RESOLUTION NO. /072 ' <br /> • A RESOLUTION TO DEFER ENFORCEMENT <br /> OF RESOLUTION NO. 1070 <br /> WHEREAS, on September 11, 1979, the City Council adopted <br /> Resolution No. 1070 denying a conditional use permit for non�conforming <br /> �use of property at 3220 Navarre Lane; and <br /> • WHEREAS, in that Resolution the City Council noted a prior <br /> agreement to defer enforcement of the permit denial until July 15, 1980 <br /> if certain covenants regarding the use of the property were signed <br /> by Richard Proudfit; and - <br /> WHEREAS, Resolution No. 1070 was adopted because such <br /> covenants had not been signed after due notice over five (5) weeks <br /> time; and � • <br /> WHEREAS, subsequent to the adoption of Resolution No. 1070 <br /> and initiation of enforcement activities by the City staff, Mr. � <br /> Proudfit did deliver- to the City signed copies of the requested <br /> covenants; and <br /> � WHEREAS, the interit of the City Council was clearly to allow <br /> • rMr. Proudfit time to terminate his non-conforming use of the property <br /> = if such termination was agreed to in the subject covenants, <br /> ;, <br /> � . <br /> NOW, THEREFORE, BE IT RESOLVED, that because the requested <br /> covenants have been completed, the City Council hereby agrees to abide . <br /> by the terms of said covenants, the Council directs the City Attorney . - <br /> to file said covenants in the chain of title of the subject property, <br /> and the Council directs City staff to enforce termination of an <br /> illegal-nonconforming use of the property after July 15, 1980, <br /> provided that no increase in the intensity of non-conforming use shall <br /> be permitted between this date and July 15, 1980. <br /> Adopted by the City Council of the Ci:ty of Orono on the 2,�� <br /> day of , 1979. <br /> F <br /> e <br /> : <br /> � il iam B.
