Applicant is requesting a 35' right yard setback and a 10' left side yard setback as well as a lot area and width variance. Discussion mostly concerned staff's request that he reverse the side yard setbacks. Mr. Baxter stated that although he would go along with the request, the topography of the lot made if more feasible to build the proposed house as his plans indicated. Hannah moved to approve the variances, as originally submitted, as the situation is improved by the combining of four drastically substandard lots into one building site due to the hardship of no other land being available and the topography of the lot, conditioned upon the combination of the lots. Motion seconded by Hammerel. Vote: Ayes (6), Nays (0). Motion passed unanimously. Mr. Worre was present. Also present were his neighbors to the south and across the street. The request was for a 7' front yard setback and a 10' side yard setback. Mr. Worre stated he was now requesting a 10' front yard setback instead of the 7' previously requested. Some questions were regarding the height of the building. numbers of rooms proposed and their proposed uses. It was stated that the existing garage would be kept. Neighbors noted that there was a 4' X 6' shed also located on the property. The mair. concern of the neighbors was that they did not want the addition so close to the south lot line as the neighboring house is only 8' from the property line and the proposed building would create a distance of 28' between the houses. Neighbors across the street felt that the neighborhood was more "open" than adjacent areas of Crystal Bay and was perhaps the only area with those distinctive qualities - they would prefer to keep this "openness". Planning Commission also questioned the size of the addition wondering if it would be feasible to make it smaller thereby increasing the distances between the houses. Mr. Worre stated that the size of the addition was because of a landing and stairs that would be needed to get to the addition. It would also be used for a breezeway and an access to the back yard. The structure, built upon a cement slab, was built about the same time as the garage. At one time the building was used as a potting shed but in recent years as a doghouse. If the structure remains, we should determine future use. We have reviewed Mr. Worre's floor plans and agree that a reduction in the width of the breezeway is not feasible if he plans to construct a room above the garage. Plummer's Subdivision of Lot 2 of Kitchel's Subdivision of Government Lots S and 6. Such vacation to be approved without relocation of the public right-of-way based on the following findings: HENNEPIN COUNTY PARK RESERVE DISTRICT Big Island STREET VACATIONS (#444) 1. The vacation does not affect access to or use of any affected or adjoining property. 2. The City has not and does not intend to develop, improve or use the property in any way. 3. The property as it exists serves nn public purpose. 4. The vacation is in the PUBLIC INTEREST, by: a) furthering plans of the Park Reserve District, b) reducing city liability for maintenance, and c) increasing taxable valuation. S. The Supreme Court ruling applies to access TO the lake which is not applicable in this factual case. The only members of the public needing access are the three affected property owners who each have independent access available. 6. It was stared that the request was for a 10' front yard variance and a 10' side yard -ariance. The height of the proposed building is 17-112' with nothing proposed for the upstairs at this time. Most of the discussion was regarding the comparison figures of LR-1C-1 and the M-6 zoning districts in relation to the proposed development (comparison prepared by staff in their memo of December 4, 1978, Page 3). During the discussion it was determined that the proposal was not suited for the M-6 zoning district. Planning Commission suggested that the applicant submit a PRD Subdivision within the LR-IC-1 zoning district. Applicant agreed to look into this possibility and to contact staff as to which direction he would pursue. CORRECTIONS: Page 3, Patrick Baxter: 1. Correct application number is #445. 2.
