NOW, THi]EItEFO BE I' 1[ESLVED by the City Council of Orono, M:i.ln.esota: FINDINGS 1. This application was reviewed as Zoning File#03-2907. 2. The property is located in the LR-1B Lakeshore Residential Zoning District, tivhich requires minimum lot area of 1.0 acres and minimum lot width of 140'. The lot has a defined width of 50' at the shoreline and 45' at the 75' lakeshore setback, a_nd is 0.18 acres in area. Page 1 of 7 . ° 0 0 : CITY of ORONO , . ., . , ti . G~' RESOLUTION OF THE CITY COUNCIL kESIIOg' N O. a Q 3. The Orono Planning Commission initially reviewed this application at a public hearing held on June 16,2003 and subsequently at a continued hearing held on July 28, 2003. The applicants revised their initial proposal, and on July 21, 2003 the Planning Commission recommended partial denial and conditional approval of the variances needed for the revised proposal on a 7-0 vote, based on the following . findings: , a) The property contains an existing residence structure and detached garage. The applicants wish to remove the existing detached garage, add an attached garage to portions of the existing house, and construct a second story addition over the new garage and existing house. A portion of the existing house is located less than 75' from the shoreline, and the house severely encroaches the required 10'yard on both sides. The property also contains an existing deck within the 0-75' zone and other features which constitute additional hardcover on the properly. • , b) Approval for the second story structure encroachment within 0-75' setback zone,65'from the shoreline is a reasonable request which is supported by the hardship created by the location of the existing home. c) The side setback variances to allow a second story of structure to encroach within 4.3' of the left side lot line and within 2.4' of the right side lot line should not be approved, because the resulting structure would tend to overshadow adjoining properties and lead to future maintenance issues. d) The side setback variances requested for an attached garage addition to encroach within 6' of the left side lot line should not be approved, as the garage can be shifted to meet the 10'required side setback with some interior design changes, and no hardship exists to support this request. e) The removal of the existing 423 s.f. deck in 0-75' zone is appropriate, and replacement with a smaller 95 s.f.deck as proposed, still slightly encroaching the average setback line, is a reasonable request given the location of the existing house and the minimal impacts on neighboring views of the lake created by the revised deck proposal. • (. Page 2 of 7 , . y . O O O g . CITY of ORONO a ,:.:.., . , ti G~' RESOLUTION OF THE CITY COUNCIL `kEsH.o4 No. 2 E fl Approval of the hardcover variances per the revised plans is reasonable, finding that the plan reflects what appears to be the minimum hardcover necessary to support a reasonable residence on the property, as follows: 1) Hardcover in the 0-75' zone will be reduced from 1058 s.f. (29.4%) to 535.3 s.f.(14.8%)whereno hardcoveris allowed, byreducing deck steps and concrete slab areas. 2) Hardcover in the 75-250' zone will be reduced from 2257.1 s.f. (51.9%)to 1961.38 s.f. (45.1%)where 25%is allowed. g) Applicants should provide a suitable drainage p.lan to be developed prior to fmal Council action, to address the drainage concerns expressed by • neighboring property owners. 4. The City Council reviewed this application on July 28,2003 meeting and on a vote of 4-0 granted partial approval per the Planning Commission recommendation, directing the applicants to return with a plan meeting the established parameters and directing staff to draft a resolution for adoption. 5. The City Council reviewed the submitted revisions on August 11, 2003 and tabled the application for further revisions to eliminate excessive encroachment of the 10' side setbacks by garage roof overhangs. On August 25, 2003 the Council reviewed the further revised proposal and finds it to meet the parameters established for development of this substandard site. 6. The City Council has considered this application including the findings and . recommendations of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variances on the health, safety and welfare of the community. 7. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zonirig Code and Comprehensive Plan of the City.
