The Planning Commission -ill hold public hearings in the Council Chambers
a at 1275 South Brown Road on Monday, July 1.8, .988, at 7:00 p.m. on the
matter of reviewing the following land use app11.;ations:
1. #1300 Anthony Eiden, representing the property owners of 2290 and
2340 Abingdon Way, seeks a Conditional Use Permit for the installation
of a duck pond between the shared boundaries of both properties.
2. #1302 City of Orono seeks a Conditional Use Permit and variance
for the repair of portiona of Crystal Bay Road located within 75 feet
of the lakeshore of Lake Minnetonka.
" 3. #1303 Allan and Shirley Rezabek of 1989 Fagerness Point Road seek
a lakeshore setback varianc^ for the relocation of a privacy fence
along the side lot line.
4. #1304 Richard Bloomquist/nick's Super Vaiu at 3333 Shoreline Drive
seeks a parking setback variance, size of parking stall variance and
setback for the pylon sign as a result of required alterations of the

Minnetonka, Sec. 7BA, City of Orono.
The Engineer reviewed the application for dredging for a
private boat slip noting that the applicant proposed to dredge to a
depth of 925.0. It was moved by Miller, seconded by Andre, that
the application be approved, limiting the bottom depth elevation,
however, to 925.4, consistent with prior District practice with
respect to this type of project and subject to review and approval
by the Minnesota Department of Natural Resources. Upon vote, the
motion carried.

an ipen water wildlife pond. The Engineer noted that a 100 year
flood elevation has not been established for this subwatershed. It
was moved by Andre, seconded by Love, that the application be
approved subject to review and approval by the Minnesota Department
of Natural Resources; further, that the District request the DNR to
inspect the site and determine the boundaries of the wetland. Upon
vote, the motion carried.

Hydrologic Study Glen Lake Road/County Road 19 Subwatershed
Noting that no other members of the public were present in
connection with permit applica�-ions, but that members of the public
were present in connection with the hydrologic analysis of the Glen
Road/County Road 19 area, the Managers amended the agenda to
consider the engineering report on this subject. Present in
connection with this matter were Mr. and Mrs. Bill Ecoff. The
Engineer distributed and reviewed for the Board of Managers the
hydrologic analysis preoared by the Engineer's office of the Glen
Road/County Road 19 Subwatershed. The Engineer identified the
scope of the study, the preliminary conclusions reached and the
alternate solutions identified by the study. These included
increasing outlet capacity in the subwatershed with an estimated
cost of approximately $95,000 and an alternative of increasing
storage capacity in the subwatershed with an estimated cost of
$154,000. Mr. Ecoff stated that he remained concerned about delay
in connection with his anticipated development and stressed the
need to have some work start promptly. The Engineer stated that
the hydrologic analysis has been submitted to the two cities and
that the Eingineer intended to review the report with the city
councils of the two affec-=ed cities within the next two weeks. It
was moved by Miller, seconded by Love that the Board of Managers
recommend to the cities the adoption of the expanded storage pond
option, n.)ting the strong preference of the Board and state law for
use of natural storage and retention systems. The Chair appointed
Managers 1,ove and Lehman to represent the Board and express the
Board's support for the increased storage option.
It was further moved by Miller, seconded by Love, that the
Engineer explain the study to the city councils and make available
such technical assistance with respect to interpretation of the
study as :he cities might require.
88-63 - Haskell's, Inc_. -- Stormwater management plan for a
parking l)t expansion, Sec. 3AD, City of Minnetonka.
The ngineer reviewed the stormwater management plan and
indicated that the Minnesota Department of Transportation has
approved -:he project. The Engineer recommended approval. It was
moved by �ndre, seconded by Miller, that the application be
approved .is recommended by the Engineer. Upon vote, the motion
carried.

