Toward proposed the construction of a 2 stall garage to serve as the
principal garage. The existing attached garage will probably serve
as additional storage area. The property is a sad example of the
overuse and abuses of paving. I would suggest you ask for at least
a matching removal of hardcover to be specific 214 sf more. Planning
Commission may ask for more. Check to see if the existing garage is
to be used for yard maintenance equipment and storage, if so ask that
the drive area in front of attached garage be removed.
Staff Recommendations
To approve R. William Toward's variance application for setback variances
and hardcover variance within the 75' - 250' setback area rased on the
following findings:
1. Proposed application is very consistent with pattern of
neighborhood development.

Member Goetten stated her reason for voting Nay
was because of the amount of hardcover within 75'
of the shoreline.
Zoning Administrator Mabusth reviewed with the
Planning Commission the request of William
Toward, 34ti;O Birch Lane, for a variance for the
construction of a two -stall garage.
Mr. Toward was present. Also present: Mr.
Ammerman of 2731 Orchard Lane, Excelsior. It is
noted in the record that Mr. Ammerman has had a
variance granted for property he owns at 3458
North Shore Drive and during that review for a
garage setback variance, problems with backing
out were not noted.
Member Sime moved, Member goetten seconded, to
recommend approval for a variance request of
William Toward, 3460 Birch Lane, per the
following findings:
1. Proposed application is very consistent
with pattern of the neighborhood development.
2. The location and use of the proposed
structure will have no adverse eff-ct on the
surrounding properties.

recommend approval for a setback variance and
hardcover variance for Sandra Georae, 3399
Crystal Bay Road, based on the following
findings:
1. The hardcover limitations and variances
approved for the property are in consideration of
the past divisions of Lot 18 reducing a total of
15' in lot width and approximately 2,835 sq. ft.
in area.
2. The proposal is consistent with the pattern
of the neighborhood development.
1. There is no additional land available.
Approval is subject to the following conditions:
1. To work with staff to determine the amount of
reduction in hardcover.
2. The seeding of gravel drive on west side of

Toward proposes the construction of a two stall garage to
serve as an accessory garage. The existing attached garage
will serve as additional storage and parking area. The property
is a sad example of the overuse and abuses of paving. PC advised
that if the garaqe is to be approved there must be an equal
amount of hardcover removed.
PC asked staff to inspect the site again in order to determine
what areas of existing blacktop could be removed without
causing undue hardship to the applicant. Upon that inspec-
tion staff determined there was more area of the blacktop
surface to be covered by the proposed garage, approximately
198 sq. ft. hardcover.

The applicant has agreed to the removal of paved areas as specified. The
location and design of proposed garage will not create ad-
ditional problems for the quantity and velocity of the surface
drainage in the area. In fact the drainage will be slightly
improved what with the removal of one section of paving next
to road and half the roof drainage of the garage being directed
to the grassed area to the north. At present, the majority of
the paved area in the street yard flows down Birch Lane.
PC Recommendation
To approve R. William Toward's variance application for set-
back variances and a hardcover variance within the 75' - 250'
lakeshore setback area to allow the construction of a 20' x 22'
detached garage based on the following findings:
1. Proposed improvement is consistent with pattern of
development within surrounding neighborhood.
2. The location and use of the proposed structure will have
no adverse effects on the surrounding properties, existing
surface drainage nor will it have detrimental effects on
the property values within the surrounding neighborhood.
3. Doors face away from the street, with turnaround pro-
vided on the property.
Approval is subject to the following conditions:
1. The proposed structure must not create additional hard-
cover for a property that already has 31.5% of excessive
hardcover.

Grantin-, A Variance to Municipal
Zoning Code Sections 34.552, 34,610 and 38,201 - File 747
Whereas, R. William Toward th` -��ner 'hereafter "owner") of
property located within the City of Orono (hereafter "City") at 3460 Birch Lane,
legally described as All that part of Lot 19, Lydiard's Park Lake Minnetonka,
lying Northerly of the Northerly line of Birch Lane in "Baldur Park" if said
Northerly line were extended in a straight line across said Lot 19, (hereafter
"property"); and
Whereat, the owner has applied to the City for variances to municipal
zoning code sections 34.552, 34.610 and 38.201 to allow construction of a 20' X 22'
detached garage to be located 3 feet from the exterior side property line instead
of the required 10 feet per Section 38.101 and 10 feet from the street lot line
instead of the required 30' per Sectior::,4.552 and to approve an existing ex- s of
hardcover on the property at 2924 square feet over the allowed amount of har --over
at 2315 square feet per Section 34.610.
Now, Therefore Be I_ Resolved by the City Council of Orono, Minnesota:
Findings
1. This application was reviewed as zoning file no. 747.
2. The property is located in the LR-lC Single Family Lakeshore
Residential zoning district.
Z. The proposed accessory structure is to be no larger than 20' X 22' , one
story high.
4. Tt.e doors of the detached garage will face away from the street making
use of the ::xisting paved area as a turnaround.
5. "he new landscaping that will replace existing paved area and the roof
desijn of the detached garage will improve the existing surface drainage
pattern on the property by redirecting some drainage to the grassed area to
the .io r th .
6. The Orono Planning Commission reviewed this application on May 16,
1983, and recommended approval of the variances as requested based upon the
following findings:
a) Tho location of the principal structure and the width of the lot
prevent the proposed structure from meeting the required setbacks.

b) The addition of proposed structure will not result in an increase of
hardcover because the owner must remove an equal amount of existing
hardcover on the property.
c) The proposed improvement is consistent with pattern of development
within the surrounding neighborhood.
d) The location and use of the proposed structure will have no adverse
effects on the surrounding properties, existing surface drainage
pattern nor will it have detrimental effects on the property values
within the surrounding neighborhood.
7. The City Council has considered this application including the findings
and recommendations of the Planning Commission, reports by City staff,
comments by the owner and other interested persons, and the effect of the
proposed variance on the health, safety and welfare of the community.
8. The Ci ty Council finds that • conditions existing o , this property are
peculiar to it and do not apply generally t, other property in t:.'s zoning
district: that granting the variance would not adversely effect traffic
conditions, light, air nor pose a fire hazard or other danger to neighboring
property; would not merely serve as a convenience to the owner, but is
necessary toalleviate a demonstrable hardship or difficulty; is necessary
to preserve a substanl-ial property right of the owner; and would be in
keeping with the spirit and intent of the zoning code and comprehensive plan
of the City
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants variances to
Section 34.552, 34.h11 and 38.201 to allow construction of a detached garage
within 3 feet of the interior side property line, 10 feet from the front/street
property line and to approve an existing hardcover varainceof 2024 square feet or
31.5%, subject to the following conditions:
I. Any doors over 3 feec wide shall face away from the street.
2. No other variances are granted or permitted for this
structure.
3. The City will approve no future variances for this property.
4. Authorities granted by this variance run with the property not with the
owner, but are permissive only and must be exercised by application for a
building permit and/or occupancy certificate within one year of the date of
Council approval, or this variance will expire on that datA (June 14, 1984) .

this variance shall constitute a violation of the zoning code, shall
automatically terminate any authority granted herein, and shall be
punishable as a misdemeanor.
6. The undersigned owner has read, understood and hereby agrees to the
terms of this resolution and on behalf of himself, his heirs, successors and
assigns, hereby agrees to the recording of this resolution in the chain of
title of the property.
