RESOLUTION N0. 1008 i A RESOLUTION APPROVING LOT AREA AND LOT WIDTH VARIANCES BUT DENYING SETBACK VARIANCES FOR LOT 18, �BLOCK 13, SAGA HILL REVISED WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, pursuant to State Statutes 412 et. seq, and � 462 et. seq. , the City Council of the City of Orono has adopted zoning regulations for the protection of the public health, safety and general welfare; and � WHEREAS, Paul C. Clabo has applied for lot area and lot width variances to build a structure on I,ot 18, Block 13, Saga Hill Revised; and � _ WHEREAS, the Planning Commission and City staff have reviewed the facts and circumstances involved in this application; • WHEREAS, the City Council has reviewed the application; the recommendations by the staff and the Planning Commission; comments by Mr. Clabo; and comments by the neighbors to this property; and WHEREAS, the City Council of the City of Orono makes the following findings of fact: 1. The property is located in the LR-1B Single Family Lakeshore Residential use district .which has among � others the following minimum requirements : Lot Area - One acre Lot Width - 140 feet � Front Yar'd - 35 feet • Side Yard - 10 feet each side � Rear Yard - 30 feet Between 500 - 1000 feet of the shoreline, there shall be no greater than 35% hardcover. • . �� � V . Resolution No.1008 ' • Page 2 � 2. The property is deficient in regard to the items ' • as set forth in Paragraph 1 for the following reasons : A. The lot area is 8300 sq. ft, which is 20% of the area required - variance requested 80%. B. The lot is 50 ft, wide at the street which is 36% of the width required - variance requested 64%. 3. The property is substandard in size in relationship to the other lots in the area. 4. The property has been in single separate ownership since at least 1969. 5. The property was .occupied with a habitable cabin as � recent as 1969. , , 6. The property has been assessed for and has been provided • with a sewer service connection. 7. Construction of a single family residence on this 1ot will not materially affect the public health, safety, or welfare. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves of said lot area and lot width variance application subject to the condition that no other variances will be considered or permitted. A11 future construction on the property shall be in full conformity with front, side and rear setback requirements, with building height requirements and with maximum hardcover requirements of the LR-1B zoning use district, except that the front yard setback shall be no less than the front yard setback of the existing neighboring house to the south, or 35 ft. whichever is greater. The applicant, Paul C. Clabo, shall agree to this condition which agreement shall be indicated by his signature 1�.ereon. This variance shall expire one year after adoption as provided by Section 32. 371 of the Zoning Code. ' AG : � � . Paul C.
