Studies have shown that sediments, cils, and debris carried into the lake from h:ihly urbanized areas have a detrimental impact on the quality of water in the lake. The intent of Orono's ordinance is to ensure that rainfall run-off will be cleansed by filtering through grassed or vegeta`ed yard areas before entering the lake. B. G - Floor Plans Exhibit H - Elevations benriw of Application - The applicant proEoses an addition consisting of a grade level attached two stall garage, an expanded family room to the rear, and a second story bedroom expansion over the new addition (review Exhibits G t A). The proposed improvements result in a 1.81 increase in hardcover within the 75-250' setback area. Applicant notes that there is no hardcover within the 0-75' setback area and that the house is located approximately 175' from the lakeshore. The majority of the surface drainage from the improvements on the site run over the expansive grassed yard betore it reaches the lake. In addition, the applicant notes that there is no excessive amounts of hardcover within the 250-500' setback area. In Light of recent Planning Commis.ion and Council action, applicants have been held to no increase in hardcover where excesses of hardcover exist with proposed new imt rovements. In cases where a turn- around is required so that a resident did not have to back out onto a public roadway, Council has re-consider.vd the policy of maintaining hard- cover at present levels. Zoni',y File #1312 August 10, 1988 Page 2 of 2 If the Planning Commission holds that the 1..88 increase is excessive and that the findings of the applicant that note that there are no excesses in hardcover within the other setback areas, that there are additional areas that could be removed without providing major hardships to the applicant. Planning Commission may consider a trade-off, asking for the removal of the accessory structures within the 250-500' setback area (approximately 417 s.f. of hardcover) to offset 502 s.f. of additional hardcover within the 75-250' setback area. There -ire no height concerns in reviewing the elevations of the additions, (Exhibit H) no major land alterations are proposed outside of the normal excavrtion for the foundation, no charges in drainage are proposed with the majority of drainage continuing_ to flow over the expansive grassed yard towards the lake. Staff Recomwndation - To ipprove the hardcover variance application ( * ) of Wi i 1 iam J. Lauer for a proposed addition to the existinq residence at 3165 N,rth Shore Drive, based on the following findings: 1. `liere is no hardcover within the 0-75' Setback area. 2. The existing house is located 175' from the defined lakeshore at 929.4 elevation.. 3. There are no excesses in hardcover within the 250-500' setback area. Options Available to the Planning Commission Regarding Conditions of Approval A. Maintain hardcover within the 75-250' setback area at 29.2% and require the removal of 1.81 of hardcover within the 75-250' setback area. B. Allow hardcover to be increased to 311 within the 75-250' setback area but require the removal of 1.8• of hardcover portions of that hardcover may be located within the 250-500' setback area. C. To approve the application as proposed providing an increase of hardcover of 1.8% within the 75-250' setback area and require no additional removal of hardcover within either the 75-250' setback area or the 250-500' setback area. • The applicant should be advised that a hardcover variance must be addressed because of the new construction/new hardcover. P'ither Planning Commission approves or disapproves of an increase in hardcover in rho 75-250' setback area, a hardcover variance must be addressed. zoning Pile #1312 Additional Comments and Planning Cemission Recommendation September 22, 1986 Page 3 of 3 Additional. Zoning Administrator. Mabusth stated that the applicant was seeking approval for a hardcover variance for an addition that will not encroach in the average lakeshore setback or 75' lakeshore setback areas. The variance would allow a 1.89% hardcover increase in the 75-250' setback area. The project will not require major excavation or land alterations. Bellows asked for readable plans. Mabusth stated that the sketch s4howing t11e proposal was staff's sketch. An updated sLrvey showing the driveway was not submitted with the application. Bellow;; admonished the Zoning Department for accepting incomplete plans. Applicant stated that he was not aware that the City required any further information. Mabusth noted for both applicant and Commission members that the land use application clearly states that a survey is required. Kelley suggested revising the variance application. He wanted to change item 14 under "Required Submittals" to include the language *current and proposed". Mr. Lauer stated that he had revier.ed the staff's drawings and felt that they were correct. Mabusth stated that the applicant showed 245 s.f. more hardcover than staff's calculations. Johnson asked if the 1.89% hardcover increase was based upon staff's calculations? Mabusth stated that the percentage was based upon applicant's calculations, staff's percentage was less. There were no comments from the public regarding this matter and the public hearing was closed. It was moved by Cohen, seconded by Moos, to recommend approval of i1312, per staff's recommendations and option B regarding conditions of approval. Cohen asked Mabusth what percentage of hardcover needed to be removed from the 250-500' zone. Mabusth stated that applicant could remove 1.89% hardcover by removing accessory structures in the 250-500' zone. Applicant was present for this matter. Assistant Planning & Zoning Administrator Gaffron Explained that the applicant was requesting some changes to his existing patio rrea. Currently there is a second story deck over a grade - level concrete patio. Applicant's proposal involves removal of the entire second story deck and construction of a 4' wide walkway at the upper level along the lakeside of the house that would connect to a new Beck above a new screen porch. He would also construct a grade -level wood deck over the existing concrete patio. Kelley asked if there woc:ld actually be a reduction in hardcover? Gaffron stated depending upon the Planning Commission's decision, there could be a small decrease or a net trade --off in the total amount of hardcover. Bellows asked if applicant was proposing a screen porch or a 3-season porch. Applicant asked for a clarification as to what differentiated one from the other. Bellows stated that a screen porch would not be closed in with storm windows, it would remain open. Applicant stated that he would be building a 3-season porch. Gaffron explained that the difference between the Purdy and Eller applications was that the Purdy application called for a new addition encroaching toward the lake. The Ellers are proposing to reduce the existing upper level deck and build a porch directly underneath it. !Bellows stated that what applicar:r is proposing is an aesthetic improvement. Kelley concurred wlL`- thiF and asked whether the net increase in hardcover in the 0-75' was in fact 128 s.f. Gaffron stated that was correct. Applicant said that he would not .increase the hardcover if that was the request of the Planning Commission. Kelley stated that he would like applicant to decrease the hardcover percentage.
