A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND HARDCOVER VARIANCE FOR RONALD CHRISTENSEN � • WHEREAS, the Planning Commission and City Council have 4 reviewed a reguest by Ronald Christensen to reconstruct and relocate an attached garage at his residence located at 3587 North Shore Drive; and ' WHEREAS, said proposal entails major alteration of the lot by grading, filling and retaining wall construction all within 75 ft. of Lake Minnetonka, which work requires conditional use approval pursuant to Section 31. 700 of the Orono Municipal Code; and WHEREAS, said proposal entails construction of a building and driveway within 75 ft. of Lake �Minnetonka which work requires a variance to Section 34. 202 of the Orono Municipal Code; - \ . NOW, THEREFORE, BE IT RESOLVED, that based upon Planning � Commission and City staff research, the City Council hereby makes the following findings of fact: • l. There is an existing residence, an existing detached garage and existing driveway surface on the subject lot, all located within 75 ft. of Lake Minnetonka 2. There is too much existing hardcover on the lot and , no adequate drainage, erosion or siltation control system. 3. There is an existingrflooding problem of the residence and the garage caused by runoff �coming from County Road 15 down onto the property, which flooding threatens the use • and structural integrity of the existing buildings. 4. The existing drainage patterns cause excessive erosion and flow directly into Lake Minnetonka. 5. The existing driveway onto the property is steep and ices dangerously in the winter months. t 6. The existing private road serving this property and five others has an inadequate intersection with County � Road 51 with limited maneuvering room or sight lines. ' 7. The proposal would raise the garage floor and eliminate flooding or flood damage to the home. . 8. The proposal would regrade and raise the driveway elevation to redirect drainage away from Lake Minnetonka, reducing erosion and direct siltation. , I � � � � - • Resolution No. • ' • Page 2 ' � � • 1 . 9. The proposal would provide increased turning and • maneuvering room far all private road users thereby increasing the safety of the private road intersection as approved by Hennepin County Department of Transportation. a 10. The proposal would result in an increase in hardcover of approximately 10$ , which increase is to be compensated by improved drainage, erosion and siltation control. 11. The special conditions applying to the structure or � land in question are peculiar to such property or immediately . surrounding property and do not apply generally to other land or structures in the district in which said land is � located. - � 12 . The granting of the application is necessary for the preservation and enjoyment of a. substantial property right of the applicant. ' " 13. The granting of the proposed variance will not in � any way impair the public health, safety, comfort, morals or general welfare. . � • 14. The granting of the proposed variance will not be . �ontrary to the intent of the Comprehensive Land Use Plan or the Zoning Code. 15. The granting of such variance will not merely serve as a convenience to the applicant, but is necessary to � alleviate demonstrated hardships or difficulties. FURTHERMORE, BE IT RESOLVED, that based upon the foregoing findings, the City Council hereby approves the conditional use permit and hardcover variance as requested subject to the �following conditions: � l. The existing gravel area beside the house will be fully sodded between the road and the lake with no hard surface � • drainageway, and graded or fenced in such a way as to preclude future parking in the side yard. S 2. The necessary retaining wall will be constructed . according to approvecl engineering plans, filled on the lake side as much as possible, and further screened with trees or other vegetation. � • ` . . «w. � Resol•ution No. � � • Page 3 3. Complete drainage plans must be submitted for approval by the City Engineer prior to issuance of the building permit. 4 . The approvals granted by this Resolution will expire if permits are not received and work commenced on or before September 11, 1980, in•which case a new application must be �submitted for review at that time.
