9. 2003 COMPREHENSIVE ANNUAL FINANCIAL REPORT -KEN MALLOY
Ken Malloy, of the City's auditing firm, presented an overview of the 2003 Comprehensive Annual
Financial Report. He indicated that the audit was completed in June and provides the City with a
tool for reviewing its financial records and testing its compliance with state laws and regulations .
Other than one minor finding, which was the use of public funds for employee recognition, Malloy
complimented the City on its great job of keeping on top of state rules and regulations .

A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 78-420 SUBDIVISION B

WHEREAS, Dean Thomas Lundblad and Sherri Jean Strelow-Lundblad,
husband and wife (hereinafter "the applicants") have an interest in and Steven R. Benson,
a single person, is the owner of the property located at 1290 Arbor Street within the City
of Orono (hereinafter the "City") and legally described as follows:
Lots 7 & 8, Block 1, Crystal Bay Minnetonka, Hennepin County, Minnesota
(hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-420 Subdivision B to allow a
side street setback of 21.2' where a 50' setback is normally required.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #04-3040.
2. The property is located in the RR-lB, One Family Rural Residential
Zoning District which requires a minimum lot area of 2 acres and a
minimum lot width of 200'.
3. The Planning Commission reviewed this application at a public hearing
held on August 16, 2004 and recommended approval of the variance based
on the following findings:
a. The property has 12,809 s.f. (0.29 acre) in area and 100' in width. The
property is within the 500' -1000' shoreland hardcover zone.
b. The side street is unimproved right-of-way, has been fenced and
currently is being used as parkland for Crystal Bay Playground.

c. The proposed garage location will have no negative impacts on the
parkland or the neighborhood.
4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the applicant and the public, and the effect of the proposed
variance on the health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance would not adversely affect traffic
conditions, light, air nor pose a fire hazard or other danger to neighboring
property; would not merely serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicant; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants a variance to Orono Municipal Zoning Code Section 78-420 Subdivision B to
allow a side street setback of 21.2' where 50' is normally required, subject to the
following conditions:
1. Council approval is based on the site plan submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibit A. Any
amendments to the site plan which are not in conformity with City codes will
require further Planning Commission and City Council review.
2. Hardcover in the 500-1000' zone shall be limited to 4,483 s.f. or 35% per the
proposed plan and hardcover allowance summary as depicted on Exhibit A.
Applicants are advised that any future requests to increase hardcover above the
limited amounts or change the nature of existing/approved hardcover shall require
City approval, and increases in hardcover above the allowed limits will not likely
be approved without concurrent reduction in existing hardcover.

3. Applicant shall remove all plastic or fabric liner material from the decorative
landscape beds on the property to ensure their permeability as non-hardcover
surfaces.
4. Authorities granted by this resolution run with the property not with the applicant,
but are permissive only and must be exercised by obtaining a building permit for
the new construction within one year of the date of Council approval, or the
variance will expire on that date (August 23, 2005).
5. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
6. The undersigned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of the applicants and the applicants' heirs,
successors and assigns, hereby agree to the recording of this resolution in the
chain of title of the property.

Zoning Code, Sections 78-1101 through 78-1210, as outlined in the August 11, 2004 Planner's

OLD BUSINESS
#4. #04-3010 THEODORE CAPRA, 3534 IVY PLACE -VARIANCES (6:08 -6:29 p.m.)
Theodore Capra, Applicant, was present.
Gundlach indicated the applicant is requesting a hardcover variance to permit 30 percent hardcover
within the 75'-250' zone where 25 percent is normally allowed and 49% currently exists and a
conditional use permit to allow land alterations within the 0-75' zone, in order to construct a new
residence on an existing lot.
Gundlach stated the City Engineer has not visited the site but has reviewed the proposed grading plan
and has concerns regarding whether restoration of the slope is necessary. Gundlach recommended the
CUP portion of the application be tabled to allow the City Engineer to visit the site. Gundlach
indicated the applicant is in agreement with tabling this portion of the application.
Gundlach noted the applicant and the applicant's architect have met with staff numerous times
since the June Planning Commission meeting to discuss alternative site plans in an attempt to

