WHEREAS, C. Steven Wilson and Susan D. Wilson, husband and wife ("Wilson"), are the fee owners of property located in the County of Hennepin, State of Minnesota, legally described as Lot 5, Block 1, ABINGDON GLEN ("Property"); WHEREAS, the Property is subject to that certain Declaration of Private Road Easement and Declaration of Covenants recorded February 10, 1984, as Document No. 1562404 in the office of the Hennepin County Registrar of Titles ("Declaration"); WHEREAS, the Declaration provides that, in the event the City is required to maintain the private road described in said Declaration ("Private Road"), the City has the right to place a lien on the Property for a proportionate share of the cost of said maintenance; WHEREAS, Wilson applied to the City of Orono for subdivision of the Property into the following Parcels: That part of Lot 5, Block 1, ABINGDON GLEN, according to the plat thereof on file or ofrecord in the office of the Registrar of Titles in and for Hennepin County, Minnesota, that lies west of the east 60.00 feet thereof ("Parcel 1 "); and The East 60 feet of Lot 5, Block 1, ABINGDON GLEN, according to the plat thereof on file or ofrecord in the office of the Registrar of Titles in and for Hennepin County, Minnesota ("Parcel 2"); . WHEREAS, Wilson desires that Parcel 2 be released from the terms and conditions of the Declaration, including the City's rights to lien thereunder; and WHEREAS, in its Resolution No. 4329 on file in the office of the Hennepin County Registrar of Titles, the City has consented to amendment of the Declaration to release Parcel 2 from the terms and conditions of the Declaration. Chadwick Legal Assistant ORONO CITY COUNCIL MEETING MINUTES FOR AUGUST 9, 1999 (#2410 Peter and Darsi Boynton, Continued) Weinberger stated a variance is needed to the lakeshore setback to allow the residence to be located 47.59 feet from the OWHL of Lake Minnetonka where 75' is required and 21 .01' from the street lot line where 30' is required . The Applicants are proposing to reduce the hardcover in the 0-75' lakeshore to 11 percent where currently 22 percent exists . Under City Codes, no hardcover is allowed in the 0-75' setback. The Planning Commission has recommended denial of the Conditional Use Permit to permit grading within 75' of the lakeshore, but is recommending approval of the variances as proposed on this most recent revised plan due to a hardship based on the uniqueness of the lot. Boynton stated that they have worked hard to revise their plan in an effort to meet the recommendations of the Planning Commission . Boynton remarked that she has briefly reviewed the resolution that is before the City Council tonight. Mayor Jabbour commented that the resolution , if approved, will be filed with the title to the property. Dzurik stated that the Applicants are not proposing to do any excavation outside what is necessary for construction of the house , with the grade for the existing walkout remaining as is. Mayor Jabbour stated that the Applicants will be issued a grading permit to allow for construction of the proposed residence . Steven and Susan Wilson for properties located at 325 South Brown Road and 2150 Abingdon Way. The applicants own both properties involved. They reside at the 325 South Brown Road property, the Abingdon Way lot is vacant. Subdivision Code requires applicants dedicate drainage and utility easements along all newly created property lines . Easements have been granted by the applicants along the new property line. However the underlying drainage and utility easement along the old property line was not vacated at the time the subdivision was approved. The new property line will provide for any future utilities required . The existing drainage and utility easement should be vacated. Typically the old easements are vacated as part of the subdivision. Request to release east 60 feet of Lot 5, Block 1, Abingdon Glen from the Private Road Maintenance Agreement for the private road Abingdon Glen Abingdon Glen is subject to a Declaration of Private Road Easement and Declaration of Covenants .for Maintenance among the property owners. Applicants have requested the east 60 feet of Lot 5, which will become part of 325 Brown Road South property be released from the Private Road Easement. The covenants and easement documents within the Abingdon Homeowner's Association require consent of the City of Orono. The Planning Commission voted 7 to O to recommend approval to vacate the drainage and utility easement underlying the previous lot line. Staffs recommends approval of the request to vacate the 1 O' wide drainage and utility easement along the previously existing property line between 325 South Brown Road and 2150 Abingdon Way based on the fact the easement is no longer necessary as a new drainage and utility easement has been granted along the new property line. Steven Wilson and Susan D. The Abingdon Way lot is · the last vacant lot in Abingdon Glen, and is about 5 acres, half of which is wetland protected under an existing Flowage and Conservation Easement. Applicants' residence is on Brown Road South. The two parcels are separated by Long Lake Creek. Applicants' goal is to gain access to the Luce Line from their residence lot by creating a corridor from the easterly 60' of the Abingdon Way lot; a second goal is to protect a row of trees along the east line of the Abingdon Way lot. The critical conditions identified by staff and Planning Commission as necessary for approval include: 1. 