Dear Mr. Weckman:
am writing to follow up to our conversation of approximately one month ago regarding
the septic system located near the rear of our property at 258 Cygnet Place. In August of
1996 we were issued a permit to connect our property to the municipal sewer. That was
done and a septic system in the front yard was abandoned. From that time on the entire
waste flow from our residence has entered the municipal sewer.
As we discussed earlier, the basement level in our house does have a non-functioning
floor drain that is connected to a septic system that is not on our property. That drain has
now been filled with cement. In the basement there is also a sump pump that routes any
water generated from the use of a humidifier, water softener and air conditioner to the
ground surface As discussed with you, this would be acceptable.
The issue left to resolve is to determine who should be responsible for the septic system
attached to our basement drain that is on our neighbor's property. We have made some
inquiries about this. We have been advised that legally we have no right or duty to
trespass on our neighbor's property to take steps to abandon this septic system. We have
also talked with a contractor who has told us he will not do an abandonment of that
system at our request because we do not own the land it is located on. No one has lived
in the neighboring house since August of 1997. We have tried to contact the owner of the
property to discuss the issue but have not been able to locate that person. Hennepin
County records indicate the fee owner is Lisa Kannenberg and also show a Lawrence
Gross. "Trustee. The county told us that mail delivered to the last taxpayer address (the
property) has been returned.
We can think of no further action to take at this point. Please advise us as to what you
would suggest we do.
