TO: Planning Commission <br />FROM: Dexter ?tars ton <br />SUBJECT: Variance - Charles Welter - 3309 Crystal Bay Road <br />DATE: April 6, 1973 <br />The Welters own Lot 1 of Wallaces Addition, Lot 1 is 50' wide and in <br />1969, when a 20' street east of them was vacated, it was given to Lot 1. <br />The Village maintained a water easement on this property and a letter <br />from Mike Scheller is included describing *.he limitations that were <br />placed on the vacated street. <br />The Welters would like to construct a garage which would extend onto <br />the vacated street portion of their property and feel that adequate <br />setback from the water main can be maintained. �-Ir. Mills, the Village <br />Engineer, has reaffirmed that the conditions listed in Mr. Scheller•s <br />letter of October, 1969, are still valid and no construction should <br />take place on the vacated street. <br />The proposed garage also extends onto railroad property. The Welters <br />have corresponded with the railroad about this problem, but have <br />not yet received a reply, No affirmative, if it is desired, should <br />be taken until we have railroad approval. <br />
