Officially signed as City Clerk of Orono, Minnesota and the seal of the city. so Stine Lus ,City Clerk 11 x7" 4 r,1V). f�:- ,cLoAo t�`� CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO.7616 kEs Hoo- A RESOLUTION APPROVING ACCESS AND UTILITY EASEMENTS WHEREAS, the Orono Housing and Redevelopment Authority ("Authority") is a public body corporate and politic, and a political subdivision of the State of Minnesota; and WHEREAS, the Authority is the fee owner of certain real property located at 2700 Kelley Parkway, in the City of Orono, County of Hennepin, State of Minnesota (PID: 33.118.23.12.0007), which is legally described as Lot 1, Block 1, City of Orono Addition, Hennepin County, Minnesota; and WHEREAS, Midcontinent Communications is a South Dakota general partnership that provides telecommunications services in Minnesota and has a principal place of business at 4020 West Cayman Street, Sioux Falls, SD 57107; and WHEREAS, the Orono Housing and Redevelopment Authority Board of Commissioners adopted Resolution No. 7615 approving that certain Optical Transport Networking (OTN) Site Lease between the Authority and Midcontinent Communications whereby Midcontinent Communications will lease a portion of the Authority's property for the purpose of constructing and maintaining a structure for its OTN facilities to serve customers in and around the City of Orono, which structure will measure approximately 16 x 30 feet, with a seven-foot concrete stoop; and WHEREAS, in order to access the part of the Authority's property that is leased pursuant to the OTN Site Lease, and for the proper functioning of the OTN facilities located there, Midcontinent Communications, requires certain rights of ingress and egress and for the placement of electrical utilities; and WHEREAS, the Authority is willing to grant such easement rights according to the terms and conditions set forth in the Grant of Access Easement and Grant of Utility Easements, attached hereto, which shall each be filed of record at the sole cost and expense of Midcontinent Communications in the Office of the Hennepin County Recorder; and NOW, THEREFORE, BE IT RESOLVED by the Orono Housing and Redevelopment Authority Board of Commissioners and the Orono Housing and Redevelopment Authority as follows: 1) The Grant of Access Easement attached hereto is approved; and 2) The Grant of Utility Easements attached hereto is approved; and ‘7L-oAto CITY OF ORONO RESOLUTION OF THE CITY COUNCIL No.7616 EsHov-`" 3) The Authority Board Chair and Executive Director are authorized to execute the Grant of Access Easement and the Grant of Utility Easements.
