A RESOLUTION GRANTING VA.RIANCES TO MUNICIPAL ZONING CODE i SECTION 78-1279, 78-1288 � FILE NO. OS-3079 � . , � WHEREAS, Peter M. Thomas and Nicole M. Thomas, husband and wife (hereinafter "the applicants") are the owners of the property located at 1385 Orono Lane within the City of Orono (hereinafter the"City") and legally described as follows: } See Attached Exhibit A (hereinafter the"property"); and • WHEREAS, the applicants have made application to the City of Orono for variances to Orono Municipal Zoning Code Sections 78-1279 and 78-1288 to pernut construction of a wrought iron deck within the lake yard requiring a 0-75' zone hardcover . variance to permit 10.79% hardcover when 0% is normally allowed and 10.79% currently exists and also a lake setback variance to permit a lake setback of approximately 56' when 75' is normally required. . . NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,Minnesota: FINDINGS 4 � 1. This application was reviewed as Zoning File#OS-3079. 2. The property is located in the LR — lA zoning district, which requires a minimum lot area of 2.0 acres. The applicants' property is approximately 1.387 acres in area. 3. The Planning Commission reviewed this application at a public hearing held on January 18, 2005 where a motion to deny yielded a tie vote. I � f� a. Because the wrought iron deck will be placed over existing mechanical equipment, no fiuther negative visual appearances from the lake will i result. b. The mechanical equipment will restrict the deck from becoming anything other than wrought iron,which is almost entirely permeable. � kc. The deck will not be any closer to the lake than the existing lake yard j encroachments, which were approved by variance in Resolution f #4604. i d. The removal of 100 s.f. of driveway within the 0-75' zone will benefit the lake much more than the addition of the proposed wrought iron deck that is almost entirely permeable. • 4. ,The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed � . variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring � property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in . keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby � grants a variance to Orono Municipal Zoning Code Sections 78-1279 and 78-1288 to permit construction of a wrought iron deck within the lake yard requiring a 0-75' zone . hardcover variance to permit 10.79% hardcover when 0% is normally allowed and • 10.79% cunently exists and also a lake setback variance to permit a lake setback of approximately 56' when 75' is normally required, subject to the following conditions: Page 2 of 6 � °� � 0 0 • �� CITY of ORONO � --- : � , ti ti RESOLUTION OF THE CITY COUNCIL ��`�k'EsH.og'�G . NO. � � � '� . l. Council approval is based on the site plan submitted by the applicants and � annotated by City staff, attached to this Resolution as Exhibit B. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. , 2. Hardcover in the 0-75' zone shall not increase above the 10.79%. Hardcover in the 75-250' zone shall be limited to 7,433 s.f. or 26.76% per the proposed plan and hardcover allowance suinmary as depicted in Resolution #4604 and on ! Exhibit B. Applicants are advised that any future requests to increase hardcover � or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent � reduction in existing hardcover. � 3. Applicants shall remove all plastic or fabric liner material from the decorative � landscape beds on the property to ensure their permeability as non-hardcover surfaces. 4. The applicants shall remove 100 s.f. of driveway bituminous within the 0-75' zone as depicted on Exhibit B. , 5. Applicants are advised that the intent of the City Council is to not allow the wrought iron deck to be converted to a porch of any kind, and any future variance request to do so is not likely to be approved. I6. Required remova�s of hardcover shall be completed by the first inspection of the f proposed wrought iron deck. i � f 7. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be exercised by obtaining a building , permit for the new construction within one year of the date of Council approval, ' or the variance will expire on that date(February 28, 2006). 8. Violation of or non-compliarice with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. • 9.
