Section 10.22, Subd. 2 and Section 10.56, Subd. 16 (C)(l): Structure within 75': Structures shall be set back a minimum of75' from the OHWL of Lake Minnetonka(929.4'). (Request: To allow expansion of the principal structure located 25.1' from the OHWL of Lake Minnetonka where 75' is required). 2. Section 10.25, Subd. 6 (B): Yard Requirements: The following minimum requirements shall be observed: side yard 10 feet. (Request: To allow a side yard setback of 6.6' where 10' is required). 3. Section 10.22, Subd. 1 (B) and Section 10.56, Subd. 16 (C)(6): Average Lakeshore Setback: The average lakeshore setback line shall be a straight line connecting the most lakeward protrusions of the residence buildings on the immediately adjacent lakeshore lots. COUNCIL ACTION REQUESTED: To adopt or amend the enclosed resolution. 2 A RESOLUTION GRANTING AV ARIAN CE TO MUNICIPAL ZONING CODE SECTION 10.22, SUBDIVISION 2; SECTION 10.56, SUBDIVISION 16 (C)(l); SECTION 10.25, SUBDIVISION 6 (B); SECTION 10.22, SUBDIVISION 1 (B); AND SECTION 10.56, SUBDIVISION 16 (C)(6) FILE NO. 03-2875 WHEREAS, Sandra Ann Benson (hereinafter "the applicant")is the owner of the property located at 1376 Baldur Park Road, within the City of Orono (hereinafter "the City") and legally described as follows: Lot 20 and that part of Lot 21 lying northeasterly of a line running from a point in the northwesterly line thereof distant 23 feet southwesterly from the most northerly meander corner thereof to a point in the southeasterly line of said Lot distant 66.5 feet southwesterly from the most easterly meander corner thereof, Baldur Park, Hennepin County, Minnesota, (hereinafter "the property"); and WHEREAS, the applicant has applied to the City for a variance from Municipal Zoning Code Section 10.22, Subdivision 2; Section 10.56, Subdivision 16 (C)(l ); Section 10.25, Subdivision 6(B); Section 10.22, Subdivision l(B); and Section 10.56, Subdivision 16 (C)(6) to reconstruct and expand the roof of an existing principal structure and replace windows and doors on the second story, in the LR-1 C zoning district; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on March 17, 2003, at which time all persons desiring to be heard concerning this application were given the oppmiunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #03-2875. Page 1 of 5 2. The property is located in the LR-IC Zoning District, where 0.5 acres is the minimum required lot area. The property consists of approximately 0.27 acres. 3. The Orono Planning Commission reviewed this application on March 17, 2003 and recommended approval by a vote of 5 to 0. 4. The Planning Commission made the following findings of fact: A. The original structure has been located within this footprint since 1959; B. The property is unique in that it has lakeshore on the front and rear and almost all of the lot falls within the required 75' structure setback from the OHWL; C. The application does not propose to increase the footprint of the structure, change the existing setbacks or change the existing hardcover; and D. Additional vegetative screening along the lake side of the residence will help to mitigate the visual impacts of the added height of the structure adjacent to the lake. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other prope1iy in this zoning district; that granting the variances will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 6. The City Council has considered this application, including the findings and recommendations of the Planning Commission, rep01is by City Staff, comments by the applicant and the effect of the proposed variances on the health, safety and welfare of the community. CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances from Municipal Zoning Code Section 10.22, Subdivision 2; Section 10.56, Subdivision 16 (C)(l ); Section 10.25, Subdivision 6(B); Section 10.22, Subdivision 1 (B); and Section 10.56, Subdivision 16 (C)(6) Page 2 of 5 to reconstruct and expand the roof of an existing principal structure and replace windows and doors on the second story. Approval is subject to the following conditions: 1. Council approval is based on the site plan and building construction plans submitted by the applicant as attached to this resolution as Exhibit A. Any further amendments to the site plan may require further Planning Commission and City Council review. 2. Approval is subject to the following conditions: a) Due to substandard setback of the principal residence from the OHWL, the applicant must provide the following landscaping on the lakeside of the residence to mitigate the visual impact of the structure as it is viewed from the lake: 1. Two hardwood trees of the applicant's choice, located between the shoreline and the deck, at approximately the eastern comer of the existing deck and 20' from the property line on the northwest comer of property; and 2. Replace the existing hedge, located in front of the deck stairway, with a more substantial hedge. b) If structural removals exceed what is shown on the proposed plans, further review by the Planning Commission and City Council will be required. 3 . Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or these variances will expire on that date (March 24, 2004). 4. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicant has read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the property. Application Summary: The applicant requests the following variances to reconstruct and expand the roof of an existing principal structure and replace windows and doors on the second story: 1. Expand portion of principal structure located 25. l' the OHWL of Lake Minnetonka · where 7 5' is required; 2. A side yard setback of 6.6' where 10' is required; and 3. A 48. 