It was moved by Goetten, seconded by Hurr, to approve Resolution #3330 for applicant Irwin
Jacobs, 1700 Shoreline Drive, granting variances to Municipal Zoning Code Section 10.03,
Subdivision 9 (C) to allow six oversized accessory structures on the property where only one
is allowed and to approve a variance to the allowed total area of accessory structures on the
property of 4,633 s.£ or 77% and grants a conditional use permit per Municipal Zoning Code
Section 10.27, Subdivision 3 for construction of a guest ·house. Ayes 4, Nays 0.

It was moved by Goetten, seconded by Hurr to approve Resolution #3331 for applicants
Stephen & Randi Carlson, 1185 Arbor Street, granting a variance to Municipal Zoning Code
Section 10.28, Subdivision 5 (B) to permit construction of a 10' x 24'8" addition to the north
side of the principal structure to be located 27'3" from the street lot line with a setback
variance at 22'7" or 45.5%. Ayes 4, Nays 0.

AVENUE NORTH-VACATION OF DRAINAGE & UTILITY EASEMENTS -
RESOLUTION #3332
Mabusth explained the memo from Steve Weckman specifically discussing salt based surface
discharge (water softener discharge). The question is whether we could allow this discharge
on the surface. Mabusth asked Steve Weckman to give some background that this has been
allowed in the past. He contacted Mark Westpetal at MPCA who concurred that it was
. alright to do but that if there were wetlands adjacent, he would prefer a trench be installed to
carry the discharge. He also stated that if there weren't severe slopes a trench wouldn't be
needed and it could be discharged on the surface and wouldn't damage the ground.
It was moved by Goetten, seconded by Hurr to recommend approval of Resolution #3332
for Orono Woodlands Inc. approving the vacation of the drainage and utility easement
dedicated in the Eckstrom Addition over Lot 2, Block 1 and in the Phillips Woodland Terrace .
over Lot 4, Block 1 as shared lot line will be redefined and former drainage and utility
easements will be obsolete. Ayes: 4 Nays, 0.
MAYOR/COUNCIL REPORT
(A) Comment on Application #1829 Diane Sieff
Mayor Callahan commented on a visit by Gerhardson and Mabusth to the site. He had
requested an assessment of how Wildhurst Trail got to it's current condition and what could
be done to improve the situation. He felt that Mrs . Sieff would be suffering damage to her
property and that the condition shouldn't exist in the City. Mayor Callahan requested that
further additional information be gathered and further consideration be given as to
recommendations for repair of Wildhurst Trail.
Goetten noted that this application had been on a the Consent Agenda at the last meeting and
she voted against it. Her concerns were shared driveway and hardcover excesses.

Variance -Resolution
The Planning Commission unanimously approved a street setback variance for a 10' x
24' 8" addition to the north side of an existing single stall garage. The existing attached garage
is located 27' 3' from street setback line. The addition will be placed at the same setback.
Major structural portions of the existing single stall garage will be saved during the
reconstruction. The foundation and floor of the existing garage will be replaced as it is in a
serious state of disrepair and can no longer be used for the storage of cars.
The enclosed approval resolution has been drafted per the Planning Commission
recommendation.

Stephen Carlson was present.
Mabusth explained the applicant proposes a single stall garage addition to the existing principle
structure that will be located in a sub-standard street setback. The single stall garage has a
lower level. The floor is collapsing and is very unsafe.
Mabusth asked if this would be a double-level garage.
Mr. Carlson responded that his intent is to maintain the lower level garage in the back to use
as storage but that addition part would be filled in with dirt.
Rowlette noted that there are no hardcover issues.
It was moved by Nolan, seconded by Rowlette, to recommend approval of application #1870
for Stephen and Randi Carlson for variance as listed. Vote: Ayes 1, Nays 0.

Jack Edwards was present.
Mabusth explained that applicant proposes a 4'xl2' addition to the garage. He's also putting
a lower level 8'xl 1' storage addition to his existing workshop area. Because his doors face
away from the street he needs only a 1 O' setback. Hardcover is reduced by 222 s.f. in the 0-75'
and 498 s.f. in the 75-250'.
Nolan discussed the issue of drainage and suggested that Mr. Edwards present a grading
proposal for the north ,side between the garage and the house.
Mabusth noted that there is a City drainage culvert that outlets on Mr. Edwards property.

Applicants propose a 10' x 24' 8" addition to the north side of the existing single stall
garage creating a double stall garage. The existing garage is located 27.3' from street yard.

Variance = 22' 7" or 45.4%
2. Section 10.56, Subd. 16 (L) -Hardcover limitations. The property is located within
1,000' of French Lake, specifically within the 500-1,000' setback area. The property
is allowed 35 % . The total area of the property is approximately 3 ½ acres or 152,460
s.f. and would be allowed 53,360 s.f. of hardcover. Review Exhibit F. The property
is at 4,165.6 s.f.