reduce hardcover. The applicant has submitted a number of plans that have included both an attached
garage and a detached garage as well as relocating the residence closer to the road but has been unable
to reduce the proposed hardcover to 25 percent.
The Planning Commission reviewed an overhead of the proposed footprint. Gundlach indicated the
applicant is proposing to construct a two and a half story residence consisting of a house footprint of
2288 square feet with an attached 720 square feet three-car garage and with the proposed hardcover at
30 percent. Gundlach noted the amount of proposed hardcover has been reduced slightly from the
previous plan. Gundlach stated the revised plan has the same basic footprint, smaller deck, smaller
garage, and no porch. The existing detached garage located by the road and the shed will be removed
as part of the construction.
Capra noted at the last Planning Commission meeting he had indicated in his opinion the small road
at the back of his property was a hardship. Capra indicated the road was in existence at the time he
purchased the property. Capra stated he has met all of the City's requirements except for the
hardcover and that in his opinion being required to reduce the size of the house is penalizing him.
Capra indicated he has revised his plans to the point where the proposed residence is not what he
would like to construct. Capra indicated he understands the need to limit hardcover along the lake in
an effort to reduce runoff, but he is unable to reduce the amount of hardcover being proposed.
Capra pointed out the property at 1740 Shadywood Road was allowed 38 or 39 percent hardcover, and
requested the Planning Commission reconsider his application. Capra suggested the City consider
increasing the amount of hardcover allowed within the City to 30 percent.
There were no public comments regarding this application.
Rahn stated he understands how the applicant feels.
Capra stated he does not feel the proposed residence is out of line for that lot and that the lot would be
improved with the new construction.
Bremer stated to her recollection the lot located on Shadywood is a very narrow lot.
Capra noted the lot is 82 feet. Capra stated that property owner was also aware of the road but yet the
Planning Commission determined a hardship existed.
Gundlach indicated that the property the applicant is referring to had over half of its acreage located in
the 0-7 5' zone, which was the primary basis for granting the variance.
Capra indicated he is aware that he is not comparing apples to apples.
Bremer commented there are many examples where the Planning Commission has required applicants
to reduce the amount of hardcover to 25 percent on lots that are similar to Mr. Capra's. Bremer
indicated the City Council is the final authority.

The applicants have proposed a detached garage to be set back 21.2' from the side street
lot line where a 50' setback is normally required. The side street in question was fenced
and turned into part of the grassed park lawn. It is unimproved right-of-way currently,
and indefinitely, being used as parkland for Crystal Bay Playground. This unimproved
right-of-way serves as a side yard and not an improved, traveled street.
Hardship Statement
Applicant has completed the Hardship Documentation Form attached as Exhibit B, and
should be asked for additional testimony regarding the application.
Hardship Analysis
In considering applications for variance, the Planning Commission shall consider the effect of the
proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in
the surrounding area. The Planning Commission shall consider recommending approval for variances
from the literal provisions of the Zoning Code in instances where their strict enforcement would cause
undue hardship because of circumstances unique to the individual property under consideration, and
shall recommend approval only when it is demonstrated that such actions will be in keeping with the
spirit and intent of the Orono Zoning Code.
The size of the lot is consistent with the other properties within this neighborhood and the
proposal is not out of character for the neighborhood. Staff finds that due to the size of
the lot and the nature of the unimproved side street right-of-way there is hardship to
support the 21.2' side street setback where a 50' setback is normally required.

Meeting. Planning Commission Meetings are normally held on the third Monday of each month.
Applicants must be present at all scheduled review meetings of the Planning Commission and

HARDSHIP DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application
will not be considered complete or placed on any meeting agendas until this form is
complete and submitted to the City.
Minnesota State Statue Section 394.27, Subdivision 7 requires that a hardship be
demonstrated in order for a variance to be granted. The hardship must be unique to the
property as variances run with the land and not the land owner. Personal and economic
situations are not considered valid hardships. In order for an application to be heard by
the Planning Commission and City Council a hardship having merit must be
demonstrated.
HOW DO I PROVE A HARDSHIP?
This form has 12 points outlining the basis City staff uses to determine if a hardship
exists and how the variance will affect the surrounding community. To prove a hardship,
address all the relevant points listed below and answer them as elearly as possible.
Since you are requesting the code exception, you have the burden of proving that the
variance is justified. The information the City receives is what is used in determining a
denial or approval recommendation. If you leave something out it will not be considered.
Please address each of these hardship criteria as they relate to the request (some may
not apply): ·

The City recently closed Crystal A venue between Brown Road and Arbor Street, adjacent to the Crystal
Bay Park This street was closed because it severed the park, and it was not critical for neighborhood
traffic circulation. The street pavement was removed and the area was restored to grass, but the Right of
Way has not been vacated. The City has no intention of ever vacating this Right of Way as it is now
being used for park purposes. Also, because this area is essentially fully developed according to current
zoning regulations, we do not envision any future substantial changes in neighborhood traffic circulation
patterns that would necessitate the reopening of Crystal A venue.

HARDCOVER ORDINANCE n 1975, the Orono City Council ad :ed an ordinance limiting the
percentage of lot area that can be covered with impervious surface ("hardcover") such as roofs,
driveways, sidewalks, etc. on properties located within 1,000 feet of a lake. Studies have shown that
sediments, oils, and debris carried into the lake from highly urbanized areas have a detrimental
impact on the quality of water in the lake. The intent of Orono's ordinance is to ensure that rainfall
run-off will be cleansed by filtering through grassed or vegetated yard areas before entering the lake.

