COOPERATIVL PURCHASIrd� AGREET�'P1m
t^JI�EREAS, the Commissioner of Administration o_f the State of
llinnesota, procures for State Agencies throuqh competitive bidding
various supplies, corunodities and equipment, which are then ordered
by or for the Agencies by appropriate methods, and
WHEREAS, the State Lec�islature by t�innesota Statutes 1969 ,
Sec. 471.59 has authorized the State and its Political Subc�ivisions
to enter into agreerients to exercise jointly the governmental powers
and functions each has individually, and
���HEREAS, the State and the City of Orono wish to corabine
their purchasing functions as is specificallv provided below s� that
the City of Orono r�1ay avail itself of the prices which have been
agreed upon by the State and its Vendor.
TIiEREFORE, it is the purPose of this Ac�reement to r:lake
available to the City of Orono the cor,unodities listed below, at the
prices and terr.ls as are available to the State under contracts entered
into under corapetitive bidding pursuant to P4.S. (1969) , Chapter 16 ,
by the Corimissioner of Administration.
• (1) Kustor,l KR-10 Radar Unit
IT IS AGREED that if the City of Orono chooses to buy fron any
such State Contracts, it shall purchase all of its rec�uirements for the
above cor.unodities a� they arise by placinc� purchase orders against such
State Contracts, for the cortmodities stated, in accordance with all
conditions, terms, specifications, and prices stated in such Contracts.
Orders shall be issed by the City of Orono in accordance with its
regularly authorized purchasing procedure. The �tate Contract Number
shall be shown on the Purchase Order.
The City of Orono shall make payment directly to the Vendor in accordance
with its establishec� procedures. Neither the State nor its Purchasing
agent, personally or officially, shall assurle any responsibility for
the accountability of funds expended hereunder by the City of_ Orono, or
the issuance or non-issuance of_ any x�urchase order by the City of Orono.
Each party shall separately be accountable for its own expenditures of
public funds made hereunder. Both parties hereto agree to save and hold
each other harmless from any loss or damage for any reason arising from
this agreement.

AN ADDEPIDUM TO RESOLUTION #1054
BE IT RESOLVED that the City of Orono enter into an
agreement with the State of P2innesota, Department of Public Safety
for the following purpose, to-wit:
To reimburse the county for monies spent in connection
with project grant nunber 79-05-02 for the purchase of moving radar
at 50� of the net contract price of the radar unit but not to
exceed $289.50 per-radar unit. ,
BE IT FURTHER RESOLV�D that the P4ayor of the City and
City Administrator be and they hereby are authorized to execute
such agreement.