2. 3. 4. Planning Commission Recommendation On April 19 Planning Commision voted 6-0 to recommend approval subject to the 4 above conditions, finding no variances would be required and each lot would be conforming after the proposed lot line rearrangement is completed. Staff Recommendation Applicants' surveyor has confirmed that the Abingdon Way lot will meet the 2.0 acre minimum dry #24 7 4 -Wilson June 24, 1999 Page2 buildable standard, with the new lot line being 60.00 feet west of the existing lot line. A review of the original septic testing information provided when Abingdon Glen was platted, indicates the septic sites will still meet the required 20' lot line setback. The potential buildable envelope for this lot will be slightly smaller than before the lot line rearrangement, but will still provide for two potential house sites. Staff recommends approval of the lot line rearrangement subject to applicants granting the required 1 0' drainage and utility easement adjacent to the new lot line. The old 1 0' easement will remain in place (no vacation was requested). Steven and Susan Wilson, Applicants, were prese_nt.: W~inberger stated the Applicants are requesting a lot line rearrangement to change the lot line · 60 feet to the west to have the trees located along the east property line on the 325 South Brown Road property, which would allow that lot to have platted access to the Luce Line Trail. The property located at 2150 Abingdon Way will continue to have two suitable septic sites that can meet the 20 foot setback requirement from the east property line. The rearranged lot line will not make either lot non-conforming for lot area or setbacks or change the existing building pads. City Staff recommends approval of this application subject to the property owner providing a new 1 O foot drainage easement along the new east property line for 2150 Abingdon Way as well as the other conditions outlined in the April 19, 1999 Planner's Report. Mrs. Wilson commented that the land might be sold and they wanted to insure that the trees in that area will not be cut down. Smith noted that this was an unusual situation, but questioned whether the City would be running the risk of having other property owners construct alleys to other desirable locations. Weinberger stated the City has seen proposals similar to this requesting walkways down to Lake Minnetonka, but this is the first application requesting a walkway to the Luce Line. Weinberger remarked that another alternaiive to preserving the trees would be to grant a conservation easement, but noted this lot line rearrangement is really not creating a flag lot There were no public comments. Lindquist commented he does not have a problem with this application. Schroeder inquired whether any variances were necessary with this application. Weinberger stated it was simply a lot line rearrangement and would not require any variances. Lindquist moved, Berg seconded, to recommend approval of Application #2474, 325 Brown Road South/2510 Abingdon Way, Lot Line Rearrangement, with the understanding that a new 10 foot drainage easement along the new east property line for 2150 Abingdon Way will be required. I was told that the resolution could be revised and I would appreciate it if you would check on that. My wife and I have gone to the City and signed the survey relating to the rearrangement. In that regard, the City Council resolution referred to my wife as Susan Wilson, but she is in the title as Susan D. Wilson. I was told that the resolution could be revised and I would appreciate it if you would check on that. There is also a vacation of easement action before the City Council on August 9. and I would appreciate it if you could check that our names are correct on that as well. As requested by the City, I enclose an executed new drainage and utility easement as well as a report of our firm on the state of title to the property. I also enclose a consent of U.S. Bank to the vacation of easement which lies within an area subject to a mortgage in favor of U.S. Bank. Finally, I note that Abingdon Glen is subject to a Declaration of Private Road Easement and Declaration of Covenants for Maintenance of Same among the Lot owners and the City of Orono. Steven Wilson ORONO PLANNING COMMISSION MEETING MINUTES FOR JULY 19, 1999 (#2504 Warren and Tana Garrett, Continued) Warren Garrett, Applicant, was present. Jenson stated the Applicant is proposing to add an addition to the northeast comer of the home, a deck addition, which will be located on the southeast comer of the existing deck, and an inground swimming pool. The existing hardcover, including the total surface area of the additions, will not exceed 30 percent. A variance is needed to the average lakeshore setback. Staff feels that the proposed location is the most logical and will not block or interfere with the view of either neighbor towards the lake, with heavy vegetation between the residences . Jenson stated the Applicant is also requesting to install a three rail, split-rail fence, 5 feet in height, along the south property line to the lakeshore. The president of the West Shore Townhome Association has written a letter .c the City protesting any fence being erected on the Applicant's property. The Applicants are pr::posing th E fence due to the fact that the neighboring lakeshore owner to the south is a '-ong La ke City Par'I\, and the Applicants have had people trespass on their property and dock. The Applicants feel that the proposed fence will be high enough to deter · trespassers, but will not block the view of the adjoining homes. Garrett commented that the letter was written before his application was written, but that he is willing at this time to not construct the proposed fence. Garrett stated he was considering the fence to help deter people from using his dock. Hawn suggested that perhaps he consider installing a sign indicating that it is private property. Garrett inquired whether a fence located on the dock would be a problem, noting that he has some concerns regarding liability. Garrett indicated that the neighbor who has expressed disapproval of the fence was here at tonight's meeting but has left. Weinberger stated a fence located on the dock would be outside the jurisdiction of the City, and the impact that the fence located along the property line would need to be taken into consideration. Garrett stated he could install a fence on the dock with a gate which would require any trespassers to enter the water in order to obtain access to the dock. Lindquist indicated he does have a problem with a fence in the 0-75' setback. Gaffron stated the City of Orono has not adopted any codes relating to docks, but that he personally does not have any objection to a fence surrounding the dock to deter trespassers. · Garrett indicated that he is willing to drop the fence portion of his application tonight. There were no public comments. However, the previous underlying drainage and utility easement along the old property line was not vacated at the time the subdivision was approved, which should be vacated. Staff is recommending approval of this application. Wilson had no comment. Hawn inquired whether the Applicant would be agreeable to affirming the agreement with Abingdon Way. Wilson stated it would not be an affirmation, but merely notifying the owners of each lot in this division that they are liable for each easement. Wilson stated he would approach the homeowners association requesting that the 60 foot pathway be eliminated from their agreement, which requires City agreement. Hawn inquired whether that portion was before the Planning Commission as part of this application and whether any legal notice must be given to the adjoining property owners. Gaffron stated that it was, noting that technically action by the Planning Commission may not be required. Gaffron stated that in his opinion no notice is required. There were no public comments. Kelley stated that MnDOT will need to notify Orono of their final decision regarding this intersection, but that the City is in favor of a full intersection at this location . Kelley remarked that should MnDOT refuse to construct a full intersection, then he would be supportive of a right-in/ right-out intersection to allow Service 800 access to their property. Mayor Jabbour encouraged MnDOT to consider a full intersection at this location. O'Keefe stated that MnDOT is proposing the safest intersection for this location. Mork-Bredeson stated she would like to have a left-in/right-in/right-out intersection and that full access could be negotiated in the future, which would allow her to construct her driveway. Sansevere inquired whether MnDOT would consider a full intersection. O'Keefe stated that MnDOT may consider that request if the City's position is adamant in that regard . .. Hawn inquired whether there were any public comments regarding this application. Pat Dougherty, Old Crystal Bay Road, stated he has no particular difficulties with this proposed subdivision, but expressed a concern over the amount of land developed to the north and the increased water runoff problems they have been experiencing since that time. Dougherty requested that that issue be addressed. Stickney commented that he would be willing to review the drainage to see if steps could be taken to correct the problem. Weinberger stated City Staff would like to see more water runoff to the drainage pond. Stickney remarked that there will not be a horse housed on Lot 2 due to a covenant that will be in effect with this subdivision. · Lindquist commented that the Applicant should be aware that City Staff is recommending a ten foot easement in addition to the park dedication fee for this subdivision. Hawn noted that the City is not in possession of the septic reports for this subdivision. Stickney stated that the septic inspe·ctor has been out t~ the prop~rty and has not found any major issues involving the septic. Stickney remarked that it was his understanding that the reports had been submitted to the City and was not sure why the City does not have them at this time. Hawn inquired how frequently variances are given to lots that do not meet the 200 foot setback at the street. Weinberger stated that variances to street width are typically granted on a cul-de-sac due to the fact that if the lots were required to meet the 200 foot street width, that the lots would not function we!! with the other lots and would have an unusual configuration. Stoddard inquired whether this was a subdivision or preliminary plat approval. Stickney stated it was a preliminary plat application. · Stoddard moved, Lindquist seconded, to recommend approval of Application #2477, 250 and 340 Old Crystal Bay Road South, Class Ill Preliminary Plat Subdivision, to permit variances to the 200 foot street width for Lots 3, 4, and 5, subject to the conditions outlined in the April 19, 1999 Planner's Report and the April 5, 1999 City Engineer's report, and further subject to the incorporation of any recommendations by the DNR and Hennepin County regarding the drainage into the final plat application. VOTE: Ayes 6, Nays 0. 