� �- " • ` City of ORONO RESOLUTION OF THE CITY COUNCIL • NO. 1294 • " • • Ai"�IEI�?DIN� RESCULJTIOiV 1288 REGARnIIVG PRO�ERTIES TO BE SERVED BY THE PvGRT:ISHORF DRIVE/HIi��iWOOD SANITARY SE�aER PP,OJECT WHEREAS, ori June 22r 1.981 , the Orono City Council adopt�d Resolution 1288 ordering pr_eparation of plans and specifications far providing Municipal Sanitary Sewer to certain lo�ts in the plat of Highwood Lake Minnetor�ka; and Tw��EREAS, 5 l.ots or comi�.ina'�ions of lots w�re to be serv�d by said project and one prop°rty known as lot 70 was to be excluded from project; and �aHEREAS , an this date the City Caunci.l moved to recansider the decision made by Resolut�_on 1288 regardinc� provi_s;on of sewer service to lot 70; and WHER�AS, lot 70, Highwoo�l Lake Minnetonka is a single • separate lot. af r�cord 50ft wide by 200 ft. cleep (14 ,OQ0 sq. ft. ? :ahich contains a uninhabitable structure lacking footings, foundation, �sanitarv facilities , electricity, heat, insulation and other require- rnents of the State Building C;ode. Al1 surrounding land is owned by the City as pa.rt of Highwood Park. �ot 70 is the same size as nearby lot 72 whir.}z contains a habitable dwelling and which lot 72 i.s to be provided with sanitary sewer service as part of this praject; and WHERE;AS, th� owner of_ lot 70 has been irscl�aded on the maiiing list and the notices for publi� hearings and all other meetings h�ld in regard t� this project, both befor� and after the adoption of Resolutior� 1288, ��nd WHEREF�S , the dE�cision whether �o include �r exclude lot 70 from the 1Vorth Shore Drive/HigY�waod Sanitary Sewer Project has rested with the Cit.y Council and has been cor�sie:ered ir. regard to reports made by City Staff , to comments riade by the owner Meri�on Crooker at the June 8 , 1981 public he�ring, and to past decisions of the Caunc:�1 regarding simi.lar sized prapertiese NOW, THEREFORE BE IT RESOLVE�7 by the City Council of the City of Orono that Res�luti_on 1288 is hereby amended by extending fihe scoz�e of the North Shore Drive/Highwood Sanitary Sewer project to ir�clude nrovision of service to lot 7d , which lot will thereafter �e assessed for such service in the manner of other praperties • incl�acied in this project, This decision shall not be construed as approval of any lot area, lot width or other vari.a:�ce from any zc,ning cade requirement , and shall not be cor.strued as auth�rizing any use , occupancy or habitat.ion of the existing structure on lot 70 except in full compliance with