Description of Request
The applicants propose the installation of an additional stall to the north side of the
existing single stall garage. The existing new garage is in a serious state of disrepair with the
floor deteriorating to a point where cars can no longer be stored within the interior for fear of
collapsing on lower level storage garage accessed at rear of house. Review Exhibit D.
Applicant advises that much of the framework will be retained but that the entire garage
foundation would be basically replaced. The single stall yard maintenance garage to the rear
will also be retained with the reconstruction.

Statement of Hardship
Refer to Exhibit A. As applicant notes, structure is similar to other structures in the
Crystal Bay neighborhood .where structures were not constructed under two acre zoning
standards. The steeper sloping topographies to the rear would require major filling if structure
was to be moved further away from street and still be installed as an attached garage. In review
of City records, there has never been a vehicular accident resulting with the use of the garage
at this location.

RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data.· The rights of individuals on whom the data is
stored or to be stored shall be es set forth in this section.
Subd. 2. Information required to be given individual. An. individual asked to
· supply private or confidential data concerning himself shall be informed of: (a) the
purpose and intended use of the requested data within the collecting state agency,
political subdivision, or statewide system; (b) whether he may refuse or is legally
required to supply the reguested data; (c) any known consequence arising from his
supplying or refusing to supply private er confidential data; and (d) the identity of
other persons or entities authorized by state or federal law to receive the data.. This_
requirement sha.11 not apply when an individual is asked to supply investigative data,
pursuant to section 13.82, subdivision 5, to a law enforcement officer.
. The commissioner of revenue may olace the notice reauired under this
subdivision in the individual income tax or orooertv tax refund instructions instead of
on those forms.
· Subd. 3 •. ··Access· to data by·· individual. Upon request to a responsible
authority, an individual sha.11 l:>e informed whether he is the subject of stored data on
individuals; and whether it is classified as public, private or confidential. Upon his
. further request, an individual who is the subject of stored private or public data on
individue.ls shall be shown the data without any charge to him and, if he desires, shall

requesting person to pay the actual c~sts of making, certifying, and compiling the
cooies.
• The responsible authority shall comply immediately, if possible, with any request
made pursuant to this subdivision, or within five days of the date of the request,
excluding Saturdays, Sundays and legal holidays, if · immediate compliance is not
possible. If he cannot comply with the request within that time, he shall so inform the
individual, and may have an additional five days within which to comply with the
request, excluding Saturdays, Sundays and legal holidays. ---
Subd. 4. Procedure when da.ta is not ac:curate or complete. An individual may
contest the accuracy or completeness ·of public or private ds.ta concerning himself. To
exercise this right, an individual shall notify in writing the responsible authority
describing the nature o! the disagreement. The responsible authority shall within 30
days either: (a) correct the data found to be inaccurate or incomplete and attempt to
notify past recipients of inaccurate or incomplete data, including recipients named by
the individual; or (b) notify the individual that he believes the data to be correct.
Data in dispute shall be disclosed only if the individual's statement of disagreement is
included with the disclosed data.

The Planning Commission will hold public hearings in the Council Chambers at 2780 Kelley
Parkway on Monday, September 23, 1993 for the purpose of reviewing the following land use
applications:
1. #1854 Troy Anderson of 1490 Long Lake Boulevard, seeks approval of side and rear
setback variances for an attached 2-stall garage addition.
2. #1855 Paul E. Bowman of 3458 North Shore Drive, seeks approval of a side setback
variance to allow the installation of second floor over the existing single story residence.
3. #1856 Mark & Jenny Prueter of 3215 Crystal Bay Road, seeks approval of a height,
average lakeshore setback, rear and side setback variances and hardcover variances for
a rear addition to the existing residence and the installation of a third story where only
two and half stories are allowed within the residential zoning district. The final structure
will not exceed the allowed building height of 30'.
4. #1857 James L. Stinson of 2623 Casco Point Road seeks approval of hardcover and side
setback variances for a proposed 12x18' addition to the lakeside of the residence and an
adjacent 12x21' deck.
5. #1858 John & Marla Meridith of 3685 Watertown Road, seek approval of an area
variance for an indoor riding arena at 4800 s.f., considered an oversized accessory.

seeking approval of a garage addition that would be located 2 '4" from the side lot line
rather than 3' as originally proposed to the City.

Permit to allow the construction of a caretakers residence at his residential property.
11. #1865 David Owen of 2248 Shadywood Road seeks approval of side and street setback
variances to allow structural repairs to an existing garage located within the street yard
of the lakeshore property.
12. James & Joann Jundt the current owners of 1400 Bracketts Point Road have applied for
the following land use applications:
a. #1866 Applicants seek approval of a Conditional Use permit for a caretaker
apartment within the existing residence structure.
b. #1867 The applicants have applied for lakeshore setback and hardcover
variances to allow a second access stairs to the lake where only one stair structure
is allowed.
