THIS INDENTURE, made this
day of May 19 68
between H. K. Grunlund _ _ and Minnie his wife,
hereinafter referred to as "Grantors" and the VILLAGE OF ORONO, a
municipal corporation, hereinafter referred to as "Grantee";

WHEREAS, the Grantee is desirous of obtaining an easement
on land hereinafter described for the particular purposes described;
NOW, THEREFORE, in consideration of One Dollar and other good
and valuable consideration paid by the Grantee to the Grantors, the
receipt and sufficiency of which is hereby acknowledged, the Grantors
hereby grant unto the Grantee, its successors and assigns forever, a
perpetual easement for the following purpose:
A perpetual easement for underground utility purposes over, under and
across that part of Tract C of Lots 3 and 4, Block 1, "Wiley's Park"
Lake Minnetonka, Hennepin County, Minnesota, lying within 5 feet on
each side of the following described centerline: Commencing at the
Southwest corner of Tract C; thence Easterly along South line of Tract C
a distance 87.0 feet to the point of beginning of the centerline being
described; thence Westerly to a point on the West line of Tract C,
said point being distance of 40.0 feet North of the Southwest corner
of Tract C and there ending.
Together with a temporary construction easement over, under and across
that part of Tract C lying within 10 feet North and South of said above -
described centerline.
on the following described real estate:
Lot 3, Block 1, Plat 43620, Parcel 1200, Wiley's Park
Lot 4, Block 1, Plat 43620, Parcel 1600, Wiley's Park
including, but not by way of limitation, a full and free right and
authority for the Village or its agents, to enter upon and use the said
land in connection with the aforementioned purposes.
The Grantors hereby covenant for themselves and their successors, heirs
and assigns, to refrain from performing any act on, or constructing or
erecting ao fixture or improvement on said land which would interfere
with Grar easement herein established.
