CITY of ORONO A \,‘so u�; RESOLUTION OF THE CITY COUNCIL IAA ' Ofl ' _ C, NO. 6 3 1 5 4kESiIOg WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesotaii pity Code, a public hearing was held by the Orono Planning Commission on August 2013 at which times all persons desiring to be heard concerning this applicationre given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 13-3624. 2. The Property is located in the LR-1 B, One Family Lakeshore Zoning District which requires a minimum lot area of 1.0 dry acres and a minimum lot width of 140 feet. 3. The Planning Commission reviewed this application at a public hearing held on August 19, 2013 and voted 6 for and 0 against on a motion to approve the CUP. The Planning Commission finds that the following factors support the granting of the requested CUP: a. The Property is 1.5 acres in area; has 173 feet of width at the lakeshore and 149 feet in width at the 75-foot setback. b. The request for fill in excess of 500 cubic yards will not impact the Property as viewed from the lake. c. The elevation which the fill is ultimately achieving will be consistent with the grades on the Owner's property to the south. d. The fill will be brought in over the Owner's access off of Bohns Point Road and not over the shared driveway accessing off of North Shore Drive. Neither the shared driveway nor the adjacent properties will be negatively impacted by the proposed fill. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed CUP on the health, safety and welfare of the community. O O CITY of ORONO ,-� =-"$% S,f1.°6P( ir t RESOLUTION OF6TE1CTY COUNCIL ESHev CONCLUSIONS, ORDER 4ND CONDITIONS Based upon one or more of the above findigs, the Orono City Council hereby grants a CUP for filling and grading activity in excess of 500 cubic yards per Orono Municipal Zoning Code Sections 78-916, 78-966 & 78-1286 in order to incorporate approximately 2,267 cubic yards of fill into the Property; subject to the following conditions: 1. Council approval is based on the grading plan submitted by the Owner and annotated by City staff, attached to th s Resolution as Exhibit A. Any amendments to the grading plan may require further Planning Commission and City Council review. 2. A double row of silt fencing shall be placed and maintained between the lakeward extent of the grading activity and the lake. 3. The Owner shall conform to the recommendations of the City Engineer. 4. The amount of fill brought onto the Property shall be monitored so as to ensure compliance with the approved grading plan. 5. An administrative Zoning Permit for Major Land Alteration is required prior to the commencement of grading activities. 6. The Owner shall submit an escrow in the amount of $5,000.00 for erosion control purposes with the application for Zoning Permit for Major Land Alteration prior to commencement of grading activities. 7. An as-built grading plan/survey showing conformance with the approved plan shall be submitted prior to the final inspection of the site grading. Conditional Use Permit Analysis According to Section 78-1286(e) the following considerations and conditions must be adhered to during the issuance of construction permits, grading and filling permits, conditional use permits, variances and subdivision approvals: (1) Grading or filling in any type 1, 2, 3, 4, 5, 6, 7 or 8 wetland must be evaluated to determine how extensively the proposed activity would affect the following functional qualities of the wetland... Not applicable (2) Alterations must be designed and conducted in a manner that ensures only the smallest amount of bare ground is exposed for the shortest time possible. This will be addressed by the Stormwater Pollution Prevention Plan as submitted and approved by the city Engineer. (3) Mulches or similar materials must be used, where necessary, for temporary bare soil coverage, and a permanent vegetation cover must be established as soon as possible. This will be addressed by the Storm water Pollution Prevention Plan as submitted and approved by the City Engineer. (4) Methods to minimize soil erosion and to trap sediments before they reach any surface water feature must be used. This will be addressed by the Stormwater Pollution Prevention Plan as submitted and approved by the City Engineer. (5) Altered areas must be stabilized to acceptable erosion control standards consistent with the field office technical guides of the local soil and water conservation districts and the United States Soil Conservation Service. This will be addressed by the Storm water Pollution Prevention Plan as submitted and approved by the City Engineer. (6) Fill or excavated material must not be placed in a manner that creates an unstable slope. The plans have been reviewed and approved by the City Engineer. (7) Plans to place fill or excavated material on steep slopes must be reviewed by the city engineer for continued slope stability and must not create finished slopes of 30 percent or greater. The plans have been reviewed and approved by the City Engineer. (8) Fill or excavated material must not be placed in bluff impact zones. Not applicable. (9) Any alterations below the ordinary high water level of public waters must first be authorized by the commissioner of the department of natur I resources under Minn. Stat. § 103G.245. Not applicable. (10) Alterations of topography must only be allowed if they are accessory to permitted or conditional uses and do not adversely affect adjacent or ne rby property. The plans have been reviewed and approved by the City Engineer specifically to assure no n gative impacts on adjacent properties. • • FILE#13-3624 13 August 2013 Page 3 of 4 (11) Placement of