Per your request, Resolution No. 1163 approving a side
yard variance for Steven Haverberg was sent to the county
for recordings on Haverberg's property. It was discovered
that Haverberg's property is Registered or Torrens property.
The Hennepin County Torrens office will not accept
resolutions for recording on Certificates of Title.
There are two reasons for the Torrens department not
accepting this resolution. First of all, the subject
matter of the resolution is not necessarily of a real
estate nature, rather it is of an administrative nature
dealing with City business. Secondly, the Torrens office
in general, hesitates to accept any resolution from any
city to be recorded on a Certificate of Title. Their
reasoning is that once the resolution becomes a memorial
on the Certificate, and the existing property owner or
new property owner wishes to remove such a memorial, a
court proceeding must ensue costing between $300 and $500.
I have experienced this problem in the past, with the
Torrens department as regards recording resolutions from
cities.
