HomeMy WebLinkAboutResolution 1049 � :.. � � RESOLUTION N0. 1049 RESOLU^1ION REGARDING ALLOCATIOTJ OF SEWER CAPACITY OF THE PROPOSED MEDIPJA-ORONO SEWER PIPE WHEREAS, The City of Medina has present pollution problems existing with on-site septic systems in that area of the City of AZedina known as the Medina-Morningside District, and therefore the City of Medina desires to con- nect the tdedina-Morningside District to the City of Orono � trunk sewer system, and . \ WH�REAS, The City of Orono expressed a prior willingness to �assist the City of Medina in solving its existing pollution problem, and WHEREAS, The City of Orono will construct and/or has constructed and owns and operates various trunk and lateral sanitary sewer lin�s which service various land use areas in __ the City of Orono, and those sewer lines are needed to serve present and proposed development in the City of Orono, and tiVHEREAS, the City of Medina needs to utilize a portion , of the capacity of those sewer lines to solve its existing • pollution problems , and WHEREAS, based upon the prior request by the City of Medina, the City of Orono had tentatively agreed with the City of Medina to allow for an allocation of capacity in the proposed new pipe and its use of the Orono sewer line, all as set forth in the preliminary engineering report done for the City of Medina, Minnesota, Medina-Morningside area, dated October, 1978, by McCombs-Knutson Associates, Inc. , and WHEREAS, based upon the tentative agreement, the City of Orono has finalized further its sewer capacity needs based upon its land use plans and desires of the property owners in � the City of Orono included in the present sewer-benefited area, NO�V, THEREFORE, BE I^1 RESOLVED AS FOLLOWS: l. That the City of Orono reaffirms its prior repre- ' sentation to the City of Medina that it is willing to assist the City of I�iedina in solving its present pollution problem existing with on-site septic systems in the area of the City of Medina known as the Medina-Morningside District.. i � -,� . � � 2 . That the City of Orono is willing to allow the City of Medina to build the sewer pipe within the City of Orono as set forth in the preliminary engineering report and to allow the sewage collected thereby to be deposited into the sewer pipe of the City of Orono as set forth in the preliminary engineering report. 3 . That the prior understanding with the City of A�edina must remain and that is that the sewer pipe to be constructed by the City of Medina may service only the Medina-Morningside District which may not involve more than a total of 83 homes, which homes must be located in the AZedina- Morningside District. �� , 4. Any additional allocation of sewer capacity to the City of Medina would result in increased sanitary sewer flow which could not be handled by the City of Orono' s truizk sewer system and downstream sewer systems given those systems ' pre- sent capacity and the prior commitments by the City of Orono for using that existing capacity in the pipe belonging to the City of Orono for the benefit of properties previously assessed for sewer in the City of Orono and which presently need and/or want the sanitary sewer hool�-ups. For the above reasons, the City Council of the City of Orono • • declines to give up any more of its sewer capacity than was previously agreed. Specifically, the City Council of the City of Orono declines to provide any additional sewer capa- city for the 31 units requested by Mr. Fred Keller and five units requested by Mr. Wayne Neddermeyer, all for the devel- � opment of land which is presently vacant in the City of Medina.