natural rock riprap, including associat:d grading of the shoreline and placement of a filter blanket, is permitted if the finished slope does not exceed three feet horizontal to one foot vertical, the landward extent of the riprap is within ten feet of the o dinary high water level, and the height of the riprap above the ordinary high water level does not excee. three feet. A riprap permit shall be obtained per the requirements of section 78-969. Not applicable. Additionally, by code conditionally permitted uses must be r-viewed using the criteria found in Section 78- 916. On the basis of the application and the evidence submitted, the city must find that the proposed use at the proposed location is or will be: (1) Consistent with the community management plan; (2) Compliant with the zoning code, including any conditions imposed on specific uses as required by article V, division 3 (i.e. 78-966 thru 78-968) of the City Code; (3) Adequately served by police, fire, roads, and storn7water management; (4) Provided with an adequate water supply and sewage disposal system; (5) Not expected to generate excessive demand for public services at public cost; (6) Compatible with the surrounding area as the area is used both presently and as it is planned to be used in the future; (7) Consistent with the character of the surrounding area, unless a change of character is called for in the community management plan; (8) Compatible with the character of buildings and site improvements in the surrounding area, unless a change of character is called for in the community management plan; (9) Not expected to substantially impair the use and ejnjoyment of the property in the area or have a materially adverse impact on the property values in the area when compared to the impairment or impact of generally permitted uses; (10) Provided with screening and buffering adequate to mitigate undesirable views and activities likely to disturb surrounding uses; (11) Not create a nuisance which generates smoke, noise, glare, vibration, odors, fumes, dust, electrical interference, general unsightliness, or of er means; (12) Not cause excessive non-residential traffic on r sidential streets, parking needs that cause a demonstrable inconvenience to adjoining properti s,traffic congestion, or unsafe access; (13) Designed to take into account the natural, sce ic, and historic features of the area and to minimize environmental impact; (14) All exterior lighting shall be so directed so as not to cast glare toward or onto the public right-of- way or neighboring residential uses or districts; and (15) Not detrimental to the public health, public safety,or general welfare. With regard to this application, items 2, 6, 7, 9, and 13 are generally applicable. Re: Item 2. The proposed grading is residential in nature anc: are compliant with the zoning code. Re: Items 6 & 7. These criteria essentially ask whether the proposed new grade is appropriate and in character with the surrounding land and neighborhood. Drainage patterns for runoff leaving the site should be improved. The resulting grade will blend into the property to the south. Re: Item 9. This standard requires that the grading activ ty must not substantially impair the use and enjoyment of the property in the area or have an adverse i pact on the property values in the area when compared to the impairment or impact of generally permitt:d uses. The proposed use of the property as a residential property will not be changing as a result of the p oposed grading activity, so there should be no change in the use and enjoyment of adjacent properties. Re: Item 13. This standard requires that the grading be de igned to take into account the natural, scenic, and historic features of the area and to minimize environm ntal impact. The proposed grading on this lot will have minimal if any environmental impacts. As the property is proposed to be vegetated to match the property to the south there should not be undesirable views of the property when viewed from the lake. We offer the following observations, co ents, and recommendations for your consideration: 1. The Applicant proposes to move more than 500 cy of m.terial within the Shoreland Overlay District. Therefore, Conditional Use Permit approval by the City ouncil is required in addition to the staff- issued Land Alteration Permit. Also, since the Applica t proposes to achieve proposed grades by importing fill,the City should consider the following: a. The City Engineer should be allowed to inspect any fill being imported to the site prior to it being placed. b. The Applicant should confirm with the City Engine r acceptable hours of truck hauling and provide documentation on the haul route to be used. Acceptable hours and haul route should be approved prior to the importing of any fill. c. The City Engineer should inspect roadways on haul oute prior to and following completion of work to determine whether adverse impacts have oc urred. The applicant should be responsible for the repair to roadways for any adverse impacts. 2. Grading,filling, and excavating of less than 10 cy is proposed within 75 feet of the ordinary high water level of Lake Minnetonka,which requires staff review and approval. A boulder wall is being removed in this area; therefore, a minimum amount of grading is required to accommodate the grade change. The grading proposed in the 75' zone will not adversely affect adjacent or nearby property. 3. The proposed grading in the northeast corner of the site does not appear to match what is intended. The 936 contour does not connect with the edge of the site and a depression is shown in the northeast corner. The grading should be revised to depict the swale continuing along the north and east property line, flowing continuously to the 934 contour. 