A RESOLUTION GRANTING
A CONDITIONAL USE PERMIT
FOR PLUMBING IN AN ACCESSORY STRUCTURE
PER MUNICIPAL ZONING CODE
SECTION 78-303,SUBDIVISION (17)
FILE #04-2976
WHEREAS,Jaines W.Pierpont and Judith A.Pieipont,husband and wife, (hereinafter
"the applicailts")are owners of the property located at 1801 West Farm Road within the City of Orono
(hereinafter "City") and legally described as:
Attached"Exhibit A" (hereinafter"the property"); and
WfIEREAS,the applicants have applied to the City for a conditional use perrnit per
� Miuucipal Zonulg Code Section 78-303,Subdivision(17)to allow pluinbing including a toilet,bathroom
sink and shower to remain in an existing accessory structure formerly used as a guest house; and
WHEREAS,after due published notice and mailed notice in accordance with Minnesota
Statutes and the City of Orono Zonuig and Planning Codes,the Orono Planning Commission held apublic
hearing on January 20,2004,at which times all�persons desiring to be heard concerning this application
were given the opportunity to speak thereon.
NOW,THEREFORE,BE IT RESOLVED bythe City Council of Orono,Minnesota:
FINDINGS
1. Tliis application was reviewed as Zoning File#04-2976.
2. The property is located in the LR-1 A Zoning District,where 2 acres is the minimum lot
area. The property is approximately 4 acres in gross area including wetlands.
3. The Plarming Cominission reviewed tlus application on January20,2004 and on a vote of
4-1 recommended approval of a CUP for plumbing in the accessory structure,based on
the following findings:

a. The proposed use of tlze accessoiy structure with plumbing will not be
detrimental to the residential character of the neighborhood.
b. The plumbing fixtures proposed are in keeping with the intended use of the
accessoiy structure.
c. The property size and accessory building location axe sufficient to allow the
conditional use permit to be granted. The noncoizformity of the building
location is mitigated by the existing screening and adequate separation
distances to neighboring homes.
, d. The CUP should be suUj ect to the standard"Plurnbing in Accessory S tructure"
conditions.
� e. The retention of the existing kitchen fixtures 'in the structure would not be
� appropriate as that would inake the building easily functional as a guest house
for which tlze property does not qualify.
4. The City Council has considered this application including the findings and
recominendations ofthePlanning Comrnission,reports by City staff,comments bythe
applicants and the effect of the proposed conditional use permit on the health,safety and
welfare of the community.
5. Tlze City Council finds that wl�ile removal of kitchen fixtures is appropriate for the intended
use,retention of the antique kitchen sink basin/washstand without water supplyplumbing
would notbe inconsistent with the intended use ofthe structure norwould it result in a use
detrimental to the neighborhood.
6. The City Council finds that graiiting a conditional use permit to allow plumbing in the
accessory structure will not b e detrimental to the health,safety or general welfare of the
public,would not adversely affect light, air nor pose a fire hazard or other danger to
neighboringproperties,norwill its use depreciate surroundingpropertyvalues and thatthe
proposed level ofuse ofthepropertywill be inkeeping withthe intent and objectives of
tlie Zoning Code and Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more ofthe fitidings noted above,the Orono City Council hereby grants
a conditional usepemut perMunicipal Zoning Code Section 78-303,Subdivision(17)to allowplumbing
including a toilet,bathroom sink and shower to be retained in the existing accessorystructure,perthe site
plan and building floorplans attached to this Resolution as Exhibit B and as annotatedby City staff,subject
to the following conditions:
1. The applicants shall,prior to this resolution taking full effect and within 90 days of the date
of tlus resolution,remove the following existing ldtchen fixtures aud facilities from the structure in
question: -
- cooktop (no oven exists)
-refrigerator
-water supply plumbing to the kitchen sink(sink basin and stand may remain in place
� without water supply plumbing; waste phimbing does not have to be removed)
2. The applicants by executing this resolution agree and covenant that the property will be
bound by the following conditions:
A) Kitchen fixtures including refrigerator,stove/range/cooktop,and water supply to the kitchen
sink,shall not be reinstalled or installed in the accessory structure unless specific approval
to do so is granted by the City Council,and installation of such fixtures in the future without
Council approval shall be considered a violation of the conditions of this resolution;
B) The accessory building will not be used for a home occupation unless specifically
approved by City or if allowed by City code;
C) The accessory building will not be used as a dwelling unless a guest house CUP is
obtained (site is not large enough to qualify); and
D) � The accessory building will not be rented, leased or otherwise provided for use as a
dwelling under any circumstances.

3. Authorities granted by this resolution run with the property not with the applicants,but are
pennissive only and must be exercised by completing the above noted kitchen fixture rernovals
witivn the time frame established above and byobtauung a final inspection for same withinone year
of the date of Council approval, or this approval will expire on that date (March 22, 2005).
4. Violation of or non-compliance with any of the terms and conditious of this resolution shall
constitute a violation of the Zoning Code,shall automatically ternunate any authority granted herein,
and shall be puiushable as a rnisdemeanor.
5. The Luidersigned applicants have read,understood aud hereby agree to the terms ofthis resolution
andonbehalfofthemselves,theirheirs,successors andassigns,herebyagreetotherecordingof
this resolution in the chain of title of the property.
