SUBJECT: 1971 Tax Advances
DATE: June 4, 1970
According to Stanly R. Cowle , Hennepin County Administrator
in his letter of May 12, 1970, the tax advances f or 1971 will
be delayed approximately 30 days. The schedule is as f ollows:
Niarch 30, 19?1 (personal property tax advance of approximately
�p2, �00) , June 20, 1971 and lv'ovember 20, 1971.
It is m� opinion that if the �ounty wishes to revise the tax
advance schedule they should �.11ow the Villages at least or�e
r_��p�e year to prepare f or this change. As you know every March
we have to make a temporary transfer of �20,000 to y�25, 000 from
the Liquor Store to the General Fund to finance expenditures
until we receive our May taz advance. If the county should
follow through on the proposed schedule it would mean the Village
of Orono would have to transfer at least �$45,000 from the
Liquor Store , which is not feasible at this time. Our only
other alternative would be to write warrants against our 1971
tax collections.
Should the county delay the schedule until 1972 it is my
recommendation we bud�et �20,000. 00 contingency fund this year�
this would enable us to handle the 30 day delay in tax advances.
I would suggest the County �dministrator receive a letter in
regard to this matter as well as a copy of the letter be sent
to County Commissioner E. C. Robb.
REMA_:KS: The County �roposal will create a serious
pro}�lem for Orono to finance village operations from
1971 on.
I sug�est we w ite a letter or adopt a resolution
requesting that the� ' dvances be continued on the present
basis.
If this is not continued, then the village will
be forced to levy th $20,000 to use for permanant
ca�ital funds to use ' until tax advances arrive each
year or write tax warrents and b ow and nay`nterest

to advancements of tax collections. LJe arish to apologize for not
responding more promptly, but 4�re have been attempting to formulate a
policy of payments that would be fair to all . This proposed policy
change is now pending before the Qoard of County Co�issioners .
The practice of makin4 advance� dgairst collections prior to the settle-
ment dates established by lar�a was first initiated by the County of liennepin
on an emergency basis only. R�cently the process has increase� to the
point where many political subdiWisions are makina requests for advances
a matter of routine procedure. 7his practice is becoming an administrative
and bookkeeping burden as well as creating inequities bet��:een gov�rnr�ental
entities. The State of ;?innesota, for example, has always maintained a
strict policy of adhering to the dates established by laaa relative to the
settlement of funds to counties dnd other political subdivisions and have
never honored requests for advances. L�lhile ttiey have been strict, this
County recognizes the State's procedure as equitable and fair.
Although state law requires only three tax settlements per year to be made
by the County within 90 days of the final tax payment date, this County
proposes to add to this requirem�nt additional tax payments to be identified
as advances. You will note in the following paragraph extra payments for
the year 1970 to permit you ample time to adjust your budgetary planning.
Advances will be made only in response to a ���ritten request wherein the
specific need or emergency is stated.

Minnesota Statutes 1967, Section 276.11, provides that "Within
90 days after each settlement in February, May, and October the
county treasurer shall pay over to the state treasurer or the
treasurer of any town, city, village, or school district, on the
warrant of the county auditor, all moneys received by him aris-
ing from taxes levied and collected belonging to the state, or
to such municipal corporation, or other body, and deliver up all
orders and other evidences of indebtedness of such manicipal
corporation or other body, . . ."

County stafF has previously ina cated, and with considerable
justificati�n in my opinion, t� t our previous , extra-statutory
tax advancF policy was discrimi atory in many instances and very
difficult administratively. Th County Board desires to treat
all munica_�alities, school dist icts and other entities relying
upon propFrty tax collected in ennepin County fairly, efficiently

• County Administrator proposing the new schedule for tax
advances and settlements for 1971. ' �
' If this proposal is carried out, it has bset� rccomn[ended by
our Village Administrator and T�easurer that the schedule be
delayed until 1972 so that we could prepare for this change.
At the prescnt time, we mus� �nake a temporary transfer from
the Liquor Store every March to the General Fund to finance
expenditures until we receive our May tax advance. If the
County were to follow throu$h on the proposed schedulc, we
would not have the monies in �the Liquor fund to £inance the
General Fund unti2 the proposed June 20th setLlement date.
It is the desire of the Village of Orono Council that the
County retain the policy of tax advances used in the past .
1Ve do not wish ta levy 3 mi11� to our 1971 budget to finance
this program or write warrant� against our tax settlewents ,
that this new schedule would �nake necessary.
