The existing single stall garage will be turned into living space. The existing driveway will be removed and a new one will be located in from the new garage. The proposed porch will be 4' wide, 21' long, and 26' from the front property line. The existing residence is 30' from the front property line, where 50' is required in the RR-lB zoning district. A RESOLUTION GRANTING VARIANCE TO MUNICIPAL ZONING CODE SECTION 10.28, SUBDIVISION 5 (B), FILE NO. 02-2804 WHEREAS, Phillip Martin and Constance Martin, husband and wife, (hereinafter "the applicants") are the owners of the property located at 1230 Arbor Street within the City of Orono (hereinafter "the City") and legally described as follows: Lots 8 and 9, Block 1, Maxwell's Addition, Hennepin County, Minnesota, (hereinafter "the property"); and WHEREAS, the applicants have applied to the City for a variance to Municipal Zoning Code Section 10.28, Subdivision 5 (B) to allow construction of a front porch and an attached two stall garage to the existing house to be 26' from the front lot line where 50' is required and 15' from the side lot line where 30' is required in the RR-lB zoning district. WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on July 15, 2002, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #02-2804. 2. The property is located in the RR-lB Zoning District, where 2 acre is the minimum required lot area. The property consists of approximately .47 acres. 3. The Orono Planning Commission reviewed this application on July 15, 2002 and recommended approval of the proposed variance based upon the following findings: A. The existing residence was built in 1957, prior to city adoption of the current 2 acre zoning standards. 1 of 5 B. The hardship is the existing house location in relation to front and street lot lines. C. The hardcover in the 500-1000' setback zone is well below the allowed 35%. D. Lot coverage by structures will be 10.6%, well below the 15% limit. E. The front porch and attached garage are in character with the neighborhood. 4. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicants and the effect of the proposed variances on the health, safety and welfare of the community. CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10 .28, Subdivision 5 (B) to allow construction of a front porch and an attached two stall garage to the existing house to be 26' from the front lot line where 50' is required and 15' from the side lot line where 30' is required in the RR-lB zoning district. Approval is subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicant attached to this resolution as Exhibit A. Any amendments to the site plan may require further Planning Commission and City Council review. 2. Authorities granted by this variance run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within 2 of 5 one year of the date of Council approval, or these variances will expire on that date (July 22, 2003). 3. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the property. The property is located in a two acre zoning district. However, the neighborhood is more in character with half acre zoning standards. If half acre zoning standards were applied to this property the existing residence would meet the 30' required front setback. The proposed front porch and the front of the proposed garage would encroach 4' into the front yard setback. The side of the proposed garage would meet the required 10' side yard setback. The topographic map (Exhibit C) shows where neighboring residences are located in relation to the Arbor Street. In general, homes on the west side of Arbor Street are 50-60' from the traveled road. On the east side, they average about 40' from the paved road. The proposed 4' addition puts this house about 42' from the paved road. History of Arbor Street: Arbor Street is zoned RR-1 B, most of the properties in the area are half acre lots. The residences in the area were built prior to the current zoning classificat1on. Because of this, many variances have been applied for and approved in the area. Staff researched only Arbor Street. Three were found for Arbor Street. (Two of these 3 properties are located on the southerly section of Arbor Street not shown on the topographic map.) 1. 1185 Arbor Street-1993. Approved to permit construction of a 10' x 24' 8" addition to the north side of the existing single stall garage which is located 27' 3" from the street lot line (50' required). 2. 1365 Arbor Street -1996. Approved to permit construction of a partial second floor over the existing residence which is located 3' from detached garage (1 0" required) and 29' from the street lot line (50' required) and 18' from the side lot line (30' required). 3. 1380 Arbor Street -1996. Approved to permit construction if a 10' x 14' three season porch which is located 12.3' from the north side lot line (30' required) and 10' from rear lot line (50' required). Statement of Hardship: The applicant has included their statement of hardship in Exhibit A. Does the Planning Commission feel the front porch and garage addition are in character with the neighborhood? 2. Would the Planning Commission rather have the front porch be smaller and the proposed garage be in line with the existing residence? 3. The residence to the north has a small front porch, and its attached garage is setback from the front of the house. 4. Th-e hardcover in the 500-1000' setback zone is well below the allowed 35%. 5. The existing residence was built in 1957. 6. The property to the south has been vacant for many years. If and when it will be developed cannot be predicted. 7. Other issues raised by the Planning Commission. Staff Recommendation: If the Planning Commission concludes that the addition as proposed will be in character with the neighborhood, and will not be detrimental to the neighborhood, and if Planning Commission also concludes that there are adequate hardships present, then a recommendation for approval would be appropriate. Options for Action: 1. Recommend approval of variances requested. 2. Recommend denial of variances. 3. Table, giving applicant direction. 