7' encroachment into the average lakeshore setback. Neither the footprint of the structure nor hardcover is proposed to change with the roof expansion. The applicant proposes to remove a portion of the existing roof of the original structure and replace it with one continuous ridge, approximately 14" higher than the existing roof structure ( or l '-1 O" below the roofline attached to the west). The exact height may vary a few inches from what is proposed once the structure is worked out. Structure setback from the OHWL The existing structure is located 17.2' (at the second story deck) from the OHWL of Lake Minnetonka where 75' is required. However, the proposed roof expansion and reconstruction is located 25.1' (at the house footprint) from the OHWL. The structure is not proposed to be closer to the OHWL than it exists. However, the proposed overhangs do encroach into an already substandard setback. This encroachment changes the proposed roof expansion from 25.1' to 23.6' from the OHWL. 2. Structure setback from the side yard The existing structure is located 6.6' from the side lot line to the east where 1 O' is required. The structure is not proposed to be located closer to the side lot line than it exists. The applicant proposes l' overhangs along this side of the new roof. With the l' overhang encroachment, the proposed roof expansion will be located 5.6' from the side lot line (a difference of approximately 2"). The proposed overhangs are not considered to be part of structure or hardcover. 3. Average lakeshore setback There is one home located to the southeast of the property (1384 Baldur Park Road) and vacant lots to the west. Since there is only one adjacent neighboring lakeshore home, the average lakeshore setback is calculated according to the setback of the adjacent residence from the OHWL. The house to the east is located 65.9' from the OHWL. The applicants' structure (including second story deck) encroaches 48.7' into the average lakeshore setback. Views from the neighboring property to the east are not obstructed by the proposed #03-2875 Sandra Ann Benson 3/18/2003 Page 2 of 5 increase in roof height. That house does not look across the property in question to have a view of the lake. Therefore, an average setback variance may be appropriate. Other Comments: Structural Engineer Letter Jared K. Larson of Larson Associates Inc. has reviewed the proposed roof reconstruction for the applicant and has found that the existing foundation and walls can support the proposed work. The City's Building Inspector has reviewed the letter and finds that the information provided is sufficient. Extent of Proposed Work The proposed work includes replacement of some windows, doors and walls on the second story of the house. The first story of the structure and other portions of the home will not be modified as a result of this proposal. History: This property was granted variances in 1988 (zoning file #1280; resolution #2483) to construct the second story over the existing first story and a two level addition with parapet between the garage and the existing home. The City Council approved variances for: 30% hardcover in the 0- 75' hardcover zone; 30.9% hardcover in the 75'-250' hardcover zone; and structure located 17' from the shoreline for these additions. There is no proposed change in hardcover with this application. Hardship: The applicant has included their statement of hardship in Exhibit B 4/4. The applicants should also be asked for their testimony regarding this issue. Issues for Consideration: 1. Variances approved in 1988 permitted a second story addition on the existing home, located within the same setbacks (from the lake, side lot line and average lakeshore setback) as are currently proposed; 2. The application does not propose to increase the footprint of the structure (with the exception of minimal overhang encroachments) nor change the existing setbacks ( from the lake, side lot line and average lakeshore setback) nor change hardcover; 3. The original structure (prior to the 1988 additions) has been located within the existing footprint since 1959; 4. The neighboring structure to the east, located at 1384 Baldur Park Road, has been in its current location since before 1955; 5. The property is unique in that it has lakeshore on front and rear and almost all of the lot falls within the required 75' structure setback from the OHWL; 6. Does increasing the height of this residence within an extremely substandard setback suggest the need for additional screening or other methods to mitigate its visual impact as viewed from the lake? 7. Statement of Hardship: This property is located on a narrower portion of Baldur Park which is a point or peninsula on Lake Minnetonka North Arm. The property varies in depth from approximately 23 feet on one end to 170 feet in depth on the other with frontage on one side of the peninsula of 100 feet and the other of 60 feet. Records available indicate the original structure dating to 1959, permit records show an addition in 1971 and another in 1988. The living quarters are located entirely within the 0-75 foot setback on the north side of the peninsula and a garage just fits between the two 7 5 foot setbacks from each side of the peninsula. None of the additions ~ill be closer to the lake than the existing house and deck. D) The applicant's original proposal showed a reduction in hardcover in the 0-75' zone from 30.4% to 30.1%, and from 49.0% to 44.4% in the 75-250' zone. The initial Planning Commission review of that proposal resulted in direction from the Planning Commission to further reduce hardcover on the property, hence r.tpplicant returned with a proposal for J0.0% in the 0-75' zone and 38.9% in the 75-250' zone. The Planning Commission found this substantial hardcover reduction to be a positive aspect of thj s application and recommended approval. E) Due to the fact that this property has lakeshore on 2 sides, with a relatively small area in the 75-250' setback zone, the property has some unique hardships in that it could not support any additions without variances. F) The proposed additions will crpate no significant visual encroachment of vi~ws enjoyed by neighboring property owners, and will not be visually obtrusive within the landscape due to the topography within the irmnediate ly adjacent areas. 