HomeMy WebLinkAboutResolution 1006 RESOLUTION N0. 1006 � i A RESOLUTION REAFFIRMING PRELIMINARY SUBDIVISION APPROVAL FOR ROGER FAZENDIN, 2700 SIXTH AVENUE WHEREAS, on March 16, 1978, the City Council adopted Resolution No. 889 preliminarily approving a subdivision for Roger Fazendin subject to certain conditions ; and WHEREAS, prior to April 17, 1978, Roger Fazendin signed said Resolution thereby agreeing to said conditions ; and WHEREAS, said preliminary approval expired on August 16, 1978 because said conditions were not completed by that date; and WHEREAS, Mr. Henry Neils , acting with interest in the subject property, has requested reconsideration of some of the conditions of preliminary subdivision approval ; and said request has received a lengthy review by the City Council; and WHEREAS, none of the applicable zoning or subdivision � regulations has been changed since March 16, 1978, NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby reaffirms the preliminary subdivision approval for Roger Fazendin and hereby extends the deadline for submittal of a final subdivision application to July 13, 1979 subject to the following conditions : 1. The final sub division shall be submitted in the form of two mylar copies of a record plat, fully executed by all parties having an interest in the property. 2. The Subdivision plat shall include the following: A. Designation of "wetland" on the drawing. ��B. Dedication of drainage and utility easements along all lot lines . C. Dedication of County Road Six to a width of forty (40) feet from the centerline of Hennepin CSAH Six, Plat S. , D. Dedication of a utility easement for sewer purposes according to applicant ' s negotiations with the City of Medina (or evidence of a written easement for said sewer) . (� , � ` Resolution No. 1006 Page 2 � • 3. Dedica tion of a Flowage and Conservation Easement over "the wetlands as shown on the plat of . . . . . . . . . . ". 4. Submittal of an up-to-date title opinion addressed to the City. 5. Submittal of a sketch or map showing the location . of existing driveways or curb cuts into the property plus submittal of a copy of the Hennepin County driveway permit issued for construction of the new (in 1977/78) access onto the Neil 's parcel. - 6. Payment of a park dedication fee accordirig to the current schedule ($250.00 total) . 7. To ensure uniform front yard building setbacks with . adjoining platted property, and because of a 40 ft. � right-of-way dedication instead of the 50 ft, dedication . . originally required in Resolution No. 889, a condition � of this Subdivision shall be that the minimum front yard setback on this property shall be increased from 50 ft. to 60 ft, measured perpendicularly from the right of way- of Sixth Avenue North. This resolution will expire on �July 13, 1979 if the above required inform�tion has not been submitted to the City ' for final approval.
