RESOLUTION OF THE CITY COUNCIL

' � - � � A RESOLUTION APPROVING A CONDITIONAL USE
PERMIT FOR JOAN LUNDQUIST FOR A RESTAURANT
LOCATED AT 3416 SHORELINE DRIVE
WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, pursuant to State Statutes 412 et. seq. and 463 et. seq. ,
the City Council of the City of Orono has adopted zoning regulations for
the protection of the public health, safety and welfare; and
WHEREAS, pursuant to Section 35. 024 of the Orono Zoning Code,
Joan Lundquist has applied for a conditional use permit as the new
owner-operator of the Mexican Inn located at 3416 Shoreline Drive; and
WHEREAS, after review of the Planning Commission and City staff,
the City Council hereby makes the following findings of fact:
1) The new owners plan no physical changes of the
• existing' structure nor any changes in the interior
design.
2) The kitchen will continue to serve fxom a traditional
Mexican menu.
3) The owner and her daughter will be the sole operators
of the restuarant.
4) The hours of operation are as follows:
Monday - Thursday 11: 30 AM - 2: 00 PM, 5: 00 PM - 8 : 00 PM
Friday - 11: 30 AM - 2 : 00 PM, 5: 00 PM - 9: 00 PM
Saturday 5: 00 PM - 9: 00 PM
5) Additional parking is provided in the rear and
and side parking lots.
6) The existing signage for the restuarant satisfies �
all code requirements of Section 38. 031.
7) The City Council approved a beer license for the
Mexican Inn at their September 28 , 1981 meeting.
8) The proposed use is in accord with the intent and
objectives of the zoning code and the purpose of
the B-1 zoning district.
9) The proposed use is in accord with the intent and
objectives of the Orono Comprehensive Lane Use Plan. ,
10) The location of the conditional use and the proposed �
conditions under which the restaurant wou�d be
operated or maintained are not detrimental to the
public health, safety or welfare.

11) The proposed use is not materially injurious to
properties or improvements in the surrdunding
business community. '
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Orono hereby approves the application of Joan Lundquist for a
conditional use permit for operating a restuarant subject to the
following conditions:
l) The City Council hereby reserves the ri�ht to
review and/or modify the conditional use permit,
if at any time in the future, the Council finds
the conditions of the subject permit to be violated
or if the proposed use is found to be detrimental
to the health, safety and public welfare of Orono
citizens. In particular, the Council hereby reserves
� the right to restrict the hours of operation; if
complaints are received in the future.
2) Sale of the business or premises� to a new owner
or conversion to a different use shall require
application and review by the City for approval �
to transfer this conditional use permit.
Adopted by the City Council of the City of Orono, Minnesota
at a regular meeting held October 14, 1981. �
