HomeMy WebLinkAboutResolution 1267 � • � Cit� o� ORONO • RESOLUTION OF THE CITY COUNCIL • NO. 1267 • � • • A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR JEROME KROGER TO PLANT A TREE AND SHRUB NURSERY ON LOTS 2 AND 3, BLOCK 1 WILLOW RUN WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq. , the City Council of the City of Orono has adopted zoning regulations for the protection of the public health, safety and general welfare; and WHEREAS, Section 34 .032 of the Orono Zoning Code requires a conditional use permit for the planting of a crop in residential districts; and WHEREAS, Jerome Kroger has applied for a conditional use • permit to plant a tree and shrub nursery on property located in the RR-1B, Rural Residential Zoning District; and WHEREAS, after review by the Planning Commission and City staff, the City Council hereby makes the following findings of fact: 1. The subject property consists of two separate , non- combined residential lots totaling approximately nine acres and legally described as follows: Lot 2 , Block 1 - Willow Run Lot 3 , Block 1 - Willow Run 2. The applicant proposes to plant a tree and shrub nursery per sketch submitted with application dated March 18 , 1981. 3 . The applicant is aware of the location and restrictions on the use of the wetlands in Lot 2 , Block 1, Willow Run, per original Flowage and Conservation Easement. 4 . The applicati�n does not involve the construction of a principal or accessory structure. 5. The applicant does not propose the on-site sale of the mature nursery stock grown at this location. • 6 . The proposed use is in accord with the intent and objective of the zoning code and the purpose of the RR-1B Zoning District. 8 . The proposed use is in accord with the intent and objective of the Orono Comprehensive Land Use Plan. 9 . The location of the conditional use permit and the proposed conditions under which it would be operated or maintained are not detrimental to the public health, safety or welfare . 10 . The proposed use is not materially injurious to properties or improvements in the surrounding residential neighborhood. . NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orono hereby approves the application for a conditional use permit for the planting of a tree and shrub nursery, subject to the following conditions : 1 . Council will not approve the on-site sale of nursery stock grown on the subject property either now or at anytime in the future. 2 . Council will not approve of the construction of any accessory structure on the subject property in the absence of a principal structure.
