RESOLUTION OF THE CITY COUNCIL

NO. 1309
� - � � A RESOLUTION APPROVING AND ACCEPTING THE SANITARY SEWER
PROJECT FOR THE MINNETONKA BLUFFS AREA AND THE SHORELINE
DRIVE AREA.
WHEREAS, the Orono City Council on September 15 , 1980
approved the construction of a sanitary sewer system for the
Minnetonka Bluffs area and an area on Shoreline Drive (County Rd. 15)
more commonly known and the Marina area; and
WHEREAS, the construction of the sanitary sewer was constucted
as per �the executed contract; and
WHEREAS, on July 15 , 1981 the construction of the sanitary
sewer construction was completed, approved, and accepted by the City
Engineer, Bonestroo, Rosene, Anderlik and Associates with the exception
of minor restoration; and
WHEREAS, it is understood that there is a one year warranty
for all construction and restoration; and
• WHEREAS, it is further understood that as per the contract
that after one year of the acceptance date of the sanitary sewer system
by the City Engineer that all of the gravity portion of the sanitary
sewer system will be inspected by way of televising to determine any
deficiencies in the system; and
WHEREAS, if it is determined by the City Engineer as a
result of the televising of the gravity portion of the sanitary sewer
system there are needed repairs that those repairs will be corrected
� by the contractor at no cost to the City of Orono; and
• WHEREAS, on July 15th 1981 , the residents affected by the �
construction of the sanitary sewer system were notified that they could
connect their dwelling or business establishment to the sanitary sewer
system.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Orono does hereby accept the sanitary sewer system for the
Minnetonka Bluffs area and the Shoreline Drive area (County Rd. 15) as
per the City Engineers recommendation with the conditions set forth above.
I�Iothing herein shall be construed as a release of any claims , known or
unknown, that the City may have now or in the future arising out of the
project.