The pond proposed between lots 2290 and 2340 Abingdon Way should be reduced in
size to eliminate excavation it the designated wetlands area.
The pond would be located across a drainage and utility easement. We do not
feel this will create any problems relative to future use of the easment.
The pond should be in accordance with watershed requirements. Silt fence for
protection of the wetland areas will be required.

yards standard.

approximately 50' wide and with approximately 230' of length. The pond
will be constructed with 3:1 bank ratios at a 4' depth. The original plan
showed the encroachment of a designated wetlands protected with flowage and
conservation easements taken with the Abingdon Glen plat. Review Exhibit
G. In addition, review Exhibit F, the southeast portion of the proposal
was also encroaching a DNR protected wetlands. As Cook's letter notes in
reviewing the original plan, Exhibit E, the pond should be reduced in size
to eliminate excavation in the designated wetlands area. If applicant
chose to continue with the application seeking encroachment of the wetlands
area, staff would have to ask the applicant to also file a permit
application with the DNR_
In consideration of the conflicts with the designated wetlands and the DNR
protected-4etlands, the applicant chose to have his engineer redesign the
pond so hat it no longer encroaches the protected wetlands area. Review
Exhibit H. The excavation of the pond now located 20 from tYe protected

wetlands area, requires a variance setback to the 26' setback standard of
6'.
Review EAhibit H. The area of the pond adjacent to the designated wetland
will not contain any exposed or disturbed soils. The fill and grading is
to be done to the northwest side of the proposed pond with appropriate silt
fencing to be placed at the lower elevations to prevent erosion into the
lower pond elevations. After final grades are completed, seeding will
immediately follow. Please note the proposed drainfield area has not been
effected by the excavation of the pond nor the filling and Trading to the
northwest of the proposed pond area. The changes and alternations will not
effect drainage as drainage will still flow to the wetlands area to the
southeast. The island in the center of the pond will provide a natural
habitat for the wildlife sought by the applicant. The pond will function
predominantly as an aesthetic pond.
The city engineer has also called note to the fact that the pond will be
located over a drainage and utility easement, located along the shared lot
line. He notes that this will not create any problems relative to the
future use of the easement. Although the required setback of 26' has not
been maintained from the designated wetland, once again staff would note
that no disturbed soils would be located within the area of the wetlands
and the drainage from the newly filled area will be draining around over
grassed areas before it reaches the wetlands to the southeast. In
addition, the applicant will provide the necessary silt fencing until the
ground cover has been restored.
Staff Recommendation
To approve a Conditional :Ise Permit and seth-Ack variance application of
Anthony Eiden for the properties located ar 2.:90 and 2340 Abingdon Way
based on the following findings:
1. The pond excavation will have no negative impact on the existing
wetlands to the southeast, nor on the existing septic system on Lot 8
or on the future drainfield areas on Lot 9.
2. The pond will provide a natural habitat for wildlife.
3. The applicant does not propose any disturbed earth being stored
within the area adjacent to the wetlands.
4. Undisturbed soils will be immediately graded and seeded as soon
as the excavation of the pond is completed.
Approval is subject to the following conditions:
1. Appropriate erosion control shall be maintained throughout the
project, silt fencin j shall be installed as shown on the plans by
Coffin and Gronberg revised date, 7/12/88.
2. Applicant shall stake the proposed drainfield areas prior to the
excavation to .insure protection of the proposed drainfield areas on
Lot 9.

advised the applicant that the plan had to be amended to show a 26'
setback. In addition, they asked that the applicant's surveyor provide
confirmation that each lot retain the 2 acres of dry contiguous land per
RR-lB zoning standards. Please review Exhibit I, the amended survey