INSTRUCTIONS FOR COMPLETING HARDCOVER CALCULATION WORKSHEET
1. Circle which setback zone (0-75', 75-250', etc.) the calculation is for.
2. For each item of hardcover within that zone, enter the length and width, and multiply to get
square footage (s.f.). ·
3. Add up all the square footages to get total square footage of hardcover.
4. Divide by the total area of property within the zone and multiply by 100 to get percentage of
hardcover in the zone.
5. If changes in hardcover are proposed, you should do a "before" worksheet and "after
worksheet. If either results in percentages greater than those allowed, contact City staff before
proceeding with your project planning!

HARDSHIP DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application
will not be considered complete or placed on any meeting agendas until this form is
complete and submitted to the City .
Minnesota State Statue Section 394.27 , Subdivision 7 requires that a hardship be
demonstrated in order for a variance to be granted . The hardship must be unique to the ·
property as variances run with the land and not the land owner. Personal and economic
situations are not considered valid hardships. In order for an application to be heard by
the Planning Commission and City Council a hardship having merit must be
demonstrated .
HOW DO I PROVE A HARDSHIP?
This form has 12 points outlining the basis City staff uses to determine if a hardship
exists and how the variance will affect the surrounding community. To prove a hardship,
address all the relevant points listed below and answer them as elearly as possible .
Since you are requesting the code exception , you have the burden of proving that the
variance is justified. The information the City receives is what is used in determining a
denial or approval recommendation. If you leave something out it will not be considered .

not apply):

HARDCOVER ORDINANCE -In 1975, the Orono City Counr-i! adopted an ordinance limiting the
percentage of lot area t i can be covered with impervious ~ .'ace ("hardcover") such as roofs ,
driveways, sidewalks, etc. on properties located within 1,000 feet of a lake . Studies have shown that
sediments, oils, and debris carried into the lake from highly urbanized areas have a detrimental
impact on the quality of water in the lake. The intent of Orono's ordinance is to ensure that rainfall
run-off will be cleansed by filtering through grassed or vegetated yard areas before entering the lake .

INSTRUCTIONS FOR COMPLETING HARDCOVER CALCULATION WORKSHEET
1. Circle which setback zone (0-75', 75-250', etc.) the calculation is for.
2 . For each item of hardcover within that zone, enter the length and width, and multiply to get
square footage (s.f.). ·
3. Add up all the square footages to get total square footage of hardcover.
4. Divide by the total area of property within the zone and multiply by 100 to get percentage of
hardcover in the zone.
5. If changes in hardcover are proposed, you should do a "before" worksheet and "after
worksheet. If either results in percentages greater than those allowed, contact City staff before
proceeding with your project planning!

In accordance with M.S. 13.04, Subd . 2, "Rights of subjects of data", we would like to inform you
that your request for a permit or license from the City of Orono or any of its departments may
require you to furnish certain private or confidential information .
You are notified that:
1. The information you furnish will be used to determine your qualification for the permit or
license requested.
2. You may refuse to supply data, but refusal may require that the City deny the permit or
license.
3. The information may be shared with other local, state or federal agencies to the extent
necessary to process the permit or license.
4. If your requested permit or license requires Council action t o .... approve , some information

Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or to
be stored shall be as set forth in this section. ·
Subd. 2. Information required to be given individual. An individual asked to supply
private or confidential data concerning himself shall be informed of: (a) the purpose and
intended use of the requested data within the collecting state agency, political subdivision, or
statewide system; (b) whether he may refuse or is legally required to supply the requested data;
(c) any known consequence arising from his supplying or refusing to supply private or
confidential data; and (d) the identity of other persons or entities authorized by state or federal
law to receive the data. This requirement shall not apply when an individual is asked to supply
investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue may place the notice required under this subdivision in the
individual income tax or property tax refund instructions instead of on those forms,
Subd. 3. Access to data by individual. Upon request to a responsible authority, an
individual shall be informed whether he is the subject of stored data on individuals, and whether
it is classified as public, private or confidential. Upon his further request, an individual who is
the subject of stored private or public data on individuals shall be shown the data without any
charge to him and, if he desires, shall be informed of the content and meaning of that data.
After an individual has been shown the private data and informed of its meaning, the data need
not be disclosed to him for six months thereafter unless a dispute or action pursuant to this
section is pending or additional data on the individual has been collected or created. The
. responsible authority shall provide copies of the private or public data upon request by the
individual subject of the data. The responsible authority may require the requesting person to
pay the actual costs of making, certifying, and compiling the copies.
The responsible authority shall comply immediately, if possible, with any request made
pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays,
Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with
the request within that time, he shall so inform the individual, and may have an additional five
days within which to comply with the request, excluding Saturdays, Sundays and legal holidays.
Subd. 4. Procedure when data is not accurate or complete. An individual may
contest the accuracy or completeness of public or private data concerning himself. To exercise
this right, an individual shall notify in writing the responsible authority describing the nature of
the disagreement. The responsible authority shall within 30 days either: (a) correct the data
found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or
incomplete data, including recipients named by the individual; or (b) notify the individual that he
believes the data to be correct. Data in dispute shall be disclosed only if the individual's
statement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions of
the administrative procedure act relating to contested cases.
