,cLoAo <br /> t�`� CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO.7616 <br /> kEs Hoo- <br /> A RESOLUTION APPROVING <br /> ACCESS AND UTILITY EASEMENTS <br /> WHEREAS, the Orono Housing and Redevelopment Authority ("Authority") is a public <br /> body corporate and politic, and a political subdivision of the State of Minnesota; and <br /> WHEREAS, the Authority is the fee owner of certain real property located at 2700 Kelley <br /> Parkway, in the City of Orono, County of Hennepin, State of Minnesota (PID: 33.118.23.12.0007), <br /> which is legally described as Lot 1, Block 1, City of Orono Addition, Hennepin County, Minnesota; <br /> and <br /> WHEREAS, Midcontinent Communications is a South Dakota general partnership that <br /> provides telecommunications services in Minnesota and has a principal place of business at 4020 <br /> West Cayman Street, Sioux Falls, SD 57107; and <br /> WHEREAS, the Orono Housing and Redevelopment Authority Board of Commissioners <br /> adopted Resolution No. 7615 approving that certain Optical Transport Networking (OTN) Site <br /> Lease between the Authority and Midcontinent Communications whereby Midcontinent <br /> Communications will lease a portion of the Authority's property for the purpose of constructing <br /> and maintaining a structure for its OTN facilities to serve customers in and around the City of <br /> Orono, which structure will measure approximately 16 x 30 feet, with a seven-foot concrete stoop; <br /> and <br /> WHEREAS, in order to access the part of the Authority's property that is leased pursuant <br /> to the OTN Site Lease, and for the proper functioning of the OTN facilities located there, <br /> Midcontinent Communications, requires certain rights of ingress and egress and for the placement <br /> of electrical utilities; and <br /> WHEREAS, the Authority is willing to grant such easement rights according to the terms <br /> and conditions set forth in the Grant of Access Easement and Grant of Utility Easements, attached <br /> hereto, which shall each be filed of record at the sole cost and expense of Midcontinent <br /> Communications in the Office of the Hennepin County Recorder; and <br /> NOW, THEREFORE, BE IT RESOLVED by the Orono Housing and Redevelopment <br /> Authority Board of Commissioners and the Orono Housing and Redevelopment Authority as <br /> follows: <br /> 1) The Grant of Access Easement attached hereto is approved; and <br /> 2) The Grant of Utility Easements attached hereto is approved; and <br />