4. For areas where a 50 foot natural buffer to the ordinary Nigh water level cannot be maintained, a double row of siltfence should be installed to ensure adequate erosion and sediment control protection for Lake Minnetonka. The perimeter siltfence should be inspected by the City prior to any land altering activities. 5. The proposed swale along the north property line will c ncentrate runoff flow. Tree protection fencing should be installed at the outsid 1 edge of the drip zone for trees to be saved, and the fencing should be inspected by the City prior to ny land altering activities. 7. Since this project will disturb the majority of the lot and is located directly adjacent to Lake Minnetonka, it is recommended that a financial security bf$5,000 for erosion control and engineering oversight be required of the Applicant. The financial security is intended to provide protection in the event that it becomes necessary for the City to install or maintain erosion and sediment control within the project area and covers the cost of turf re-establishment if the applicant is unable to follow through with the conditions of approval. 8. The applicant will be required to obtain Minnehaha Creek Watershed District(MCWD) approval and permitting for their Erosion Control Rule. We offer the following observations,co ents, and recommendations for your consideration: 1. The Applicant proposes to move more than 500 cy of m terial within the Shoreland Overlay District. Therefore,Conditional Use Permit approval by the City ouncil is required in addition to the staff- issued Land Alteration Permit. Also,since the Applica proposes to achieve proposed grades by importing fill,the City should consider the following: a. The City Engineer should be allowed to inspect any I ill being imported to the site prior to it being placed. b. The Applicant should confirm with the City Engine:r acceptable hours of truck hauling and provide documentation on the haul route to be used. Acceptable hours and haul route should be approved prior to the importing of any fill. c. The City Engineer should inspect roadways on haul i oute prior to and following completion of work to determine whether adverse impacts have oc urred.The applicant should be responsible for the repair to roadways for any adverse impacts. 2. Grading,filling,and excavating of less than 10 cy is pro•osed within 75 feet of the ordinary high water level of Lake Minnetonka,which requires staff review . d approval. A boulder wall is being removed in this area;therefore,a minimum amount of grading is equired to accommodate the grade change. The grading proposed in the 75' zone will not adversely affect adjacent or nearby property. 3. The proposed grading in the northeast corner of the site s oes not appear to match what is intended. The 936 contour does not connect with the edge of the s to and a depression is shown in the northeast corner. The grading should be revised to depict the swa e continuing along the north and east property line,flowing continuously to the 934 contour. 4. For areas where a 50 foot natural buffer to the ordinary p igh water level cannot be maintained,a double row of siltfence should be installed to ensure ad-•uate erosion and sediment control protection for Lake Minnetonka. The perimeter siltfence should b: inspected by the City prior to any land altering activities. 5. The proposed swale along the north property line will c•ncentrate runoff flow. (a) The planning commission may recommend and the council may grant a conditional use permit as the use permit was applied for or in modified form. On the basis of the application and the evidence submitted, the city must find that the proposed use at the proposed location is or will be: (1) Consistent with the community management plan; (2) Compliant with the zoning code, including any conditions imposed on specific uses as required by article V, division 3 of the City Code; (3) Adequately served by police, fire, roads, and stormwater management; (4) Provided with an adequate water supply and sewage disposal system; (5) Not expected to generate excessive demand for public services at public cost; (6) Compatible with the surrounding area as the area is used both presently and as it is planned to be used in the future; (7) Consistent with the character of the surrounding area, unless a change of character is called for in the community management plan; (8) Compatible with the character of buildings and site improvements in the surrounding area, unless a change of character is called for in the community management plan; (9) Not expected to substantially impair the use and enjoyment of the property in the area or have a materially adverse impact on the property values in the area when compared to the impairment or impact of generally permitted uses; (10)Provided with screening and buffering adequate to mitigate undesirable views and activities likely to disturb surrounding uses; (11) Not create a nuisance which generates smoke, noise, glare, vibration, odors, fumes, dust, electrical interference, general unsightliness, or other means; (12) Not cause excessive non-residential traffic on residential streets, parking needs that cause a demonstrable inconvenience to adjoining properties, traffic congestion, or unsafe access; (13)Designed to take into account the natural, scenic, and historic features of the area and to minimize environmental impact; (14)All exterior lighting shall be so directed so as not to cast glare toward or onto the public right-of-way or neighboring residential uses or districts; and (15) Not detrimental to the public health, public safety, or general welfare. (b) A conditional use permit may be granted subject to such conditions as the council may prescribe. (c) A conditional use permit shall remain in effect as long as the conditions imposed by the city council are observed, but nothing in this section shall prevent the city from enacting or amending official controls to change the status of conditional uses. (d) A certified copy of any conditional use permit shall be filed with the county recorder or registrar of titles. The conditional use permit shall include the legal description of the property included. • • (Code 1984, § 10.09(6); Ord. No. 77 3rd series, § 1, 7-12-2010) Sec. 78-1286. -Topographic alterations/grading and filling. (a) Grading and filling and excavations necessary for the construction of structures, sewage treatment systems, and driveways under validly issued construction permits for these facilities do not require the issuance of a separate grading and filling permit. However, all grading and filling activity approved permits for construction of structures, sewage treatment systems, and driveways shall adhere to the grading and filling standards of this article. (b) Grading, filling or excavating of more than ten cubic yards is prohibited within 75 feet of the ordinary high water level of the public waters enumerated in section 78-1217. Grading, filling or excavating of ten cubic yards or less shall require city staff review and permit and be subject to other pertinent sections of this chapter. (c) Public and private roads, driveways, parking areas, and public or private watercraft access ramps shall not be constructed within 75 feet of the ordinary high water level of the public waters enumerated in section 78-1217. If no alternatives exist, such improvements shall be subject to the standard zoning variance review procedure, and such review shall take into account the following considerations: (1) Such improvements shall be designed to take advantage of natural vegetation and topography to achieve maximum screening from view from public waters. (2) All roads and parking areas shall be designed and constructed to minimize and control erosion to public waters consistent with the requirements of all agencies with jurisdiction. (d) Except for those projects requiring permits for construction of structures, sewage treatment systems and driveways, a land alteration permit will be required as follows: (1) For movement of one through 500 cubic yards of material anywhere within the Shoreland Overlay District, a staff-issued land alteration permit shall be required. (2) For movement of more than 500 cubic yards of material within the Shoreland Overlay District, conditional use permit approval by the city council is required in addition to the required land alteration permit. (e) The following considerations and conditions must be adhered to during the issuance of construction permits, grading and filling permits, conditional use permits, variances and subdivision approvals: (1) Grading or filling in any type 1, 2, 3, 4, 5, El, 7 or 8 wetland must be evaluated to determine how extensively the proposed activity would affect the following functional qualities of the wetland: a. Sediment and pollutant trapping and retention; b. Storage of surface runoff to prevent or reduce flood damage; c. Fish and wildlife habitat; « t • d. Recreational use; e. Shoreline or bank stabilization; and f. Noteworthiness, including special qualities, such as historic significance, critical habitat for endangered plants and animals, or others. This evaluation must also include a determination of whether the wetland alteration being proposed requires permits, reviews or approvals by other sections of city ordinances or by other local state or federal agencies including but not limited to watershed districts, state department of natural resources, or the United States Army Corps of Engineers. (2) Alterations must be designed and conducted in a manner that ensures only the smallest amount of bare ground is exposed for the shortest time possible. (3) Mulches or similar materials must be used, where necessary, for temporary bare soil coverage, and a permanent vegetation cover must be established as soon as possible. (4) Methods to minimize soil erosion and to trap sediments before they reach any surface water feature must be used. (5) Altered areas must be stabilized to acceptable erosion control standards consistent with the field office technical guides of the local soil and water conservation districts and the United States Soil Conservation Service. (6) Fill or excavated material must not be placed in a manner that creates an unstable slope. (7) Plans to place fill or excavated material on steep slopes must be reviewed by the city engineer for continued slope stability and must not create finished slopes of 30 percent or greater. (8) Fill or excavated material must not be placed ih bluff impact zones. (9) Any alterations below the ordinary high water level of public waters must first be authorized by the commissioner of the department of natural resources under Minn. Stat. § 103G.245. (10)Alterations of topography must only be allowed if they are accessory to permitted or conditional uses and do not adversely affect adjacent or nearby property. (11) Placement of natural rock riprap, including associated grading of the shoreline and placement of a filter blanket, is permitted if the finished slope does not exceed three feet horizontal to one foot vertical, the landward extent of the riprap is within ten feet of the ordinary high water level, and the height of the riprap above the ordinary high water