6. #2474 SUSAN WILSON, 325 BROWN ROAD SOUTH/2510 ABINGDON WAY, LOT LINE REARRANGEMENT Page6 ORONO PLANNING COMMISSION MINUTES FOR APRIL 19, 1999 (#2474 Susan Wilson, continued) The Certificate of Mailing and Affidavit of Publication were noted. Steven and Susan Wilson, Applicants, were prese_nt. Weinberger stated the Applicants are requesting a lot line rearrangement to change the lot line · 60 feet to the west to have the trees located along the east property line on the 325 South Brown Road property, which would allow that lot to have platted access to the Luce Line Trail. The property located at 2150 Abingdon Way will continue to have two suitable septic sites that can meet the 20 foot setback requirement from the east property line. The rearranged lot line will not make either lot non-conforming for lot area or setbacks or change the existing building pads. City Staff recommends approval of this application subject to the property owner providing a new 1 0 foot drainage easement along the new east property line for 2150 Abingdon Way as well as the other conditions outlined in the April 19, 1999 Planner's Report. Mrs. Wilson commented that the land might be sold and they wanted to insure that the trees in that area will not be cut down. Smith noted that this was an unusual situation, but questioned whether the City would be running the risk of having other property owners construct alleys to other desirable locations. Weinberger stated the City has seen proposals similar to this requesting walkways down to Lake Minnetonka, but this is the first application requesting a walkway to the Luce Line. Weinberger remarked that another alternative to preserving the trees would be to grant a conservation easement, but noted this lot line rearrangement is really not creating a flag lot There were no public comments. Lindquist commented he does not have a problem with this application. Schroeder inquired whether any variances w~re necessary with this application. Weinberger stated it was simply a lot line rearrangement and would not require any variances. Lindquist moved, Berg seconded, to recommend approval of Application #2474, 325 Brown Road South/2510 Abingdon Way, Lot Line Rearrangement, with the understanding that a new 10 foot drainage easement along the new east property line for 2150 Abingdon Way will be required. VOTE: Ayes 6, Nays 0. Mr. Wilson inquired whether they would be able to be put on the May 10th City Council agenda. Weinberger stated they would need to submit the existing and proposed legal descriptions, along with the new easements shown on the survey, by the end of next week Wednesday. Wilson signed in favor of the City. Upon review of the resolution, I found that Mrs. Wilson's name had been corrected on the resolution to read "Susan D. Wilson." Prior to recording the Resolution and the Easement, the real estate taxes payable in 1999 for all of the property subject to the pending subdivision must be paid in full. I am advised by the Hennepin County Treasurer's office that only the first half have been paid. If your mortgagee pays your real estate taxes, perhaps we can wait until after October 15, 1999, to record the documents. Please return the original partial release of mortgage to me to be recorded with the subdivision documents and, if you would like to have the subdivision documents recorded earlier than October 15, 1999, please also return a check to me made payable to the Hennepin County Treasurer for the second half taxes. I have confirmed with the City that the easement vacation was approved at the Council meeting on August 9. I should be receiving a certified copy of that resolution shortly and will record it simultaneously with the subdivision documents. With respect to amending the Declaration of Easements, Covenants, Conditions and Restrictions of Abingdon Glen and the Declaration of Private Road Easement relating to Abingdon Way, I have not received a copy of either of these documents for review. I do believe, however, that the procedures set forth in both of these documents for amendment must be followed to release a portion of Lot 5 from the restrictions and conditions set forth therein. I am advised that the City consented to the release of C. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required to supply the requested data; ( c) any known consequence arising from his supplying or refusing to supply private or confidential data; and ( d) the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer. The commissioner of revenue may place the notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those forms. Subd. 3. Access to data by individual. Upon request to a responsible authority, an individual shall be informed whether he is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon his further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning, the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data.