Applipant was present for this matter.
Zoning Administrator Mabusth stated that this matter pertains to the
request for a Conditional Use Permit and a variance to encroach upon a DNR-
protected, designated wetland area for the installation of a pond. The
initial plan has since been revised so that the proposed pond is now out of
the wetland area with a 20' setback separation. Most of the grading and
filling will be done to the northwest and away from the wetland area. The
change will not affect the drainfield. Appropriate erosion control must be
maintained during the entire installation of the pond. The Applicant seeks
a 20' setback to the designated wetland. If the plans could be revised to
achieve 6 more feet, then a setback variance would not be required. Kelley
questioned whether the plans would still allow for 2 acres of dry,
buildable land on both lots. Applicant stated that both Lots 9 and 10 were
over 2 acres, but he did not know the ratio of dry land to wetland.
Johnson_ questioned if potential excess f lowage from the pond would
flow oiit the wetland. Mabusth stated that she had asked the Engineer and
that there is no need for overflow in this area because the majority of
drainage really goes toward the southeast.
Kelley asked if seeding was a requirement immediately after grading
and if so, what about watering the seed with the lack of rain and water
conservation. Applicant stated that the project will not be completed
until September and hopes for more rain around that time.
Debbie Lewis, a neighbor across from Mr. Eiden's property, was
concerned with the water level of the pond and the stagnant water in the
pond becomming a mosquito breeding ground. Mabusth asked Applicant if he
planned any form of aeration to piohibit stagnation of the pond water. Mr.
Eiden said that he had not given any thought to aeration and that the water
level would vary with the rainfall. Ms. Lewis expressed her concern also
about the possibility of algae growing as a result of the lawn chemicals.
Kelley added that in his opinion a small pond would not increase the
mosquito population to a noticeable degree, especia�ly since half of Orono
is wetlands or lake.

WHEREAS, Anthony Eiden (hereinafter "the applicant") is the owner
of the properties located at 2290 and 2340 Abingdon Way within the City of

4. The City Council has considered this application including the
findings and recommendations of the Planning Commission, reports by
staff and comments of the applicani:. and the effect of the proposed use

5. The City Council finds that granting a Conditional Use Permit to
allow the installation of the pond will not be detrimental to the
health, safety or general welfare of the public, would not adversely
affect light, air nor pose a fire hazard or other danger to
neighboring properties, nor will it depreciate surrounding property
values and that the proposed level of use of the property will be in
keeping with the intent and objectives of the Zoning Code and
Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Paged upon one or more of the above findings, the Orono City
Council hereby grants a Conditional Use Permit per Municipal Zoning Code
Section 10.03, Subdivision 19 to permit the installation of a pond between
the shared lot lines of the property, subject to the following conditions:
1. Appropriate erosion controls shall be maintained throughout the
project. Silt fencing shall be installed as shown on the plans by
Coffin & Gronberg, revised date 7/22/88.
2. The applicant shall stake the alternate and principal drainfield
sites on Lot 9 prior to any land alteration to insure protection of
the future drainfield areas.
3. Upon completion of the final grades, the entire disturbed area
shall be seeded and erosion control/silt fencing shall remain in place
until ground cover is restored.
4. Authorities granted by this resolution run with the property not
with the applicant, but are permissive only and must be exercized by
application for a land alteration permit within one year of the date
of Council approval or this conditional use permit will expire on that
date (August 8, 1989).
5. Violation of or non-compliance with any of the terms and condi-
tions of this --solution shall constitute a violation of the zoning
code, shall automatically terminate any authority granted herein, and
shall be punishable as a misdemeanor.
6. The undersigned applicant has read, understood and hereby agrees
to the terms of this resolution and on behalf of himself, his heirs,
successors and assigns, hereby agrees to the recording of this
resolution in the chain of title of the property.

An existing hazard is County Road 15, and it is hoped that the
bike trail will provide an alternative and discourage people from
using County Road 15.
Councilmember Goetten asked whether the Park Commission was
considering connecting the Orono bike trail with existing bike
trails. Mr. Rost stated that was the general idea. There are
sections along County Road 19 going into Tonka Bay that are
already marked as bike trails. There is also an extensive bike
trail in Plymouth that they are hoping to connect with using
County Road 6. Apparently Minnetrista is looking into the
possibility of a bike trail and perhaps that could connect with
OrOno's trail. Councilmember Goetten was also concerned about
safety and adequate signage, specifically on Willow. Mr. Rost
said that attention to safety would be given to those
connections that would cross Highway #12 and Highway #6.
Councilmember Goetten asked if the Park Commission had a cost
estimate for the bike trail. Mr. Rost stated that the project
will be quite costly, but felt that doing the project in pieces
and obtaining public support would crake the project feasible.
Acting City Administrator Gerhardson stated that once a project
such as this was approved it would be submitted to Hennepin
County and the State for their use when they are planning some
upgrading in this area. This could mean possible funding from
the County or State for this project.
