WHEREAS,the City Council of the City of Orono(hereinafter"City Council")has " adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and �. . � - WHEREAS, the City Council has considered the application by Boyer Building . . Corporation (hereinafter the "applicant") for subdivision of property located at 3320 Waterto-wn • Road and legally described as follows: � The Northeast Quarter of the Southeast Quarter of Section 32,Township 118 North, Range 23, West of the 5`''Principal Meridian, Also: The West 23 rods (379.5 feet) of the East 43 rods (709.5 feet) of the North 3:� rods (544.5 feet) of the Southeast Quarter of the Southeast Quarter of Section 32,Township 118,Range 23;Also:That part of the Southeast Quarter of the Southeast Quarter of Section 32,Township 118, Range 23,lying West of the East 43 rods(709.5 feet) and northerly of County Road and Easterly of a line described as follows: Commencing at a point in the North line of the Southeast Quarter of the Southeast Quarter distant 14 feet East from the � Northeast corner of the West 30 rods(495 feet), 1032 feet;thence Southwesterly to a point in the northerly line of County Road No. 45 distant 10.9 feet southeasterly along said Road line from its intersection with the East line of the West 30 rods(495 � feet) of the Southeast Quarter of the Southeast Quarter; Also That part� of Government Lot l, lying South of Railroad Right of Way in Section 32, Township 118,Range 23, Hennepin County,Minnesota (hereinafter"the property"); and WHEREAS,on November 25,2002 the City Council adopted Resolution No.4894 . granting Preliminary Plat Approval for the proposed development of a hvo-lot plat for single � family residential purposes; and • ��. Completion of all platting requirements of Preliminary Plat Resolution No. 4894. 2. Dedication on the plat of perimeter Drainage and Utility Easements as required in ' Resolution No. 4894. 3. Designation andadedication on the plat of wetlands subject to City and other agency jurisdiction,and granting of the standard Flowage and Conservation Easement over � said wetlands. � ' 4. Submittal of Minnehaha Creek Watershed District(MCWD)perinit approving the grading and stormwater management plan for development of the Property. 5. Payment to the City of Park Dedication Fee, Stormwater and Drainage Trunk Fee, � • final plat review fees and legal review and filing fees as identified within Resolution � No. 4894. 6. Provision to the City of a title opinion for the Property and certified copies of all recorded easements currently affecting the Property. NOW,THEREFORE,BE IT RESOLVED that based on the findings ofResolution No. 4894, the City Council of the City of Orono does hereby approve the plat of MINTAKA, Hennepin County,Minnesota subj ect to the following conditions: l. The City Clerk shall release the plat documents for filing only u�on certification by � the City Attorney and Planning Director that all requirements of the platting regulations have been satisfied. � 2.. The aforesaid plat shall be filed by the City of Orono with the Hennepin County Registrar of Titles Office on or before February 25,2004 together with a certified original copy of this resolution and executed copies of the easements and covenants pertinent thereto. The approval granted by this Resolution shall expire if the conditions of this Resolution have not been met or the plat has not been filed by the date specified above.
