lti'}iEREAS, t�e Joint Ind�pendent School District 287
(hereinafter applicant) has appl3ed for extension of a conditional
use permit to operate a fai-m in tl-�e RR-1-B district, which farm
provides planting areas for studEnts of the applicant, and use of
a bridge over the creek for limited access to. adjac�nt agricUltural
fields for iarroing Uses only, and
j,'�-]EREAS, the use requires a conditional use pei-mit pursuant
to the Orono Zoning Code, and
l,�};ERE_AS, on 2•�ay� 9, 1977, the City Council adopted '
Resolution 781 granting said conditional use permit for a period
of one year, and •
k'NERFAS, the . applicant has ehplained to the City Council

• � NOW, THEREFORE, BE IT RESOLVED: '

. 1_ That tl�e City of Orono l�ereby extends the co�i i nal
use permit for one year based on the following conditions:
A. T'hat the only activities that shall be Undertaken
on tlz'e_properties �shall be the special crop production which includes
• such areas as orchards, vegetables, nursery stock, sod, Christmas
trees, small grains and annual and perennial -flowers and the
_ construction of one: small bridge to provide access from tbe propertp
in Qrono to the property owned by the applicant for agricultural
, purposes only. The bridge may be used only for the passage of tbe
farm equipment and may not be used for general pedestrian traffic.
g_ On a temporary �basis, satellite sanitary facilities
�and a mini�al shelter such as a small mobile constniction trailer
for use by the students while on tlze properties, may be installed
on the properties pursuant to municipai and, State regulations.
C. There sball be no stUdent parking on the properties
since the applicant will provide transportation from the classroom
�aboratory building which is Iocated off tl�e properties.
D. The acc es s to County Road �6 shall be us ed for
agricultural purposes only. �
E. The location �of t�e proposed trailer sl�all be approved
bv the building inspector prior to ' installation. �

by the appl�cont that it is vc-Ly i�;,port�nt tnat the City grant this
con�itional use pc_r3nit at this t���e bccause of scheduling confliets
the appl�cant has with its students,

year only �nd �he �ppl� cant �hall tei �nir,ate all use of the property
pursuant to the tei-ms of tnis conditional i�se pei-mit one year from
the date hereof; any further use shall be subject to tl-ie Orono Zoning
Code and furtl-�er Council action_
5. The appl �cnnt �nd the property owner acknowleoge tl�at
t�ey have no vested rights to contir�ue this operation beyond one year
without first applying for and acguiring from the -City of Orono any
of the necessaiy permits for such a continuat �on,
� 6. This conditional use shall apply to approxirr.ately three
acres �ahich the applicant is proposing to lease from the Orono Piiblic
Schools and shall apply to approximately 22 acres that the applicant
has purchased from Tfrs. E.�a Gardner in the City of Orono.
This resolution was adopted at the regularly _sch'eduled Council meeting
of June 12, 1979 and is subject to the signing- hereof by the applicant
and the property owner on attacl�ed �hibit A_

k'e have read the foregoing and agree to the ter�s thereof_ Specifically,
we acknowledge that we have no vested rigl�ts or any rights to continue
with the operation of the project or bridge as per7nitted ��nder this
conoitional use permit beyond one year from the date of the adoption
of this resolution by tl�e City Council. -
