• A RESOLUTION TO DEFER ENFORCEMENT
OF RESOLUTION NO. 1070
WHEREAS, on September 11, 1979, the City Council adopted
Resolution No. 1070 denying a conditional use permit for non�conforming
�use of property at 3220 Navarre Lane; and
• WHEREAS, in that Resolution the City Council noted a prior
agreement to defer enforcement of the permit denial until July 15, 1980
if certain covenants regarding the use of the property were signed
by Richard Proudfit; and -
WHEREAS, Resolution No. 1070 was adopted because such
covenants had not been signed after due notice over five (5) weeks
time; and � •
WHEREAS, subsequent to the adoption of Resolution No. 1070
and initiation of enforcement activities by the City staff, Mr. �
Proudfit did deliver- to the City signed copies of the requested
covenants; and
� WHEREAS, the interit of the City Council was clearly to allow
• rMr. Proudfit time to terminate his non-conforming use of the property
= if such termination was agreed to in the subject covenants,

NOW, THEREFORE, BE IT RESOLVED, that because the requested
covenants have been completed, the City Council hereby agrees to abide .
by the terms of said covenants, the Council directs the City Attorney . -
to file said covenants in the chain of title of the subject property,
and the Council directs City staff to enforce termination of an
illegal-nonconforming use of the property after July 15, 1980,
provided that no increase in the intensity of non-conforming use shall
be permitted between this date and July 15, 1980.
