HomeMy WebLinkAbout1986-08-11 Resolution 1757City of ORONO RESOLUTION OF THE CITY COUNCIL 1757 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT PER MUNICIPAL ZONING CODE SECTION 10.20, SUBDIVISION 3 (G) FILE NO. 905 WHEREAS, Dennis Thompson (hereinafter "the applicant") has an interest in the property located at 250 Old Crystal Bay Road within the City of Orono (hereafter "City") and legally described as follows: That part of Lot 1, Auditor's Subdivision Two Hundred twenty-nine (229), Hennepin County, Minnesota, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said county, lying Southerly of a line drawn parallel with and 240 feet Southerly of, as measured at right angles to, the North line of said Lot 1 and lying Westerly of a line drawn parallel with and 1,070 feet Easterly of, as measured at right angles to, the West line of said Lot 1 (hereinafter "the property"); and WHEREAS, the applicant has applied to the City for a Conditional Use Permit per Municipal Zoning Code Section 10.20, Subdivision 3 (G) to permit a guest/caretaker apartment within the residence located at 250 Old Crystal Bay Road. FINDINGS 1. This application was reviewed as Zoning File No. 905. 2. The property is located in the RR-1B Rural Residential Zoning District. 3. The property contains approximately 16 + acres of area. 4. The property can meet the required area standard for two residental units. 5. The apartment is for the sole use of the owner and shall not be rented. 6. The Orono Planning Commission reviewed the application at their meeting of April 15th, 1985 and voted unanimously to recommend approval of the application finding that it satisfied all standards of Section10.20, Subdivision 3 (G). 7. The City Council has considered this application in- cluding the findings and recommendations of the Planning Commission, reports by staff and comments of the applicant and the effect of the proposed use on the health, safety and welfare of the community. Page 1 of 3 City of ORONO RESOLUTION OF THE CITY COUNCIL NO. 1757 ie City Council finds that granting a Conditional Use Permit to allow the guest apartment/caretaker apartment on the property will not be detrimental to the health, safety or general welfare of the public, would not adversely affect light, air nor pose a fire hazard or other danger to neigh- boring properties, nor will it depreciate surrounding pro- perty values and the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. CONCULSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a Conditional Use Permit to Dennis Thompson for a guest/caretaker apartment within the existing main house, subject to the following conditions: 1. The caretaker/Quest apartment may not be rented out. 2. No variances or other special uses are granted with this application. 3. Violation of or non-compliance with any of the items and conditions of this resolution shall constitute a violation of the Zoning Cade, shall automatically terminate any authority granted herein; and shall be punishable as a misdemeanor. 4. The undersigned owner has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
