Street within the f Orono a 1 OrA� V described the Y C. located �sL 1,85 Arhm Stree� � hi .he City of Ors o r en__l, e ib d. as follows: Lots 1, 2, 3, 4, 5; 6, 7, 8, 19, 20, 21, 22, 23, 24, 25, 26, 27 and 28, Block 2, Maxwell's Addition to Crystal Bay, Hennepin County, Minnesota (hereinafter the property"); and WHEREAS, the applicants have applied to the City for a variance to Municipal Zoning Code Section 10.28, Subdivision 5 (B) to permit the construction of a 10' x 24' 8" addition to the north side of the existing single stall garage to be placed 27' 3 " from the street lot line instead of the required 50' . NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: 1. This application was reviewed as Zoning File �#1870. 2. The property is located `the'RR-1B Rural Residential Zoning District requiring two acres in area. The subject property consists of approximately 31/2 acres in area. 3. The 31/2 acre parcel is served with municipal sewer. 4. The Orono Planning Commission reviewed this application on September 207 1993 and. recommended approval of the proposed variance based upon the following findings: A. Existing structure was not constructed under current two acre zoning setback standards. B. The location of structure on lot and setback is similar to other properties in the Crystal Bay neighborhood. The steeper sloping topographies to the rear would require major filling if structure was to be moved further away from the street and still be installed as an attached garage. =L: There i as Lever been a vexaicular accident resulting from the use of the garage at this street setback. 4. The City Council fords that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and. the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the findings noted above, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.28, Subdivision 5 (B) to permit construction of a 10' x 24' 8" addition to the north side of the principal structure to be located 27' 3" from the street lot line with a setback variance at 22' 7" or 45.5%, subject to the following conditions: 1. Authorities granted by this resolution run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (September 27, 1994). 2. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning .code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property.