level does not exceed three feet. A riprap permit shall be obtained per the requirements of section 78-969 (f) Excavations where the intended purpose is connection to a public water, such as boat slips, canals, lagoons and harbors, are prohibited above the ordinary high water level. Such excavations below the elevation or the ordinary high water level are subject to approval of the department of natural resources and other agencies with concurrent jurisdiction. (Ord. On the basis of the application and the evidence submitted, the city must find that the proposed use at the proposed location is or will be: (1) Consistent with the community management plan; (2) Compliant with the zoning code, including any conditions imposed on specific uses as required by article V, division 3 of the City Code; (3) Adequately served by police, fire, roads, and stormwater management; (4) Provided with an adequate water supply and sewage disposal system; (5) Not expected to generate excessive demand for public services at public cost; (6) Compatible with the surrounding area as the area is used both presently and as it is planned to be used in the future; (7) Consistent with the character of the surrounding area, unless a change of character is called for in the community management plan; (8) Compatible with the character of buildings and site improvements in the surrounding area, unless a change of character is called for in the community management plan; (9) Not expected to substantially impair the use and enjoyment of the property in the area or have a materially adverse impact on the property values in the area when compared to the impairment or impact of generally permitted uses; (10)Provided with screening and buffering adequate to mitigate undesirable views and activities likely to disturb surrounding uses; (11)Not create a nuisance which generates smoke, noise, glare, vibration, odors, fumes, dust, electrical interference, general unsightliness, or other means; (12) Not cause excessive non-residential traffic on residential streets, parking needs that cause a demonstrable inconvenience to adjoining properties, traffic congestion, or unsafe access; (13) Designed to take into account the natural, scenic, and historic features of the area and to minimize environmental impact; (14)All exterior lighting shall be so directed so as not to cast glare toward or onto the public right-of-way or neighboring residential uses or districts; and (15) Not detrimental to the public health, public safety, or general welfare. (b) A conditional use permit may be granted subject to such conditions as the council may prescribe. (c) A conditional use permit shall remain in effect as long as the conditions imposed by the city council are observed, but nothing in this section shall prevent the city from enacting or amending official controls to change the status of conditional uses. (d) A certified copy of any conditional use permit shall be filed with the county recorder or registrar of titles. The conditional use permit shall include the legal description of the property included. • • • (Code 1984, § 10.09(6); Ord. No. 77 3rd series, § 1, 7-12-2010) Sec. 78-1286. -Topographic alterations/grading and filling. (a) Grading and filling and excavations necessary for the construction of structures, sewage treatment systems, and driveways under validly issued construction permits for these facilities do not require the issuance of a separate grading and filling permit. However, all grading and filling activity approved permits for construction of structures, sewage treatment systems, and driveways shall adhere to the grading and filling standards of this article. (b) Grading, filling or excavating of more than ten cubic yards is prohibited within 75 feet of the ordinary high water level of the public waters enumerated in section 78-1217. Grading, filling or excavating of ten cubic yards or less shall require city staff review and permit and be subject to other pertinent sections of this chapter. (c) Public and private roads, driveways, parking areas, and public or private watercraft access ramps shall not be constructed within 75 feet of the ordinary high water level of the public waters enumerated in section 78-1217. If no alternatives exist, such improvements shall be subject to the standard zoning variance review procedure, and such review shall take into account the following considerations: (1) Such improvements shall be designed to tale advantage of natural vegetation and topography to achieve maximum screening from view from public waters. (2) All roads and parking areas shall be designed and constructed to minimize and control erosion to public waters consistent with the requirements of all agencies with jurisdiction. (d) Except for those projects requiring permits for construction of structures, sewage treatment systems and driveways, a land alteration permit will be required as follows: (1) For movement of one through 500 cubic yards of material anywhere within the Shoreland Overlay District, a staff-issued land alteration permit shall be required. (2) For movement of more than 500 cubic yards of material within the Shoreland Overlay District, conditional use permit approval by the city council is required in addition to the required land alteration permit. (e) The following considerations and conditions must be adhered to during the issuance of construction permits, grading and filling permits, Iconditional use permits, variances and subdivision approvals: (1) Grading or filling in any type 1, 2, 3, 4, 5, 6, 7 or 8 wetland must be evaluated to determine how extensively the proposed activity would affect the following functional