NO. � O 0 O A ItESOLUTION APPROVING A SUBDIVISION OF A LOT�,INE REA,RRANGEMENT FOR PROPERTIES LOCATED AT 2730 AND 2760 P�iEASANT ROAID � � FII,E#03-2900 �. WHEREAS, the City of Orono is a murucipal corporation organized and existing under the laws of the State of Minnesota; and �VI�[EYtEAS, the City Council of Orono (hereinafter"City Council") has.adopted subdivision regulations for the orderly,economic and safe development of land within the City;and �IEREAS,the City Council has considered the application for a subdivision of a � 1ot line rearrangement by William Yale Smiley, owner of 2730 Pheasant Road, and Timothy J. and ,• J{elly A. Mahoney, owners of 2760 Pheasant Road (hereinafter "the subdividers"} of�roperties ?egally described as: Lot 2,Block 1,YALE SMII,EY ADDITION, (Smiley) and Lot 15, "Pheasant Lawn"(Mahoney) . The above praperties in Henn�pin County,Minnesota; (hereinafter"the properties"); and WgiEREAS,the properties consist of two developed lots ovcmed by the subdividers and shown on the:survey attached hereto as Enhibit"A"; and tiVHEREAS, after due published and mailed notice in accordance with Minnesota � Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning � Commission held a public hearing on May 19,2003, at which time all persons desiring to be heard . concerning this application were given the opportunity to speak thereon; and � WHEREAS,the subdividers have completed all requirements of the City for a xnetes and'oounds subdivision of a lot line rearrangement for division and combination purposes,resulting .� in the relocation of the common lot boundaryberiveen'flie�roperties,as sho�m in the sur.vey attached as Exhibit"A"resulting in a new legal description for each parcel as shown,in��Exhibit"A"; and � ,� Page 1 of 3 .. _a • O . � � . . � O >, O � ,� ' - :-� � CITY of ORONO , ti ��� �G�' � RESOWTION OF THE CITY COUNCIL �kES�IOg' � NO. q� � � O WHEREAS,the intent of the reanangement is to allow for the construction of a new attached garage for the Smiley property without requiring a side setback variance. � WHEREAS, the LR-1B Single Family Lakeshore Residential District requires a minimum lot area of 1.0 acres and a minimum lot width of 140'. Prior to the lot line reanangement each lot was substandard in lot area and lot width compared to the standards for the LR-1B zoning district; and after the lot line rearran�ement each lot remains substandard in lot area but neither lot gains or loses area. The Smiley parcel decreases in defined width from 109' to 105' at the 75' lakeshore setback, and the Mahoney parcel increases in defined width from 125'to 129' at the 75' setback. However, the two parcels still meet the intent of the Comprehensive Plan of the City of � Orono because no new building�sites are created,having no impact on the overall density; and NOW, THEREF'OItE, BE IT RESOLVED, that the City Council of the City of .Orono hereby approves the lot line rearrangement of the properties by the subdividers as shown on . the certificate of survey by Mark S. Gronberg,a licensed surveyor of Gronberg&Associates,dated • June 2,2003, as�attached in Eachibit"A", subject to the following conditions: 1. Applicants shall provide a title opinion for the property confirming ownership and encumbrances. 2. Applicants shall dedicate to the public an appropriate dzainage and utility easement along the new property line. 3. The aforesaid division shown on the attached Certificate of Survey shall be filed by the City of Orono with either the Hennepin County Recorder's Office or Registrar of Titles Office on or before December 23, 2003 to�ether with a certified original copy of this resolution. 4. The approval granted by this resolution shall expire if the division has not been filed by the � date specified above.
