CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 4 8 51 <br />A RESOLUTION GRANTING A CONDITIONAL USE <br />PERMIT PER SECTION 10.03, SUBDIVISION 19 <br />FILE NO. 02-2819 <br />\VHEREAS, Timothy Devries and Gayle Devries, (hereinafter "the applicants") are <br />owners of the property located at 2180 Abingdon Way within the City of Orono (hereinafter "the <br />City") and legally described as follows: <br />Lot 6, Block 1, Abingdon Glen, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />\VHEREAS, the applicants have applied for a conditional use permit per Municipal <br />Zoning Code Section 10.03, Subdivision 19 to permit land alteration of 1,040 cubic yards of fill to be <br />moved, approximately 120 cubic yards of which will be trucked from the property to another <br />location, approximately 500 cubic yards will be trucked to the property located at 2150 Abingdon <br />\Vay, and the remaining 420 cubic yards will be used as a base fill for construction of a tennis court; <br />and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on August 19, 2002, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NO\V, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #02-2819. <br />2. The property is located in the RR-lB, Single Family Rural Residential Zoning <br />District. <br />3. The Orono Planning Commission reviewed this application on August 19, 2002 and <br />recommended approval by a vote of 5 to 0. <br />4. The Planning Commission made the following findings of fact: <br />A. Land alteration greater than 500 cubic yards is a conditional use in all <br />districts. <br />Page 1 of 5
