• • • A RESOLUTION APPROVING A CONDITIONAL USE
PERMIT FOR ROBERT SKINNER AND FRED HINTZE
FOR A RESTAURANT LOCATED IN A SECTION OF THE
EXISTING BUILDING AT 3416 SHORELINE DRIVE
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, pursuant to State Statutes 412 et. seq. and 463 et.
seq. , the City Council of the City of Orono has adopted zoning
regulations for the protection of the public health, safety and
welfare; and
WHEREAS, pursuant to Section 35 .024 of the Orono Zoning
Code, Robert Skinner and Fred Hintze have applied for a conditional
use permit to operate a restaurant in the existing "multi-use" ,
commercial structure at 3416 Shoreline Drive; and
WHEREAS, after review of the Planning Commission and City
• staff, the City Council hereby mdkes the following findings of fact:
1. The proposed restaurant will occupy no more than 324 sq.
ft. of area within the existing building known as The
House of Carpets.
2 . The restaurant will offer "carry-out service" only,
offering a limited menu of pizza, pasta and deli
sandwiches.
3 . The two applicants plan to operate the restaurant and
to be assisted by two part-time employees.
4 . The proposed hours of operatian are 11:00 A. M. to
11:00 P.M. , Sunday through Thursday and 11:00 A. M. to
12 :00 A. M. Friday and Saturday.
5. Five parking stalls located on the west side of the
building shall be reserved for restaurant use. A sign
shall inform customers of additional parking available
in the municipal parking lot to the rear of the building.
6 . The preliminary working plans submitted with this
application have been reviewed and approved by the
Building Inspector and the Planning Commission per
• Section 35.002 of the Orono Zoning Code .
7 . The proposed use of signage for the restaurant satisfies
code requirements of Section 38 .031.

• • • 8 . The proposec� use is in accord with the intent and
objectives of the Zoning Code and the purpose of the
B-1 Zoning District.
9. The proposed use is in accord with the intent and
objectives of the Orono Comprehensive Land Use Plan.
10. The location of the conditional use and the proposed
conditions under which it would be operated or maintained
are not detrimental to the public health, safety or
welfare.
11 . The proposed use is not materially injurious to properties
or improvements in the surrounding business community.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Orono hereby approves the application of Robert Skinner and
Fred Hintze for a conditional use permit for operating a restaurant
subject to the following conditions:
• l . The City Council hereby reserves the right to review
and/or modify the conditional use permit, if at any time
in the future, the Council finds the conditions of the
subject permit to be violated or if the proposed use
is found to be detrimental to the health, safety and
public welfare of Orono citizens. In particular, the
Council hereby reserves the right to restrict the hours
of operation, if complaints are received in the future.
2 . Issuance of this conditional use permit is for the
size and extent of use particularly mentioned herein.
Any expansi.on of floor area devoted to restaurant use
or any inclusion of facilities for dining on the premises
shall require application and review of a new conditional
use permit prior to such expansion. Sale of the business
or premises to a new owner or conversion to a different
use shall require application and review by the City for
approval to transfer this conditional use permit.
3 . This conditional use permit is void if a building permit has
not been issued by April 13 , 1982.
