� A RESOLUTION GRANTING VARIANCES
TO MUN
TCIPAL ZONING CODE
SECTIONS 78-350(B); 78-282; AND 78-1288
- FILE NO. 03-2928
'WHEREAS,Michael Mischke,a single person,(hereinafter"the applicant")is owner of '
the property located at 1972 Shadywood Road within the City of Orono(hereulafter the"Cifiy")and legally
described as follows:
Lot 37, "Shadywood",Hernzepin County, Minnesota
(hereinafter the"property"); and
WHEREAS,the applicant has made application to the City of Orono for variances to '
Orono Municipal Zoning Code Sections 78-350(B);78-282; and 78-1288 to allow construction of a
• detached garage and a first floor level deck on a lot of 0.16 acres in axea and 50'width where 0.5 acres
in area and 100'width is required;to allow a building encroachment of the side yard and street yard,as�''��'�"—�....
well as building encroacl�unent within the 75'lakeshore yard where no structure is normally allowed;ar�d
to allow hardcover in excess of the 0%hardcover normally allowed in the 0-75'lakeshore zone and in
excess of the 25%hardcover nonnally allowed in the 75-250' lakeshore zone.
NOW,THEREFORE BE IT RESOLVED bythe City Council of Orono,Minnesota:
FINDINGS • �
1. This application was reviewed as Zoning File#03-2928.
2. The property is located in the LR-1C Lakeshore Residential Zoning District,which
requires minimum lot area of 0.5 acres(21,780 s.f.)and minimum lot width of 100'.
� The lot area is 0.16 acres (6,915 s.f.) and defined lot width is 50'.
3. The Plazuiing Commission reviewed this application at apublic hearing held on Mazch 15,
2004 and on a vote of 5-2 recommended conditional approval of the applicant's"Plan A" '
based on the following findings and recommended conditions:
a. A house has existed on the property for many years,and the prop erty is served�
by municipal sewer and water. � �`,

b. The existing house andproposed 400 s.f.gara�e will coilstitute 1490 s.f.of lot
coverage by structures,just tulder the 1500 s.f.lot coverage allotment for lots less
than 10,000 s.f. in area.
c. Tlie corifiguration ofthe existing house and proposed side-loading garage will
mulunize hardcover while still allowuig for off-sh eet velucle parldng in fiont ofthe
garage. The side setback variance of 5'to the iioith lot line will allow for adequate
parking area and bacicup aproii on tlus nanow lot wlule lzaving no negative impact
on neighboring pro�erties.The street setback vai-iance to allow a street setback
of 9.8'where a 10'setback is iionnallyrequired will have no negative impacts on
the neighborhood. '
d: A small first-floor level deck of no greater than 100 s.f.slzould be allowed on
tlie southeast lake side of tlle house to serve the two existing doorways at that
comer. However,such deck,landings and steps to grade should be located so
• as to minimize the additional encroaclunent of hardcover a.nd structure in the
0-75' setback zone.
e. The small lot size and the proximity to Coffee Channel are hardships in that
approximately 3/4 of the area of this developed lot is within 75'of the shoreline.
The 25%75-250'hardcover allotrnent would allow only 43 8 s.f.o f hardcover on
tlle site,which would not allow for the minimal existing house, garage, and
driveways and sidewalks necessaryto maultain a residence on the site without
variances.
4. .The City Council llas considered this application,including the recominendations and
findings of the Planning Commission,reports by City staff,corrnnents by the applicant and
the public,and the effect of the proposed variances on the health,safety a�id welfare ofthe
community.
5. The City Council finds that the conditions existing on this property are peculiar to it and do
not apply generally to other property in this zoning district;that granting the variances
would not adversely affect traffic conditions,light, air nor pose a fire hazard or other
danger to neighboring properiy;would not merely serve as a convenience to the applicant,
but is necessary to alleviate a demonstrable hardship or difficulty;is necessary to preserve
a substantial propertyright of the applicant;and would be in keeping withthe spirit and
• intent of the Zoning Code and Comprehensive Plan of the City.

� CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings,the Orono City Couiicil hereby grants
variaiices to Orono Municipal Zoning Code Sections 78-350(B), 78-282, and 78-1288 to allow
constructioii of a detached gaxage and a first floor level deck on a lot of 0.16 acres in area and 50'width
where 0.5 acres in area and 100'width is required;to allow a side yard setback of 5'where a 10'setback
is nonnallyrequired,and a street yard setback of 9.8'where a 10'setbacic is normallyrequired,as well
as building encroacl�unent within the 75'lakeshore yard where no structure is normally allowed;and to allow
hardcover ul the 0-75'lakeshore zone of 1357 s.f.or 26.3%where no hardcover is normally allowed;and
to allow 1003 s.f.or 573%hardcover in the 75-250'zone where only 25%hardcover is norrnally allowed;
and to allow the garage and deck structures within 75'of the shoreline where no structure is normally
allowed, subject to the following conditions:
1. Council approval is based on site plan"A"submitted by the applicant and as annotatedby City
staff,attached to this Resolution as Exhibit A. Any amendments to the site plan which are not in
• conformity with City codes will require fizrther Planning Commission and City Council review.
2. Only the hardcover areas noted as approved onExhibit A shall be allowed.Hardcover in the 0-75'
zone shall not exceed 1357 s.f.or 26.3%and within the 75-25 0'zone shall not exceed 1003 s.f.
Applicant is advised that anyfiiture proposals for additional hardcover on thepropertywill likely
not be approved,but might be approved only in conjunction with concurrent hardcover removals
� to result iil no net hardcover increase on the property.
3. Areas shown on the approved site plan listed as non-hardcover decorative landscape beds shall
iiot henceforthbe lined with plastic or fabric sheeting,nor by any other material that would make
them impervious to rainfall runoff infiltration,and any such existing materials shall be removed prior
� to the footing inspection for the garage.
4. The deck on the lakeside of the house shall not be enclosed and shall not extend above the
first floor level, except that a standard railing may be constructed for said deck. The deck
shall not exceed 100 s.f.in footprint area,including the deck,landings and steps to the ground,and
no part of said deck,landuigs or steps shall extend inore than 4 feet lakeward of the east wall of
the existing house,but rnaybe configured in a shape of applicant's choosing as long as it serves
both existing doors near the southeast corner of the house.

5. Final garage plans shall be revised to incorporate a low-pitch roof system such that will be iil
compliance with City requuements that the defined height of the garage shall not exceed the defined
height of the principal residence structure.
6. Authorities granted by this resolution run with the property not with the applicant, but are
permissive oi�ly and must be exercisedbyobtaining abuildingpemlit forthe new consfiructionwitivn
one year of the date of Council approval,or the variance will expire on that date(March 22,2005).
7. Violation of or non-coinpliance with any of tlle terms and conditions of this resolution shall
constitute a violation ofthe zoning code,shall automatically terrninate any authority granted herein,
and shall be punishable as a misdemeanor.
8. The undersigned applicant has read,understood and hereby agrees to the terms of this resolution
and on behalf of the applicant and the applicant's heirs,successors and assigns,hereby agrees to
• the recording of this resolution in the chain of title of the property.
