HomeMy WebLinkAboutResolution 5046 + • i a , � O� O � O • � � � CITY of ORONO � - ;. � " ��� �G~' RESOLUTION OF THE CITY COUNCIL `�kEsKO�' N0. `� 0 �. � A RESOLUTION GRANTING VARIANCES TO MiTNICIPAL ZOIVING CODE� SECTIONS 78-281(B)AND 78-1279.6 - FILE NO. 03-2905 WHEREAS,Scott J.Na�el and Heidi B.Nagel,husband and wife,(hereinafter"the applicants") are the owners of the property located at 995 Wildhurst Trail within the City of Orono (hereinafter the "City") and legally described as follows: The East 111.00 feet of the Southeast Quarter of the Northeast Quarter of the Northwest Quarter of Section 7,Township 117,Range 23;Hennepin County,Minnesota; subject to a permanent easement for street,utility and drainage purposes over and across the south 8.00 . feet of the above described property; (hereinafter the "property"); and �`VHEREAS,the applicants have made application to the City of Orono for a variance � to Orono Municipal Zoning Code Sections 78-281(b) and 78-1279.6 to allow construction of a residence addition encroaching 6' into the average lakeshore setback where no encroachment is normally allowed. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: � FINDINGS 1. This application was reviewed as Zoning File#03-2905. � 2. The property is located in the LR-1B Lakeshore Residential Zoning District,which requires minimum lot azea of 1.0 acres and minimum lot width of 140'. 3. The Planning Commission initially reviewed this application at a public hearing held on June 16,2003 and tabled the application for revisions,specifically to eliminate the . then proposed gara�e addirion which would have resulted in stxuctural lot coverage exceeding 15%and to show how hardcover could be reduced to the levels appr.oved via Resolution No. 3578 in 1995. ' 4. The Planning Commission reviewed applicants'revised plan at a public hearing held on Au;ust 18,2003 at which time the applicant requested tabling for further minor � plan rev-isions. . � Page 1 of 5 , , � O� - O O • �� g CITY of ORONO a .. � ti ��� �G�' RESOLUTION OF THE CITY COUNCIL �kEsH.Og' N0. p� � ,� � 5. The Planning Commission reviewed the final revised plan at a public hearing held on September 15, 2003 and on a vote of 6-1 recommended approval of the revised proposal based on the following findings or conditions: a) The proposed partial enclosure of the existing upper level deck to create living space will not create additional hardcover and will not have any ixnpacts on views of the lake enj oyed by neighboring property owners,hence the average setback variance should be granted. b) The proposed partial enclosure of the front entryway, and other primarily cosmetic revisions to the house, will not create additional �ardcover and require no variances. c) The property is out of compliance with the hardcover limits e�tablished for this property in 1995 via Resolution No. 3578,apparently be-;,ause the prior � owner did not remove portions of driveway that were to be r�moved. The • current property owner as a result of the currently requested improvements should be required to return the property to the 1995 approved bardcover level of 4,910 s.f. in the 75-250'zone: d) The applicants have depicted on a site plan the areas of hardco�-er they would remove in order to comply with the 1995 limitation. 6. The City Council has considered this application includin� the findings and recommendations of the Planning Commission, reports by City sta� conunents by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 7. The City Council finds that the conditions existing on this property�_�peculiar to it and do not apply generally to other property in this zoning district;th.at�anting the variance would not adversely affect traffic conditions,light,air nor pose a fire hazard or other danger to neighboring property;would not merely serve as a caanvenience to the applicants,but is necessary to alleviate a demonstrable hardship ar difficu�ty; is necessary to preserve a substantial property right of the applicants; a�d�uould be in keeping with the spirit and intent of the Zoning Code and Comprehe��i�-e Plan of the City. � Page 2 of 5 � � °� 0 0 r �� � ,; , � CITY of ORONO � -� ti ��� � �G~' RESOLUTION OF THE CITY COUNCIL `9kEsIIOg' NO. � � � � . CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings,the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Sections 78-281(b)and 78-1279.6 to allow construction of a residence addition encroaching 6' into the average lakeshore setback where no encroachment is normally allowed, subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan which are not in conformitywith Citycodes will require furtherPlanning Commission and CityCouncil review. 2. Hardcover removals as noted on Exhibit A shall be completed prior to the footing inspection for the deck room enclosure. Hardcover in the 75-250' zone shall not henceforth exceed 4,910 s.f. as indicated on Exhibit A. Applicants are advised that any future proposals for • additional hardcover on the property will likely not be approved,but might be approved only in conjunction with concurrent hardcover removals to result in no net hardcover increase on the property. 3. Authorities granted by this resolution run with the property not with the applicants,but are pernussive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (September 22, 2004). 4. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code,shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5.
