A RESOLUTION APPROVING THE PLAT OF �
TOURANGEAU ADDITION
• �
WHEREAS, the �ity .of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota ; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development
of land within the City; and
WHEREAS, the City Council has considered the application
for a subdivision plat by A. J. Tourangeau, the subdivider; and '
� WHEREAS, the subdivider has completed all requirements of
the platting regulations of the Cityr, includi�.g:
l. Dedication on the plat of drainage and utility easements .
2. Execution of a Developer' s Agreement providing for
instaliation of curbing, fencing and building improvements
% � prior to reoccupancy of the service station at
1960 Shoreline Drive; or prior to October 15, 1979,
- whichever occurs first.
3. Legal combination for tax purposes of lots 7 - 14 and
20, Ora Park, Lake Minnetonka, as one residential parcel.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
�ity of Orono hereby approves the plat of Tourangeau Addition, Hennepin
County, Minnesota; subject to the following conditions :
The aforesaid plat shall be filed with the Hennepin
County Recorder' s Office on or before October 3, 1979
together with a certified original copy of this Resolution.
The approval granted by this Resolution shall expire if the plat has
not been filed by the date specified above. In that event, it will
be necessary to file a new application' with the City of Orono for
subdivision review. . .

DEVELOPER' S AGREEMENT FOR
SERVICE STATION IMPROVEMENTS

R. W. REUTIMAN and ARTHUR J. TOURANGEAU
THIS AGREEMENT Made and entered into this "�da of

, 1979, by and between the CITY OF ORONO, a
Municipal corporation organized under the laws of the State of
Minnesota (hereinafter called "City") , and R. W. REUTIMAN and
ARTHUR J. TOURANGEAU, and their heirs , successors and assigns ,
(hereinafter called "Developers") .
WITNESSETH:
• WHEREAS, Arthur J. Tourangeau made application to the
City Council for approval of a plat of Tourangeau Addition; and
WHER�':a.S, the City Council has granted approval for such
development on the condition in part that developer Reutiman
enter into this agreement to provide for the installation of
improvements hereinafter described on the terms and conditions
hereafter set forth;
NOW THEREFORE, in consideration of the premises and of
the mutual promises and conditions hereinafter contained, it is
hereby agreed as follows:
1. Property Descri tion: Existing service station
property at oreline Drive to be subdivided
becoming Lot 2, Block l, Tourangeau Addition.

• 2. Im rovements: In accordance with the policies and
ordinances o� i�'ty,—the following described public or private
improvements (hereinafter collectively called the "Improvements")
shall be constructed and installed on the terms and conditions
hereinafter contained:
A. Installation of 6" asphalt or concrete traffic
separation curbing as shown on attached Exhibit A.
Area between curbing to be filled with gravel or
landscaped with grass.
B. Installation of screening fence or wall, no less
than 5 ft. high and no more than 6 ft. high, along
the north and west property lines as shown on attached
Exhibit A. Fence or wall to be of material and color
approved by the City.
C. Blocking up with masonry existing west window in
service station building (and roviding mechanical
ventilation where required by Code�.
3. Construction Plans: The following described detailed
plans and speci ications or t e comp lete installation of the
Improvements shall be submitted by the developer for the approval
of the City prior to the start of construction. The Plans and
specifications shall conform to all current City standards for
• all applicable work.
4. Construction of Improvements:
A. Commencement Date - The construction of Improvements
shall begin no later than July 1, 1979.
B. Completion Da.te - All Improvements shall be completed
no later than October 10 , 1979, or building,occupancy,
whichever occurs first.
C. Contractors - The Developer shall select, retain
and supervise the Contractor(s) responsible for
Improvement construction. The City reserves the right
to require satisfactory proof of successful experience
and adequate financial status of any such experience and
adequate financial status of any such contractor. Where
required by City ordinance, the contractor shall first
obtain a license from the City.
D. PreConstruction Conference - Prior to the start of
any construction, the Developer and the Developer' s
Contractor shall meet with the responsible City official�
to review construction plans and schedules.

E. Permits - Prior to the start of any construction,
the Developer' s Contractor shall apply for and
receive all necessary permits from the City and/or
government agencies having jurisdiction.
F. Construction - The construction, installation and
materials shall be in accordance witht3ze plans and
specifications approved by the City.
G. Insurance - The Developer will cause each person
who constructs and installs any Improvement to
maintain complete insurance coverage including Workmen's
Compensation, Liability and Property Damage.
S. Performance DeEosit: For the purpose of assuring
to the City t�iat t�mprovements will be completed according to
the terms of this agreement , and that the Developer will pay all
claims for work done and materials and supp lies furnished, the
Developer has deposited with the City at the timec€ the execution
of this agreement , cash, certitied funds or an irrevocable letter
of credit in a form satisfactory to the City providing that the
City is able to draw upon such funds or letter of credit in its
sole discretion to complete the Improvements. If the Developer fails
to satistactorily complete the work prior to the completion date
specified in Section 4 above.
A. Deposit Interest - If cash or certified funds are
deposited with the City as herein provided, the City
shall deposit same in an interest-bearing account.
If Developer completes the Improvements in accordance
with this agreement, the principal amount of such
deposit, together with all interest thereon, shall
be refunded by the City to the Developer.
B. Letter of Credit Expiration - If an irrevocable
letter of credit is deposited with the City, said
letter of credit shall expire no sooner than six months
after the completion date specified in Section 4 above,
ar no sooner than October 30, 1979, whichever is later.
C. Perfannance Deposit Amount - $3,000.00.
6. Fees and Ex Pe� n-s�-es: The Developer agrees to pay all
City fees require per the current City Fee Schedule and further
agrees to completely reimburse the City for all the variable
additional expenses it incurs in regard to the review and approval
of the Improvements inc�nding, but not limited to, direct City pay-
roll and overhead, costs , and fees paid to consultants and other
professionals. For the purpose of assuring the City that these expenses