4 The City CoJncil has considered this application including the f ndings and recommendations of the Planning Commission, reports by C ty staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demon- strable hardship or difficulty; is necessary to preserve a substantial p~operty right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. MINUTES OF THE ORONO PLANNING COMMISSION MEETING Monday, March 17, 2003 6:30 o'clock p.m. (#4) #03-2875 SANDRA ANN BENSON, 1376 BALD UR PARK ROAD, VARIAN CE 7:45-7:55 P.M. Sandra Benson, Applicant, Wes Sampson, the Architect, and Dan Larkin, _the General Contractor, were present. Chaput reported that the applicant was requesting variances to reconstruct and expand the roof of an existing principal structure and replace windows and doors on the second story. The required variances would include principal structure located 25.1' from the OHWL of Lake Minnetonka where 75' is required, a side yard setback of 6.6' with a 1' overhang · encroachment where 10' is required, and a 48.7' encroachment into the average lakeshore setback Chaput explained that neither the footprint of the structure nor the hardcover was proposed to change with the roof expansion. She stated that the applicant proposes to remove a portion of the existing roof of the original structure and replace it with one continuous ridge, approximately 14" higher than the existing roof structure, or 1' 1 O" below the -· roofline attached to the west. The exact height may vary within inches from what is proposed once the structure is worked out. Chaput indicated that the structure was not proposed to be closer to the OHWL than what exists currently. With regard to the structural engineer's report, Chaput reported that the engineer reviewed the proposed roof reconstruction and found that the existing foundation and walls can support the proposed work. The extent of the proposed work includes replacement of some windows, doors and walls on the second story of the house. Chaput indicated that the first story of the structure and other portions of the home will not be modified as a result of this proposal. After reviewing the issues for consideration, Chaput stated th.at staff recommends approval of the requested variances to reconstruct and expand the roof of the existing principal structure with .two conditions mentioned in the memo dated February 25, 2003. Benson commented that they hoped to obtain more living space from the remodel. Chair Smith stated that, in her opinion, the remodel will be more attractive and that she had no difficulty approving the application . Rahn questioned the need for further screening , since the elevation change was so minor to cause the need for more screening. Hawn asked if the applicant objected to planting more trees. Benson stated that she could plant additional trees. Chaput reported that the applicant was requesting lot area, lot width, a setback of 43' from the OHWL, a rear yard setback, a 16' encroachment into the average lakeshore setback, hardcover within the 0-75' setback zone, and hardcover within the 75-250' lakeshore setback zone variances for construction of a new residence on the property. Chaput explained that the owner was in the process of selling the property and a potential buyer had signed a purchase agreement contingent on the ability to build a new structure on the lot rather than remodel the existing house. Chaput pointed out that the proposed home shown in the elevation is not necessarily the home that would be built, rather the buyer wants to be assured that he could build within the proposed footprint. With regard to the proposed variances, Chaput stated that the existing lot width is 50' where 100' is required and variances are necessary for new construction. She indicated that lot coverage by structure and side yard setbacks are not required for this application. The existing house on the lot is located 48' from the OHWL. The proposed house would be 43' from the OHWL where 75' is required, and 10' from the rear lot line where 30' is required. Chaput pointed out that if the required setbacks were followed, the setbacks would overlap, providing the applicant with no legal building envelope. Given the fact that vehicles would not fully fit on the driveway as proposed, staff would recommend that a driveway of at least an additional 5' in length be provided from Crystal Bay Road, moving the house 5' closer to the rear lot line than the 10' proposed and 30' required. The footprint of the home would remain at 48' from the OHWL and lessen the encroachment into the average lakeshore setback with a 5' setback from the rear lot line. Statement of Hardship: This property is located on a narrower portion of Baldur Park which is a point or peninsula on Lake Minnetonka North Arm. The property varies in depth from approximately 23 feet on one end to 170 feet in depth on the other with frontage on one side of the peninsula of 100 feet and the other of 60 feet. Records available indicate the original structure dating to 1959, permit records show an addition in 1971 and another in 1988. The living quarters are located entirely within the 0-75 foot setback on the north side of the peninsula and a garage just fits between the two 75 foot setbacks from each side of the peninsula. There are two levels to the structure with the lower level on grade and the main living level directly above. The ceiling heights of the main living level of the original structures is 6 '-10" clear.
