depth of the publ.ic waters . Ther� can be no dispute but that �he public
generally and each riparian o�+rner to Lake Minnetonka has the right to use
the entire surface area of Lak� Minnetanka for all suitable purposes in
common with a1Z other riparian awn�rs. This right is a right not on�y to
the m�mi�ers of the public but the right to each riparian awner_ . This
mutual r:�ght of enjoyment kahich is sh�red by riparian owner� and the

Lake Minnetonka by ha�.ring extended their docks out into Lake Minnetonka
beyond the point of navigability and have *ransferred those right� ta
athers 6aho do not have riparian rights and who are not members of th�
general public �vho obtain access and use of Lake Minnetonka by use af
the public access poin�s alms�g Lake Minnetonka. Such commercial rransfers
af the riparian rights of Lake Minnetonka have resulted in an abuse of ,
• reasonable riparian access to La�.� Minnetonka. Such abuses must l�e
r�ualified, r�stricte�d and subordinated to the paramount rights of the

• III . DOCK LAYOUT (reference Exhibit B attached)
Maximum authorized length of main dock 187 feet .
Docks extending beyond 200 ft. and docks encroaching into re-
quired side yard setbacks are hereby specifically declared to
be illegal non-conforming structures which are not permitted under
this license. This application (dee9) (does not) contain such
illegal structures. Al�. such violations are subject to prosec-
ution under Sections 35 . 100 and 73. 010 of the Orono Municipal
Code.
IV. Marina (is) (�9-ne�) authorized for FUEL SALES subject to compliance
with the State Fire Code.
V. Required number of OFF-STREET PARKING SPACES 79
All such spaces must be maintained available on the propertj�
during all summer season hours of operation.
VI . SPECIAL CONDTIONS requized for compliance with the ordinances of
the City and/or the LMCD. The issuance of this license is subject
to full compliance with these conditions . Failure to comply with
these conditions is cause for license revocation and/or prosecution
by the City.
• Sailor ' s World, the licensee, shall be responsible for any and all
activities on the licensed premises including those of the tenant,
Paul ' s Landing, or any other party, and any violation of ordinance
or license requirments by the tenant shall be deemed a violation.
Council grants a temporary parking variance of 27 stalls based on
the following findings:
1) The licensee ' s contractural obligations with Paul ' s Zanding
will cease in 1985; Sailor ' s ��Jorld P4arina will be required to
operate at a maximum dry stacked slip, water slip and buoy use
of 85 units based on the 52 available parking stalls .
2) The licensee is responsible for completion of a parking improve-
ment plan by 5-1-82 consisting of single stall designation and
traffic flow signage. Sailor ' s World has agreed to hire a full
time parking attendent (Sat. & Sun. 8 : 00 Ar7 - 8 : 00 PP�) for the
remainder of the 1.981 season.
3) The City of Orono has made th� City ' s parking lot on County
Road 146 available for the Marina' s overflow parking on week-
ends.
4) All parking spaces identified on Exhibit B shall remain open
during all hours of operation. The licensee shall be respon-
sible for k.eeping patrons from parking on the public right
of way or Shoreline Drive.
• VII. Nothing in this license shall confer upon any person for the bene-
fit of any property any vested right to use Lake Minnetonka or the
premises in a manner permitted by this resolution, but the use of
Lake Minnetonka and the premises shall remain subject to such reg-
ulations and ordinances as the City and other competent regulatory
