Box 1177 • Willmar, MN 56201 Dear Sir: The City of Orono has received complaints concerning the condi- tion of the railroad right-of-way adjacent to the rear yards of specific homes along Crystal Bay Road within the City of Orono. Specifically, a neighbor has complained of piles of debris and tree trimmings left within your right-of-way that would endanger or create hazards for his property. I have enclosed a plat map that has been marked to locate the specific areas referenced to by complaintant. The City has inspected the area and can confirm numerous piles of clippings and tree trimmings. We have also observed the following within Burlington's right-of-way: 1. Sheds located partially or totally within your right-of- way 2. Fencing 3. Piles of firewood 4. Garages partially within right-of-way 5. Private drives Please advise the City if you have any records of granting special easements or temporary use easements for these various improvements. Many of these improvements are classified by Orono Code as accessory structures requiring a principal structure to permit their legal use. If these structures are to remain on your property, the City wi 11 require that either the railroad or the appropriate property owners obtain a conditional use permit to permit the continued use of these non -conforming structures.
