the property does not qualify. • f. The property can remain in compliance with the hardcover requirements ifthe concurrent removals of driveway are completed as proposed. 4. The City Council has considered this application including the findings and recommendations of the Planning Commission,reports by City staff, comments by the applicants and the effect of the proposed conditional use permit on the health, safety and welfaxe of the community. 5. The City Council finds that granting a conditional use pernut to allow plumbing in the accessory structure will not be detrimental to the health,safety or general welfare of the public, would not adversely affect light, air nor pose a fire hazard or other danger to neighboring properties, nor will its use depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. • � Page 2 of 6 , � � � � �� � 0 0 � '� � , � CITY of ORON� � � ti �� G~' RESOLUTION OF THE CITY COUNCIL ��kESI30g'� NO. � � � � CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the findings noted above,the Orono City Council hereby grants a conditional use permit per Municipal Zoning Code Section 78-303, Subdi�ision (17) to allow plumbing including a toilet,sink and shower to be installed in a proposed accessory structure, per the site and building plans attached to this Resolution as Exhibit B and as annotated by City staff, subject to the following conditions: 1. The applicants by executing this resolution agree and covenant that the property will be bound by the following conditions: A) the accessory building will not be used for a home occupation unless specifically approved by City or if allowed by City code; B) the accessory building will not be used as a dwelling unless a guest house CUP is obtained(site is not large enough to qualify); • C) the accesso buildin will not be rented leased or otherwise rovi rY g , p ded for use as a dwelling under any circumstances; and D) the accessory building shall not be fitted with a kitchenette (kitchen sink, range or refrigerator); and installation of such fixtures in the future shall be considered a violation of this approval. 2. The applicants shall remove excess driveway hardcover per the site plan attached as Exhibit B so that the property remains in hardcover compliance. 3. Authorities granted by this resolution run with the property not with the applicants,but are . permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance v�•ill expire on that date (October 27, 2004). 4. Violation of or non-compliance with any of the terms and conditions of this resolution shall . constitute a violation of the Zoning Code,shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicants have read, understood and hereby agree to the terms of this • resolution and on behalf of themselves,their heirs, successors and assigns,hereby a�ee to the recording of this resolution in the chain of title of the property.
