A RESOLUTION APPROVING AN AFTER THE FACT
CONDITIONAL USE PERMIT FOR ROGER VEON
FOR THE DREDGING OF A WILDLIFE POND ON
PROPERTY LOCATED AT 1330 SIXTH AVENUE NORTH
WHEREAS, t�e City of Orono is a Municipal Corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, pursuant to State Statute 412 et. seq. and 463 et. seq. ,
the City Council of the City of Orono has adopted zoning regulations for
the protection of the public health, safety and welfare; and
WHEREAS, pursuant to Section 31. 832 (b) of the Orono Zoning Code,
Roger Veon has been required to file an application for a conditional use
permit for the dredging of a wildlife pond within a designated wetland
area without City' s approval on property located at 1330 Sixth Avenue
North; and
WHEREAS, the• City Council has reviewed the application; the
•recommendations of staff and the Planning Commission; the oral and written
comments made by the applicant; the City Council makes the following
""findings of fact:
1) The Veon property is 2. 6 acres in area and legally
described as Lot 4, Block l, Underhill Farm.
2) The wildlife pond is approximately 30 ' x 288 ' or
6840 sf in area.
3) The pond is located within a designated wetland
area. �
4) The wetland has existed for several years and .
was reported to have been created by the gradual
� deterioration of an extensive underground drainage
system, draining from the northeast and northwest.
5) The area of the spill out on the Veon property was
described as wet and mucky inhabited by mosquitos
and snakes. At times of a heavy rainfall the area
became a drainageway creating a waterfalls over the
property to the south and causing severe erosion.
6) The pond area affords a retention basin for the
excessive drainage and has alleviated the erosion
of the steep banks on property to the south.
7) The Hennepin Soil and Water Conservation District
has reviewed the project finding the pond envi-
ronmentally sound for wildlife habitation. .

8) The abutting property owners have all written
letters stating their approval of the application
claiming their properties have all benefitted from
the additional drainage retention provided by the
ponding area.
9) To permit the maintenance of the established
wildlife pond is in accord with the intent and
. objections of the Orono Zoning Code and environ-
mental sections of the Orono Community Management
Plan.
NOW, THEREFORE BE IT RESOLVED that the City Council of
the City of Orono hereby approves the after the fact application of
Roger Veon for a conditional use permit for the dredging of a wildlife
pand provided that the applicant complete for the purpose of filing a
conservation and flowage easement that will grant the City clear and
defined environmental controls over the designated wetland area and at
some future time confirms the right of the applicant to apply to the
•City for a conditional use permit to maintain the wildlife pond.
Adopted by the City Council of the City of Orono, Minnesota
at a regular meeting held this 26 day of October 1981.
