A RESOLUTION AUTHORIZING THE PERMANENT TAHING OF LAND
BY EMINENT DOMAIN FOR DRAINAGE AND UTILITIES
WHEREAS, the City Council has determined that it is necessary and in the public
interest that the City acquire by eminent domain a permanent drainage and utilities easement for
public purposes at the location hereinafter specified.
WHEREAS, the City Council has ordered preparation of a resolution authorizing the
taking of such easement by eminent, domain, and authorizing the City Attorney to commence
condemnation proceedings.
THEREFORE,BE IT RESOLVED,by the City Council of Orono:
1. That it is hereby determined that the taking of a permanent drainage and utilities
• easement for public purposes over the parcel of land set forth in paragraph 4
hereof is necessary and in the public interest, in addition to the ingress and egress
easement previously authorized and as a part of those eminent domain
proceedings.
2. That the City shall acquire by eminent domain a permanent drainage and utilities
easement for public purposes over the parcel of land set forth in paragraph 4 �
hereof, and that the City Attorney is hereby authorized and directed to commence
condemnation proceedings, including a motion for "quick-take" transfer of title
and possession in the District Court of Hennepin County and for appointment of
Commissioners to determine the damages, if any, sustained by those persons with '
interests in the property as a result of such taking.
3. That the City Attorney is hereby further authorized to acquire such permanent
easement through settlement with those persons with interests in the property, if
such permanent easement can be acquired through settlement in conjunction with
obtaining the easement provided for in City of Orono, Resolution of the City
Council No. 5097. �
4. That the land referred to above is more particularly described as follows:
The Easterly one-half(1/2) of the alley formerly known as
Oak Place laying adjacent to the Westerly 30 feet of Lot 1,
