RESOLUTION OF THE CITY COUNCIL
NO. 1675
GRANTING A VARIANCE TO MUNICIPAL ZONING CODE
SECTION 10.20, SUBD. 3(K) - FILE 1850
WHEREAS, DennisO.Thompson (hereafter "the applicant")has
an interest in the property located at 250 Old Crystal Bay Road within
the City of Orono (hereafter "City"), and legally described as
follows:
That part of Lot 1, Auditor's Subdivision Two Hundred
twenty-nine (229), Hennepin County, Minnesota, according to
the plat thereof on file or of record in the office of the
Registrar of Titles in and for said county, lying Southerly
of a line drawn parallel with and 240 feet Southerly of , as
measured at right angles to, the North line of said Lot 1 and
lying Westerly of a line drawn parallel with and 1,070 feet
Easterly of, as measured at right angles to, the West line of
said Lot 1 (hereinafter "the property"): and
WHEREAS, the applicant has applied to the City for a
variance to Municipal Zoning Code Section 10. 20 Subd 3 (K) to permit the
keeping of horses for the purpose of breeding, training and sale
to the public.
NOW, THEREFORE BE IT RESOLVED by the City Counci 1 of Orono,
Minnesota:
Findings
1. This application was reviewed as Zoning File No. 850.
2. The property is located is the RR-lB Single Family Rural
Residential Zoning District.
3. The Orono Planning Commission reviewed this
application on August 20, 1984 and recommended approval
of the proposed variance bar--^d upon the following
findings:
a) The applicant's principal residence will be
located on the property.
b) The proposed application requires no additional
variances to the performance standards for the keeping
of domestic animals.

c) The proposed level of use will be compatible with
the surroundng two -acre residential zone.
d ) The proposed use presents no more an intense use of
the property than a hobby farm use.
e) The City received no negative comments from the
surrounding property owners notified during the
review.
4. The City Council has considered this application
including the findings and recommendations of the
Planning Commission, reports by City staff,comments by
the owner and the effect of the proposed variance on the
health, safety and weffare of the community.
5. The City Council finds that the conditions existing on
this property are peculiar to it and do not apply
generally to other property in this zoning district:
that granting the variance would not adversely affect
traffic conditions, light air nor pose a fire hazard or
other hazard or other danger to neighboring property;
would not merely serve as a convenience to the owner,
but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial
property right of the owner; and would be in keeping
with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
Conclusions, Order and Conditions
Based upon the above f indings, the Orono City Council hereby
grants a variance to Municipal Zoning Code Section. 10.20, Subd 3 (K) to
permit the keeping of horses for ,he purpose of breeding, training and
sale to the public subject to the following conditions:
1. No other variances are granted or permitted with this
application except the one specified above.
2. Authorities granted by this variance run with the
property not with the owner, but are permissive only and
must be exercised by application for a building permit
within one year of the date of Council approval, or this
variance will expire on that date September ).0, 1985.

3. Violation of or noncompliance with any of the terms a,.d
conditions of this variance shall constitute a
violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be
punishable as a misdemeanor.
4. The undersigned owner has read, understood and hereby
agree, to the terms of this resolution and on behalf of
himself, his heirs, successors and assigns, hereby
agrees to the recording of this resolution, in the chain
of title to the property.
Adopted by the Orono City Council on this loth day of
September, 1984.