qualities of the wetland: a. Sediment and pollutant trapping and retention; b. Storage of surface runoff to prevent or reduce flood damage; c. Fish and wildlife habitat; • • d. Recreational use; e. Shoreline or bank stabilization; and f. Noteworthiness, including special qualities, such as historic significance, critical habitat for endangered plants and animals, or others. This evaluation must also include a determination of whether the wetland alteration being proposed requires permits, reviews or approvals by other sections of city ordinances or by other local state or federal agencies including but not limited to watershed districts, state department of natural resources, or the United States Army Corps of Engineers. (2) Alterations must be designed and conducted in a manner that ensures only the smallest amount of bare ground is exposed for the shortest time possible. (3) Mulches or similar materials must be used, where necessary, for temporary bare soil coverage, and a permanent vegetation cover must be established as soon as possible. (4) Methods to minimize soil erosion and to trap sediments before they reach any surface water feature must be used. (5) Altered areas must be stabilized to acceptable erosion control standards consistent with the field office technical guides of the local soil and water conservation districts and the United States Soil Conservation Service. (6) Fill or excavated material must not be placed in a manner that creates an unstable slope. (7) Plans to place fill or excavated material on steep slopes must be reviewed by the city engineer for continued slope stability and must not create finished slopes of 30 percent or greater. (8) Fill or excavated material must not be placed in bluff impact zones. (9) Any alterations below the ordinary high water level of public waters must first be authorized by the commissioner of the department of natural resources under Minn. Stat. § 103G.245. (10)Alterations of topography must only be allowed if they are accessory to permitted or conditional uses and do not adversely affect adjacent or nearby property. (11) Placement of natural rock riprap, including associated grading of the shoreline and placement of a filter blanket, is permitted if the finished slope does not exceed three feet horizontal to one foot vertical, the landward extent of the riprap is within ten feet of the ordinary high water level, and the height of the riprap above the ordinary high water level does not exceed three feet. A riprap permit shall be obtained per the requirements of section 78-969 (f) Excavations where the intended purpose is connection to a public water, such as boat slips, canals, lagoons and harbors, are prohibited above the ordinary high water level. Such excavations below the elevation or the ordinary high water level are subject to approval of the department of natural resources and other agencies with concurrent jurisdiction. (Ord. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Tennessen warning. An individual asked to supply private or confidential data concerning the individual shall be informed of: (a) the purpose and intended use of the requested data within the collecting government entity (b) whether he may refuse or is legally required to supply the requested data; (c) any known consequence arising from his supplying or refusing to supply private or confidential data; and (d) the identity of other persons or entities authorized by state or federal law to r ceive the data. This requirement shall not apply when an individual is asked to supply investigative data, pu uant to section 13.82, subdivision 7, to a law enforcement officer. Subd. 3. Access to data by individual. Upon requuest to a responsible authority or designee, an individual shall be informed whether the individual is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge and, if desired, shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning, the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The responsible authority or designee shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority or designee may require the requesting person to pay the actual costs of making and certifying the copies. The responsible authority or designee shall comply immediately, if possible, with any request made pursuant to this subdivision, or within ten days of the date of the request, excluding Saturdays, Sundays and legal holidays, if immediate compliance is not possible. Subd. 4. Procedure when data is not accurate or complete. (a)An individual subject of the data may contest the accuracy or completeness of public or private data. To exercise this right, an individual shall notify in writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: (1) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual; or (2) notify the individual that the authority believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determination of the responsible authority may be appealed pursuant to the provisions of the Administrative Procedure Act relating to contested cases. Upon receipt of an appeal by an individual, the commissioner shall, before issuing the order and notice of the contested case hearing required by chapter 14, try to resolve the dispute through education, conference, conciliation, or persuasion. If the parties consent, the commissioner may refer to the matter to medication. Following these efforts, the commissioner shall dismiss the appeal or issue the order and notice of hearing. (b) Data on individuals that have been successfully challenged by an individual must be completed, corrected, or destroyed by a government entity without regard to the requirements of section 138.17.
