RESOLUTION OF THE CITY COUNCIL

A RESOLUTION APPROVZNG A VARIANCE
OF ROBEI2T G. BREDESON FOR A LOT
WIDTH, LOT AREA, LAKESHORE SETBACK
AND HARDCOVER VARIANCES FOR PROPERTY
LOCATED AT .1410 REST POINT ROAD
WHEREAS , the City of Urono is a municipal corpor3tion
organized and existing ur_der the laws of the State of Minnesota; and
WHEREAS, pursuant to State Statutes 412 et. seq. and
462 et. seq. the Ci.ty Council of the City of Orono has adopted
zoning regulations for the protectioz�. of the public health, safety
and general_ welfare; and
WHEREAS, Robert G. Bredeson has applied for variances to
the required lot standards of the LR-1B zoning district and setback
and hardcover regulations for lakeshore propert�° to permit the con-
structi.on of a new home; and
• WHEREAS, the City Council has reviewed the at�plication;
�he recommendation of staff and the Planning Commission and letters
and comments by the applicant.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Orono hereby approves the lot width, lot area, lake-
shore setback and hardcover variar�ces for Robert G. Bredeson
to permit the construr_tion of a new home based on the following
findings of fact:
1) The subject property is located within the
LR-1B zozling district and legally ctescribed
as follows: Lat 1, Subdivision of Lot l�
Rest Point
2) The total area of the 1ot is approximately
23 , 000 sf. The LR-1B zoning district reauire�
43 , 560 sf. The applicant seeks a variance
of 20, 560 sf or 47� .
3) The lat is a peninsula and further restricted
by the 75 ' setback on three sides of the lot
leaving only a 25 ' legal buildable width. The
LR-1B zoning district requires 140 ' . The ap-
plicant seeks a variance of 115 ' or 82� .
41 The lot is a narrow peninsula making it impos-
• sible for any structure to meet the standards
for allowed hardcover and setbacks for lake-
shore properties.

5) There has been an established residence on
the property for over 50 years .
6) The e�cisting residence is served by sewer.
7) The abutting property owners have voiced
no objection to t.he proposed improvements .
8) The special conditions applying to this
property are peculiar to such and do not
apply generally to other land in the dis-
trict in which said land is located.
9) The granting of the application is neces--
sary for the preservation and enjoyment
of a substantial property right of the
applicant.
10) The granting of the proposed variance will
not in any way impair the public health,
safety, comfort, morals or general welfare.
• 1_1) The granting of the proposed variance will
not be contrary to the intent of the Com-
prehensive Land Use Plan or the Zoning Code.
12) The granting of such variance will not merely
serve as a convenience to the applicant, but
is necessary to alleviate demonstrated hard-
ship and difficulties .
FLJRTHERP�IORE, BE IT RESOLVED that based upon the foregoing
findings the City Council approves the many variance required for
the construction of a new home located at 1410 Rest Point Road
subject to the fol.lowing conditions :
1) All new construction or hardcover must be
contained within the following approved.
building envelope: See Attached Exhibit A.
a) 40 ' lakeshore setback - Council will
approve an 8 ' encroachment by the garage
and a 25 ' encroachment by the driveway
because of the location of the City
road serving the pro�erty.
b) 10 ' from north property line
2) All improvements on site to include not only
the principal structure but patio areas , walk-
• �,�3ys and paved and/or gravel driveways may not
exceed 3200 sf of hardcover.

3) The applicant must obtain a demolition permit
for the complete removal of the existing res-
idence prior to the issuance of a building
permit for new construction.
4) This variance application will expire on June
22 , 1982 if a building permit for a new res-
idence on the subject property has not been
issued.
Adopted by the City Council of the City of Orono,
Minnesota at a regular meeting held �r �a 1981.