4. The first variance is a request to allow a 15 ft sideyard setback. The code specifies a 25 ft setback. The code will not allow the addition of an attached two-car garage. The proposed garage will be 25 ft wide. The existing house has a one car tuck under garage that would be converted to living space. The existing drive would be removed and space would become lawn. A two-car garage would be added to the south side of the property. This would greatly improve the livability of our home. The house was built in the 1950' s and the garage is so narrow that it is virtually unusable. The second variance would allow building the garage and covered front porch 4 ft closer to the street. When the house was built, it did not provide any covering for the front entrance. This makes it necessary to stand in the rain at the front door. The proposed covered porch will extend 4 ft toward the street. The existing setback is 30 ft plus an additional 16 ft from the property line to the paved city street. There is little likelihooa that the street will ever be widened as it carries very little traffic. We are proposing to align the garage front with this 4ft wide porch. The proposed addition will put this house more in keeping with other houses in the neighborhood. Almost all houses on this street have a porch in front of the house. Granting these variances will overcome practical difficulties in complying with zoning requirements. Smith stated that they had covered many items, including proposed housing and how it relates to the RPUD, they touched on Kelley Parkway and transportation, and access in and out as it relates to parl<lng. Many items they had not covered need to be discussed and she asked Gaffron ifthere was anything that should be covered yet that evening to provide direction to the applicant. Gaffron suggested they either spend another hour wrapping up discussion or scheduling a follow-up meeting for another time. Bremer suggested a second meeting soon. Johnston concurred, stating that they have a timeline they are trying to meet and would like to -. continue discussion soon. Bottenberg reported that the applicants have requested front yard and side yard setback variances to construct a front porch and an attached garage to the existing residence. The proposed front porch and the front of the proposed garage would encroach 4' into the front yard setback. The side of the proposed garage would meet the required 10' side yard setback. With regard to the history of Arbor Street, Botten berg pointed out that most of the properties in the area are half acre lots and the property to the south has been vacant for many years. Bottenberg maintained that if the Planning Commission concludes that the addition as proposed would be in character with the neighborhood, and not detrimental to the neighborhood, and adequate hardships are present, then a recommendation for approval would be appropriate. Mr. Martin stated that his only hardship is that he has no character out front, most of his neighbors have front porches out front, and his has absolutely nothing. While the average setback is 40', what he has proposed does not change the character of the street, in fact, the neighbors have indicated their support. From a functional hardship, Martin stated that there is no landing to the front of his home, you enter directly into the house. There were no public comments. Rahn asked if with the removal of the existing driveway, the old garage would tum into living space. Martin stated that the driveway is not paved, in an effort to reduce hardcover. Smith inquired about the vacant lot. Martin indicated that the owner lives across the street and stated they do not object to his proposal. Smith asked if, in the future, someone wants to build on that site would the proposed garage and porch be to close to the lot line. Botten berg explained that the applicant has worked very hard with staff to best meet city ordinances and construct a new house on the property. The latest plan before the Commission just completed is Plan 3, therefore a site plan and not a survey accompany it this time around. Bottenberg reported that the applicant has requested variances to permit removal of the existing house and construction of a new house. The new home would be a two story, four bedroom home, with a two stall tuck under style garage. Due to the small size of the lot and zoning standards, it is not possible to rebuild on the property without requiring variances. The requested variances include: lot area and lot width, hardcover and structure within 75' in excess of25%, and a variance to allow encroachment into the 50' front yard setback. While Eastlake Street is zoned LR-IA (2 acre), Bottenberg pointed out that most of the properties are .11 or.12 of an acre. After researching Eastlake Street, staff found four residents where variances have been granted. Recapping, the main hardships are that the lot is extremely undersized for the zoning district and 75% of the property is within 75' of the 929.4' water level. Staff recommends approval of the required variances to construct a new single family residence on the property. The first variance is a request to allow a 15 ft sideyard setback. The code specifies a 25 ft setback. The code will not allow the addition of an attached two-car garage. The proposed garage will be 25 ft wide. The existing house has a one car tuck under garage that would be converted to living space. The existing drive would be removed and space would become lawn. A two-car garage would be added to the south side of the property. This would greatly improve the livability of our home. The house was built in the 1950' s and the garage is so narrow that it is virtually unusable. The second variance would allow building the garage and covered front porch 4 ft closer to the street. When the house was built, it did not provide any covering for the front entrance. This makes it necessary to stand in the rain at the front door. The proposed covered porch will extend 4 ft toward the street. The existing setback is 30 ft plus an additional 16 ft from the property line to the paved city street. There is little likelihoocf that the street will ever be widened as it carries very little traffic. We are proposing to align the garage front with this 4ft wide porch. The proposed addition will put this house more in keeping with other houses in the neighborhood. Almost all houses on this street have a porch in front of the house. Granting these variances will overcome practical difficulties in complying with zoning requirements. We have discussed the proposed improvements with the most affected neighbors and believe they would welcome the improvement to the area.
